Overview
The final plat includes 11 single family lots with varying lot sizes between 4 -
17 acres in size. The 11 lots are concentrated on the western half of the total
110 acres. The eastern half is primarily wetland that will not be impacted
with the exception of a road to access the developable portion of the property.
The 11 single family lots platted on 110 acres translate into a density of 1
unit per 10 acres. Although some of the lot's areas are less than 10 acres, the
overall density meets the A-1 dimensional requirements.

The final plat has been revised to reflect a wider right-of-way at the
northwest corner of the plat to accommodate a shifting of a future road to
save the existing trees along the north property hne. The plat also shows 66
feet of right-of-way on the balance of the streets which is 6 more feet than
typically required. If the developer would like to reduce this right-of-way to
60 feet, the plat may be adjusted accordingly. Anoka County has indicated
that they need an additional 27 feet along Jarvis Street to accommodate
future widening of this county road. The plat will need to be modified to
reflect this additional right-of-way per Anoka County's requirements.
Drainage and Utility Easements
Typical drainage and utility easements have been provided throughout the
plat including easements to encumber all of the wetland areas that exist.
The one area of concern is an area where mitigation is proposed to occur and
the drainage and utility easement may not be consistent with that mitigation
plan. Staff would recommend that the area of mitigation be covered with a
drainage and utility easement, and if the plat needs to be changed, that the
easement be adjusted accordingly.
Street Construction
Prehminary plat approval by the City Council provided the developer two
options in completing the road to the western hmits of the property. These
two options included:
· Constructing the road all the way to the western hmits at this time, or
Provide a Class 5 base from the point where the bituminous would end
and the western hmits of the plat, and provide the City payment to install
the bituminous at a later date.
The developers have not indicated which option they will choose; however,
this stipulation will be made part of the developer's agreement and one of the
two will be completed.
Recommendation
It is recommended the City Council approve Resolution No. 96- ., granting
final plat approval for Dan Boman (Ridgewood Hills), allowing the
subdivision of 110 acres into 11 single family lots with the following
conditions:

As you requested, we have reviewed the final plat of Ridgewood Hills Addition. This is
the 10-acre lot subdivision proposed by Dan Boman in the northeast part of the City. The
final plat was prepared by Scholl and Mattson, Inc. Based on our review, we would offer
the following comments;
The road rights-of-way internal to the plat are shown as 66 feet. The City
ordinance only requires 60 feet.
In the far northwestern corner of the plat, the proposed road right-of-way has been
expanded to 75 feet. This is to save the existing trees along that north plat line.
The review by Anoka County along County Road 24 had requested an additional
27 feet of right-of-way for a total of 50 feet west of the centerline. This is not
shown on the final plat.
It appears that all necessary drainage and utility easements are provided to protect
the existing wetlands and to provide for the necessary mitigation on the project.

WHEREAS, application has been made for final plat approval, pursuant
to Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the
property legally described on attached Exhibit A and hereinafter referred to as
"the Property"; and
WHEREAS, the application for preliminary plat approval has been
referred to the Planning Commission which has given its advice and
recommendation to the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on February 26, 1996; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the
Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
It is hereby determined by the City Council for the City of Elk River as
follows:
The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
The physical characteristics of the site, including, but not limited
to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control
and all other services, facilities and improvements otherwise
required herein.
The proposed subdivision will not cause substantial environmental
damage.
The proposed subdivision will not conflict with easements of
record or with easements established by judgment of a court.
The proposed subdivision will not have an undue or adverse
impact on the reasonable development of neighboring land.
Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
The owner of the Property is authorized to record the final plat as
required by law and shall file proof of said recording with the City. No
building permits will be issued for the Property until the final plat is
recorded.
This final plat approval shall expire two years from the date of this
resolution if the final plat is not recorded within that time.

and Zoning Administrator Steve Rohlf.
COUNCILMEMBER DIETZ MOVED TO APPROVE THE WETLAND MITIGATION PLAN FOR

6. THAT THE DEVELOPER PROVIDES THE CITY WITH A STATUS REPORT ON THE
REPLACEMENT WETLANDS ONE YEAR AFTER THEY ARE CREATED.

City Planner Steve Ach reviewed his memo to the Council regarding the .
preliminary plat for Dan Bowman.
Vice Mayor Holmgren opened the public hearing.
Madelyn Moose, 10246 221st Avenue expressed her concern regarding her trees
and fence along her property.
Dan Bowman stated it did not matter whose trees they were, he will not destroy
the trees.
There being no further comments from the public, Vice Mayor Holmgren closed
the public hearing.
Dan Bowman expressed his concerns regarding three issues:
1. Extending the road to the west property line.

The width of the cul-de-sac, and changing if from 32' to 28' which would
save approximately $2,000.
Street lights vs. individual security lights.
City Engineer Terry Maurer stated that all developers build everything in their
plat, which means extending roads fo the plat limits. The developer could
provide money to the City and not construct the entire road at this time. Terry
Maurer also stated that Elk River Utilities typically requires street lights at every
intersection. The City Engineer expressed a concern with reducing the cul-de-
sac width to less than 32'. Mr. Maurer suggested the Council reduce other costs
by ,$2,000 for Mr. Bowman rather than reducing the cul-de-sac width.
COUNCILMEMBER SCHEEL MOVED TO APPROVE THE PRELIMINARY PLAT FOR DAN
BOWMAN WITH THE FOLLOWING CONDITIONS:
A DEVELOPERS AGREEMENT BE PREPARED OUTLINING THE TERMS AND
CONDITIONS OF THE PLAT APPROVAL AND NECESSARY ROAD
CONSTRUCTION. THIS DOCUMENT NEEDS TO BE PREPARED AND EXECUTED
PRIOR TO RELEASING THE PLAT FOR RECORDING.
ADDITIONAL RIGHT-OF-WAY AND OTHER COMMENTS AS REQUESTED BY
ANOKA COUNTY BE INCORPORATED AS PART OF THE PLAT APPROVAL.
IF THE DEVELOPER IS GOING TO SAVE THE TREES ALONG THE NORTH
PROPERTY LINE, ADDITIONAL RIGHT-OF-WAY WILL NEED TO BE DEDICATED
TO ALLOW THE ROAD TO BE CONSTRUCTED WITHIN THE CENTER OF THE
RIGHT-OF-WAY.
THE CITY COUNCIL APPROVED THE WETLAND MITIGATION PLAN AND ALL
CONDITIONS OF THAT APPROVAL BE INCORPORATED INTO THE
CONDITIONS FOR FINAL PLAT.
ALL OF THE COMMENTS IN THE CITY ENGINEER'S MEMO DATED 1/17/96 BE
INCORPORATED INTO THE REVISED PRELIMINARY PLAT AND MADE A
CONDITION OF THIS APPROVAL.
DETAILED GRADING PLANS OF EACH OF THE STORM WATER
DETENTION BASINS BE PROVIDED FOR THE CITY ENGINEER'S REVIEW
AND APPROVAL.

A LETTER OF CREDIT IN THE AMOUNT OF 100% OF THE COST OF THE PUBLIC
IMPROVEMENTS BE PROVIDED PRIOR TO RELEASING THE FINAL PLAT FOR
RECORDING.

15. APPLICANT OBTAIN THE APPROPRIATE PERMITS FROM THE CORPS OF

Other Business
City Administrator Pat Klaers informed the Council of the County Board Meeting,
Thursday, February 29, 1996 and the Special City Council meeting on March 4,
1996, at ,6:00 p.m. Councilmember Scheel will not be present on 3/4/96. The
City Administrator also stated the City will close on the Cass property on March
6, 1996, and the City is ordering new microphones for the Council Chambers.

Staff report by Steve Ach. Menards, Inc. is requesting a conditional use permit
for site plan approval to construct a 160,680 square foot commercial building on
Lot 1, Block 1, Hillside Crossing II. The subject property is an 11 acre site locate at
the southeast corner of Highway 169 and 197th Avenue. The Menards site will
have access off Evans Street, which will extend from Sax Foods up to 197th
Avenue. Steve reviewed comments in the staff report relating to the site plan,
traffic, access, parking, fencing, outdoor display, fire protection, landscaping,
building materials, and signage. Steve noted 412 parking stalls have been
included, with 9 of them being handicapped accessible. Aisc, he noted staff
recommends a landscaping theme be continued throughout the PUD similar to
the Hillside Crossing I PUD.
Terry Maurer, City Engineer, indicated they have completed the grading and
utility plan for the Hillside Crossing II plat and have submitted the plans to the
engineer for Menards. He noted that he has received the plans back from
Menards and anticipates there will be no problems with compliance.
Commissioner Anderson asked the 14 foot fence will be made of wood.
Mary Prochaska, Engineer representing Menards, Inc., explained the fence will
be made of vertical 2' x 8' brown treated lumber.
Commissioner Sullivan asked when the lights shown near the fence will be lit. Mr.
Prochaska stated the lights will be lit dudng the hours the store is open. He
noted the lights have visual side cut-offs and should not be visible outside of the
fenced area.
Commissioner Minton asked for clarification regarding the yard barn display. Mr.
Prochaska stated the yard barns will be constructed, painted and decorated for
display at the north end of the site. Commissioner Minton asked if the proposed
metal cover for the storage racks located next to the fence would cause a
glare problem. Mr. Proohaska stated that he did not feel there would be a
problem, given the 14 ff. height of the fence.
Commissioner Anderson questioned if there would be any other outdoor
displays, other than the yard barns. Mr. Prochaska stated the vadous types of
fencing they sell will be displayed on the front of the building in the same area
as the yard barn display.
Commissioner Minton asked for clarification on the underground sprinkling
system. Mr. Prochaska explained that the system is an underground frost-free
type system which is hooked up to garden hoses. Commissioner Minton asked
questioned in some trees could be saved in the triangular shaped area. Steve
Ach stated it would not be possible due to the grading.
Commissioner Sullivan asked for clarification on Terry Maurer's comment
regarding the parking stalls near the yard entrance. Terry Maurer explained that
he felt customers may have a problem backing out of these stalls if there were a

line of cars waiting to access the yard. Mr. Prochaska stated these stalls will be
used primarily by the yard attendants and should not be a problem.
Commissioner Anderson asked if Menards planned to use speed bumps in the
parking lot. Mr. Prochaska explained since the traffic will be entering off the
street and making parallel routes throughout the lot, he did not feel there would
be a problem.
Commissioner Minton asked if the Police Department concerns had been
addressed. Mr. Prochaska explained felt given the geometrics of the plan, there
would not be a problem with lighting. Aisc, Mr. Prochaska stated the lighted
product signs on the wall of the building would be set on a time clock fo go off
approximately 1 hour after store closing.
Chair Dillon opened the public headng. There being no comments from the
public, Chair Dillon closed the public headng.
Commissioner Minton that two letters have been received which stated
concerns regarding the proposed Menards facility; one from Cheryl Becker and
one from Jeff Meyer.
Chair Dillon expressed his concern for hoses lying on the ground with the type of
sprinkling system proposed by Menards. Chair Dillon felt the City should require
the same type of sprinkling system for all developments to remain consistent.
Chair Dillon also expressed concern for the yard entrance canopy and felt some
type of building material which would be compatible fo the Menards structure
should be used.
Discussion followed regarding the yard canopy, The Commissioners were in
general agreement they did not have a problem with the yard canopy as
proposed, with the exception of Chair Dillon.
Chair Dillon stated he felt the outdoor display should be located within the
outside storage yard. He noted Sax and Target requested outdoor displays and
were denied. Discussion followed regarding the location of the yard barn and
fencing display. Commissioner Sullivan stated she did not have a problem with
the yard barn display. She felt the type of storage was unique. Commissioner
Anderson stated when visiting other Menards stores, outdoor displays include
patio and lawn furniture, patio brick and other items. Mr. Prochaska stated
those stores had chain link fencing around the outdoor storage display area for
security and this area would not; therefore, those items would not be displayed
in the yard barn display area. Chair Dillon questioned if the display area could
become a security issue in the future.
Commissioner Anderson concurred with staff's recommendation for additional
landscaping along the fence.
COMMISSIONER MINTON MOVED THE PLANNING COMMISSION RECOMMEND
APPROVAL OF THE REQUEST BY MENARDS, INC. FOR A CONDITIONAL USE PERMIT
FOR SITE PLAN APPROVAL, PUBLIC HEARING CASE NO. CU 96-2, BASED ON THE
FINDINGS IN THE STAFF REPORT, THE CITY ENGINEER'S LETTER, AND THE FACT THERE

WAS NO OPPOSITION DURING THE PUBLIC HEARING, SUBJECT TO THE FOLLOWING
CONDITIONS:

REVISED SET OF PLANS PRIOR TO ISSUANCE OF A BUILDING PERMIT.
ALL OF THE CITY ENGINEER'S COMMENTS IN THE MEMO DATED MARCH 22,
1996, BE INCORPORATED INTO THE DEVELOPMENT PLANS PRIOR TO
ISSUANCE OF A BUILDING PERMIT.
ALL OUTDOOR STORAGE AND DISPLAY ALONG THE FRONT OF THE BUILDING
