Overview
The final plat involves approximately 23 acres of property which will be
subdivided into 41 single family lots. The final plat has its only access off of
County Road No. 1 with streets within the plat extended to the property
hmits, providing for future connections to adjacent property. Additional
access opportunities will be available to County Road No. 1 with the platting
of the surrounding property at a later date.

Outlot A is a portion of the plat that will be replatted with the property
immediately to the south of the proposed final plat. On the preliminary plat,
0utlot A was presented as three lots on a future cul-de-sac. It is staffs
understanding that there will be a land swap between the two property
owners to accommodate the street construction off of County Road No. i at
this time, and preserving the development of the lots within Outlot A at a
later date.
DNR Approval
Since the City Council approved the preliminary plat, the DNR has had an
opportunity to review in greater detail the impact to the DNR stream with
the proposed plat design. The design as presented and previously approved
is acceptable to the DNR and the developer will just be responsible for
obtaining the appropriate permits.
Street Design of Access Road Off County Road No. I
Staff has been discussing with the developer specific design of the entrance
road off of County Road No. 1. Staffs concerns are that this entrance road's
geometrics line up with the County's plans for the realignment of County
Road No. 44 immediately to the west. Since the County does not have any
specific plans for County Road No. 44 at this time, the County has suggested
the City go ahead and design the street and the County will follow with the
appropriate design to County Road No. 44. Staff believes that this segment
of street should be designed with a landscaped median and the adequate
number of lanes to accommodate the future traffic demands at this
intersection. It is difficult to imagine that this intersection will receive a lot
of residential traffic; however, given the potential development in this area,
this access point on the County Road No. I will serve as a primary entrance
point for up to 150 single family lots. The landscaped island is not so much
for channelization of the traffic; rather, an aesthetic entrance into this
development and match into the anticipated geometrics of the intersection
across County Road No. 1.
Pedestrian Access
The Park and Recreation Commission has recommended a on-street striped
shoulder from County Road No. 1 along the short segment of street included
in this plat and extending eastward through a future plat to make the
connection to a possible trail corridor that would extend to the City's main
trail corridor, approximately 1/4 mile to the east. As mentioned above, staff
is working through some street designs to accommodate a landscaped median

and lanes for future traffic demands. One of the street designs includes a
short sidewalk extension along the south side of Street G as labeled in the
final plat, from County Road No. 1 to the east. This short segment of
sidewalk would facilitate pedestrian movements from County Road No. 1 to
the first residential street interior to the development where pedestrians can
then travel on street to the future trail corridor. (See attached detail).
Recommendation
It is recommended that the City Council approve Resolution No. 96- .,
granting final plat approval for Nordic Woods by Rick Lund, which includes
the following conditions:
A DEVELOPER'S AGREEMENT BE PREPARED OUTLINING THE TERMS AND CONDITIONS
FOR PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS.
COMMENTS OUTLINED IN THE CITY ENGINEER'S MEMO DATED 2/19/96, BE
ADDRESSED AND INCORPORATED INTO REVISED PLAT.
RECOMMENDATIONS FROM THE PARK AND RECREATION COMMISSION BE
INCORPORATED INTO THE PLAT AND A PARK DEDICATION PAYMENT BASED ON A
PER LOT BASIS BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING.
WATER AVAILABILITY CHARGE IN THE AMOUNT OF $300 PER LOT BE PAID TO ELK
RIVER UTILITIES PRIOR TO RELEASING THE FINAL PLAT FOR RECORDING. DEVELOPER
SHOULD CHECK WITH ELK RIVER UTILITIES FOR ANY ADDITIONAL CHARGES RELATIVE
TO WATER CONNECTION FEES.
SURFACE WATER MANAGEMENT FEE IN THE AMOUNT OF $5,067.60 BE PAID PRIOR
TO RECORDING THE PLAT WITH SHERBURNE COUNTY.
ALL OF THE APPROPRIATE APPROVALS BE RECEIVED FROM THE DNR REGARDING
ANY IMPACT TO THE STREAM, PRIOR TO RECORDING THE FINAL PLAT.
A TREE PRESERVATION PLAN BE SUBMITTED ALONG WITH THE GRADING PLAN FOR
EACH PHASE OF THE DEVELOPMENT TO MAXIMIZE TREE PRESERVATION DURING
CONSTRUCTION, AND THAT THE USE OF RETAINING WALLS AND OTHER
APPROPRIATE METHODS BE UTILIZED TO PRESERVE AS MANY TREES AS POSSIBLE
DURING THE CONSTRUCTION.

AN NPDES PERMIT BE OBTAINED FOR THE GRADING ASSOCIATED WITH THIS
DEVELOPMENT.
A DETAILED EROSION CONTROL PLAN BE SUBMITTED AND APPROVED BY THE CITY
ENGINEER AND DEPARTMENT OF NATURAL RESOURCES, PRIOR TO COMMENCING
GRADING ON SITE.

APPROPRIATE PERMITS BE OBTAINED FROM SHERBURNE COUNTY HIGHWAY

RE: NORDIC WOODS FINAL PLAT
Dear Mr. Ach:
As requested, we have reviewed the final plat for the Nordic Woods development. The
plat was prepared by E. G. Rud & Sons, Inc. Based on our review of the final plat and
comments presented to the Planning Commission and City Council, we would offer the
following comments:
On the east side of Lot 1, Block 4, and on the north side of Lots 1 and 6, Block 3,
there is proposed storm drainage piping. The drainage and utility easements in these
locations should be widened to accommodate these proposed pipes.
The rear lot area of Lots 2 and 3, Block 3, contains a low area that, according to the
grading plan, is not proposed to be filled. There is a drainage and utility easement
provided over Lot 3 in this area, but none is provided over Lot 2. If this low area
is not to be filled, additional easement will be required on Lot 2, Block 3.
The three lots proposed to be traded with the Nord family are shown as Outlot A.
There is a low area in this area that a utility and drainage easement is provided over.
One of our comments on an earlier review was to fill this low area because it does
not appear that an emergency overflow can be provided. This needs to be further
evaluated and possibly the grading plan changed and the drainage and utility
easement eliminated.
The entrance road referred to as Street G off of CSAH No. 1 is shown as a 60-foot
right-of-way. We would recommend that the right-of-way be widened to at least 70
feet to correspond with the existing drainage and utility easement in this area. As
you will recall, trunk sewer and water were previously installed in this area and the
City acquired a 70-foot easement from the Nord family. We would suggest that
easement just be incorporated into right-of-way as these areas are platted.

The need for a booster pumping station for the water system in this plat is being
evaluated in detail at this time. It may be determined that the booster pumping
station is only needed to serve a small number of lots. If this is the case, an option
for the Developers would be to not construct a booster pumping station and also not
develop those lots which would require that facility for water service. If that is the
chosen alternative, those lots which cannot be served by water should also be
reflected as outlots on the final plat.

To date, we have not received drainage calculations for this plat. These should be
submitted and reviewed prior to filing of the final plat, because they could affect the
size and/or need for drainage and utility easements.

A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
NORDIC WOODS
CASE NO. P 95-8
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on March 25, 1996; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
It is hereby determined by the City Council for the City of Elk River as
follows:
The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.

The physical characteristics of the site, including, but not limited
to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
The proposed subdivision will not cause substantial environmental
damage.
The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.

The proposed subdivision will not have an undue or adverse
impact on the reasonable development of neighboring land.
Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
This final plat approval shall expire two years from the date of this
resolution if the final plat is not recorded within that time.
