Ach, City Planner~~ April 29, 1996 Consider Request by Riverside Development to Grade Outlot A Hillside Crossing South Issue Riverside Development has requested a permit to grade approximately an acre of property immediately south of 193rd Avenue and east of the existing SuperAmerica station (see attached map). This grading would involve lowering the site approximately 12 feet to create a building pad for a possible commercial retail/fast food development. The material taken from this site will be used to fill a wetland at the east end of 193rd, as well as transporting some of the excess material to the ice arena site. The amount of material generated from this site will be in excess of 1000 cubic yards. This concept was presented to the city by Riverside Development when the existing office building and approved 24,000 square foot commercial center were presented. Based on the office building concept, staff felt the projects layout fit with the natural characteristics of the property and provided a reasonable "transition" in land use from the highway commercial along Highway 169 to the residential towards the east. 13065 Orono Parkway · P.O. Page 2 These types of issues are not typically presented to the City Council; however, this request raised some additional concerns which staff wanted the Council to be aware of. If it is the Council's desire to see this area converted to a more intense commercial use, it is clear that the traffic at the intersection of 193rd and Evans will demand additional traffic control by either inst~lling stop signs or possibly a signalized lighted intersection. If a signalized intersection is anticipated the funding of this improvement will need to be considered. Recommendation Staff would prefer to see this area left natural and developed as originally proposed with the two to three office buildings. Riverside Development September 27, 1994 Page 3 separate these two land uses both physically and visually to further enhance the compatibility of these two land uses. The developers have proposed to create a wetland along the southeast portion of this plat. That mitigation work will slightly encroach into the tail end of the natural buffer described above. PROPOSED USE OF PROPERTY Staff has met with the developers and expressed the importance of leaving the natural buffer in place. The developer's plans include building two to three (2 - 3) office buildings strategically located within the natural parameters of the site. Therefore, it appears that both staff and developers are trying to accomplish a project that best fits within the natural boundaries. Since this area will be platted as an outlot, a replat will need to occur prior to the Planning development. At that time, a concept plan could be presented to ~ Commission and City Council whereby easements could be iden protect the natural buffer. OUTLOTS As mentioned earlier, Outlot A will be deeded to the City for drainage and utility purposes. As for Outlot B, this area can not be developed until it is replatted at a later date. However, in order to access Lot 1, Block 1, at the south end of the plat, a driveway will have to be installed within the drainage and utility easement that traverses the plat from north to south from 193rd Avenue. PARK AND RECREATION COMMISSION RECOMMENDATION The Park and Recreation Commission discussed this plat informally and concluded that cash would be recommended. However, the Commission will take this item up at the October meeting and make a formal recommendation. RECOMMENDATION It is recommended the Planning Commission recommend approval of the preliminary plat request by Riverside Development to subdivide the seventeen (17) acres into one commercial lot and two outlots with the following conditions: riverside.pc c¢~nsider a Land Use Amendment Request bY Riverside Development, Public Headnq, Case No. LUA 94-7 Request for a comprehensive land use plan amendment changing the land use from MR (Medium Density Residential) to HB (Highway Business) for a strip of property approximately one hundred feet in width along the southeast border of Oak Parc Plaza. Request for a zone change from R lc (Single Family Residential) and PUD (Planned Unit Development) to C3 (Highway Commercial) for a strip of property approximately one hundred feet in width along the southeast border of Oak Parc Plaza. Planning Commission and Staff recommend approval of the request. Cbnsider Preliminary Plat Request by Riverside Develogment, Public: Hearinq, Case No. P 94-11 Request for a preliminary plat to plat approximately seventeen (17) acres into one commercial lot and two outlets. Planning Commission and Staff recommend approval of the request. Council discussion and action on Items 7.3 - 7.7 ..... City Planner Steve Ach presented the staff reports on each of the above items 7.3 - 7.7. Mayor Duitsman opened the public hearings for items 7.3. through 7.7. Jeff Gongoll representing Riverside Development reviewed aerial photos of the site. He indicated that it is the developer's intention to make the area environmentally pleasing and to follow the business park zoning guidelines. Mr. Gongoll spoke specifically to the developer's request to vacate the drainage and utility easement on Outlet A of Cherryhill Bluff's Addition. He stated that delaying the vacation of the easements would be burdensome as far as developing legal descriptions. Planning commission Representative Dan Tveite indicated that the Planning Commission recommended that the easements not be vacated at this time because the ridge line creates a natural barrier between the commercial and residential property. There being no further comments from the public, Mayor Duitsman closed the public hearing.
