Background/Discussion
At the Council meeting on November 10, 2008, Council directed staff to prepare a moratorium ordinance
for the Focused Area Study (FAST) area. An ordinance establishing the moratorium is attached.
The moratorium would prohibit the receipt of land use applications (and approval of these applications)
within the study area for up to 1 year. The study is expected to take 5-6 months, with the potential for
further land use actions (comprehensive plan amendment, zone change) taking additional time. The
Council may cancel the moratorium at any time before the 1 year date.
A moratorium is beneficial to the city and property owners because it allows the City to reevaluate the
direction of a given area, possibly resulting in a new direction. The area has great potential to change, with
the addition of the Northstar commuter station and the future development of the city owned Gateway
Business Park as an anchor. These factors may shift the development trends in the area. Because the land
use guidance of the area needs to be revisited, it is advantageous to hold off development that is based on
an existing plan or direction until the new plan can be developed. The private sector benefits by investing
in the area consistent with the final plan, avoiding a situation where their investment is inconsistent, or
non-conforming.
Public Hearing notices have been sent to all property owners within the study area, as well as those within
350 feet of the area. Owners of multiple properties were sent only one notice. To date, Staff has received
some comments and concerns, notably about the loss of potential sales and uncertainty about the final
plan and its impact. Others have voiced their support of the planning process.
The draft ordinance is broadly written, not allowing application for all land use decisions, including
building permits, variances, site plans, etc. The Council could adjust the. reach of the ordinance, as well as
the length.
The draft includes a variance provision, should the Planning Commission and Council feel it appropriate.

ORDINANCE NO.08-
AN ORDINANCE OF THE CITY OF ELK RIVER ESTABLISHING A MORATORIUM
ON LAND USE APPLICATIONS AND APPROVALS WITHIN THE CITY OF ELK
RIVER FAST STUDY AREA
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. Purpose: The Fast Study area of the City, as described in Section 5 below,
is experiencing change from neighboring properties market conditions. The area is expected to see
development or redevelopment in the coming years with the opening of the Northstar commuter
train station. This area of the City requires further study to determine the appropriate future land use
and zoning. It is anticipated that the study will take approximately 6 months. Additional regulation
(Comprehensive Plan amendment, rezonings) may take longer.
Section 2. Findings: The City Council of the City of Elk River finds that it is
necessary, in order to protect the integrity of the City's zoning ordinance and the planning process, to
implement a moratorium on land use applications within the area described in Section 5 below. The
area described will be studied by the Elk River Planning Commission and City Council in order to
determine the most appropriate land use and zoning standards.
Section 3. Definition: Land use applications shall include all land use applications
such as, but not limited to, building permits, conditional use permits, land use amendments, site
plans, plats, variances, or zone changes.
Section 4. Moratorium Declared: During the term of this ordinance and any
extensions thereof, a moratorium is hereby imposed on the acceptance or approval of any land use
applications for properties located entirely or partially within the area described in Section 5. During
the term of this moratorium, the City will not accept land use applications.
Section 5. Area Affected by Moratorium: The area to be studied is shown on attached
Exhibit A, and is bordered by Highway 10 to the west, 165th Avenue to the south, 177th (extended) to
the north, and Nixon Street (extended) to the east.
Section 6. Waiver of Restrictions: In cases of undue hardship, any person having a
legal or equitable interest in land within the area affected by the moratorium who is aggrieved by the
requirements of this ordinance may apply to the City Council for a waiver of all or a portion of the
applicable restrictions. A waiver may be granted where the City Council finds undue hardship, as
defined in Minnesota Statues Section 462.357 caused by the restrictions, and finds that the waiver will
not unduly affect the integrity of the planning process or the purposes for which the moratorium
ordinance is enacted.
Applications for waivers shall be filed on a form provided by the planning manager.
The planning manager shall prepare a report and recommendation on all requests for a
waiver and shall forward the request and report to the Planning Commission which shall conduct a
public hearing on the request. Not less than ten (10) days before the public hearing, the planning
manager shall mail notice of the time, place, and purpose of the hearing to property owners within
three hundred and fifty (350) feet of the subject property. Failure to give mailed notice to individual
property owners, or defects in the notice, shall not invalidate the proceedings provided a bona fide
attempt to comply with this subdivision has been made. Following the public hearing, the Planning
Commission shall forward its recommendation on the report to the City Council for final action.
The City Council may impose such conditions and require such guarantees related to the
grant of waiver as it deems reasonable and necessary to protect the public interest and to ensure
compliance with the standards and purposes of the zoning ordinance and the policies of the
comprehensive plan.
Section 7. Term: This ordinance shall be effective upon adoption and shall terminate
1 year thereafter, unless earlier terminated by action of the City Council. It is the intent of the City
Council that this ordinance shall be in effect only until the City has completed the study and adopts
such ordinance amendments as it deems necessary.
