Motion to adopt ordinance amending Section 74-1 and 74-101 of the City Code of Ordinances.
Background/Discussion
Section 74-7
The MN Statute Section referenced in the current City Code has been renumbered by the State and
should be changed in the City Code. This section outlines the definitions used for traffic regulations.
Section 74-101
The definition fox "motor vehicle" only refers to self-propelled vehicles and therefore Section 74-101
would not be enforceable on trailers in regards to parking on a street fox longer than 24 hours. The more
appropriate definition would be "vehicle" which means any device by which any person or property is or
may be transported or drawn upon a highway. Recreational vehicle and trailer is added to the ordinance in
order to make it more clear for everyone.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTION 74-1 RELATING TO DEFINITIONS FOR TRAFFIC
REGULATIONS AND SECTION 74-101 OF THE CITY CODE OF
ORDINANCES RELATING TO PARKING ON CITY STREETS FOR
LONGER THAN 24 HOURS
The City Council of the City of Elk River does hereby ordain as follows:

Section 1. That section 74-1 titled, D~nitions, of the City of Elk River Code of
Ordinances shall be amended to read as follows:
The words, combinations of words, terms or phrases used in this chapter and defined in
Minn. Stats. ~ 1 /~ 169.011 shall have the meanings given them by that section.
Section 2. That section 74-101 titled, Parking on Street for Longer Than 24 Hours, of
the City of Elk River Code of Ordinances, shall be amended to read as follows:
(a) It shall be unlawful for any person to leave, park, permit, or allow any meter vehicle,
recreational vehicle, or trailer, to stand or remain upon any city street or right-of--way for
more than 24 hours at any time.
(b) Violations of this section are punishable as provided in section 74-91.
Section 3. That this ordinance shall take effect upon publication as provided by
law.
Passed and adopted by the City Council of the Ciry of Elk River this 1st day of
December, 2008.
