In December 2006, I assisted your engineering department in developing a plan and cost
estimates to replace the lights on Hwy 10. In May of 2008 we removed two street lights on Hwy
10 to determine if the existing foundations and electric system are in good enough condition to
be reused. After inspecting the foundations and electric system, it appears both are in good
condition and can be reused.
Per our discussion at the June 10, 2008 Elk River Municipal Utilities Commission meeting, we
are to give you a proposal to remove and reinstall these highway lights. We would propose to
remove and reinstall the 26 lights (8 single and 18 double arms) on a time and material basis with
an estimated cost of $34,000 per the following.
1) City of Elk River will purchase the lights, poles, and bases etc., delivered to our facility.
We can assist you in the pole selection
2) City to provide traffic control and flagmen if necessary.
3) Above estimate is based on using existing foundations and wiring. If a foundation cannot
be used due to bad anchor bolts or wiring issues develop, ascrew-in steel anchor base
plate will be used at additional cost along with wiring modifications. Concrete patching
of median may also be necessary at additional cost.
4) The existing lighting system is divided into four electric zones. We are proposing to
complete one zone at a time to ensure at least part of the Hwy 10 corridor is always lit.
5) This work should be completed 28 working days or 5 to 6 weeks.

At the June 10, 2008 E1k.River Municipal Utilities Commission meeting, we discussed the trunk
water line under the 193`d Avenue road extension. Unknown to me, this item was also discussed
at the June 2, 2008 City Council meeting.
In review, the trunk water system for eastern Elk River (north of 175th Ave., east of Co. Rd. 13),
the 193`d Avenue trunk water main will be the last trunk water main necessary to serve this area.
As the Elk River Municipal Utilities adds wells to this area, we will be tying the wells and
associated mains to the trunk system. As the City expands, the urban service district southeast
along Hwy 10, obviously more trunk water mains will be required and funded with additional
trunk assessments.
As was stated at our Elk River Municipal Utilities Commission meeting, a good compromise
would be for the City to pay for the trunk water main expansion under 193`d Avenue at an
approximate cost of $250,000 and the Elk River Municipal Utilities would pay to tie the system
together on the east end (east of Co. Rd. 13) at an approximate cost of $100,000.
It is also my understanding, you will be tapping this 193`d Avenue trunk water line for irrigating
the medians on the roadway.

At the June 10, 2008 Elk River Municipal Utilities Commission meeting, we discussed the desire
to add street lights to the 193`d Avenue road extension. At this meeting we were asked to do a
layout and a proposal to furnish and install these lights.
Attached is a lighting layout for the 193`d Avenue road extension. Due to little or no extra right-
of-way to mitigate wetland impact issues, we have limited space to install a lighting system. The
lighting system can be placed in the road median or adjacent to and under the sidewalk. Neither
is desirable from an ongoing maintenance issue but both certainly doable. If trees are to be
planted in the median, the lights should be placed along the sidewalk which is our suggestion.
We are proposing to install the street light system on 23' fiberglass poles with 150W HPS
traditionaire fixtures on mid-block and cobra head on existing wood poles at the intersections.
We propose to provide all labor and materials to furnish and install the required lighting on a
time and material basis with an estimated cost of $55,000. Because we will be boring under new
and existing roads and placing cable under the sidewalk, some field coordination will be
required.

Staff recommends the Planning Commission review the proposed ordinance, receive public comment,
and table the discussion to allow staff to address concerns raised during the public hearing. Concerns
include:
1. Effectiveness in actual water reduction
2. Enforceability
3. Cost
Based on the information provided to date, Staff cannot support the ordinance as it is written.
Staff can also support a Planning Commission recommendation of denial, due to the concerns listed.
Background/Discussion
The Utilities Cotntxiission, in an effort to reduce the City's water use during the summer months, is
proposing an ordinance amendment that would require certain soil improvements for new lots
throughout the City. This draft ordinance is attached.
Bryan Adams, Elk River Municipal Utilities Superintendent, will verbally provide information regarding
the proposed ordinance at the meeting.
The intent of the ordinance is to reduce water consumption during the summer months. Utilities have
noticed a trend where the summer water demand doubles and triples the winter demand. The bulk of
this water is used to water lawns, wash cars, etc. Utilities generally have an obligation to reduce summer
water usage metro area wide, to preserve water for non-recreation or lawn needs: drinking, cooking,
bathing, and fue protection.
Utilities have instituted volume pricing, education, and other programs to reduce the amount of water
being pumped during the summer months. The ordinance proposed is another `tool' to reduce this
water.

Analysis
Staff recognizes the importance of water conservation. Clearly a paradigm shift is necessary to
effective measurable change.
Though supportive of the goal, Staff is concerned that the proposed ordinance may not truly be
effective in reducing water usage, will cause unreasonable enforcement demands, and place
unknown financial and tune burdens on a relatively few effected property owners.
Concern #1: Undetermined actual water reduction -The majority of the city's urban services have
been developed. Based on a review of the zoning map, as much as 80 to 85% of the City's urban
service area (the area to be served by City water and sewer) is built out. The ordinance requires 4-6
inches of top soil on these lots. The top soil will retain water longer than the sand prevalent
throughout much of the city. The concern is that only 20% of the urban service area will be
required to import top soil, and the cost to administer the ordinance does not appear out weigh the
benefits provided to the city. Additionally, the ordinance applies throughout the City, even those
lots outside city services/
Concern #2: Enforceability - Staff has genuine concerns related to enforceability. Staff is
researching enforcement programs, but it appears that a staff person would need to be on site when
the soil is delivered, (to verify mix ratio), spread (to verify depth), and tilled, to verify depth into
existing ground. These three inspections add up in staff time, and prevent a homeowner from doing
this work on a weekend. The ordinance suggests a certificate system where the property owner
would sign a statement saying that adequate top soil has been provided and tilled into the ground.
Concern #3: Cost -Staff is unsure of the cost to the homeowner. Affected lots would range in size
from 8000 square foot residential lots to multiple-acre industrial sites. Importing, spreading, and
tilling top soil has been estimated at $3,000 for the average city lot (12,000 sq ft).
