At the October Utility Commission meeting, staff originally intended to propose that ERMU,
partnered with the City of Elk River, renew the safety contract with MMUA. However, it was
discovered at that time that the City of Elk River had been researching alternative safety program
providers. The Utility Commission directed staff to renew the contract contingent upon the
ability to change the contract at a later date if the City decided to pursue other options.
Through discussion with the City safety coordinator, the City was still researching their options
and planned to use MMUA's safety program through the 2008 calendar year. Staff discussed the
situation with MMUA. The contract was then paid by ERMU through the 2008 calendar year.
However, the year contract was not signed pending feedback from the City.
The City safety coordinator and ERMU staff have scheduled to meet with an alternative safety
program provider. (A report of the meeting shall be a verbal. discussion.)

The services agreement entered into between Minnesota Municipal Utilities Association
(MMUA) and Elk River Municipal Utilities (Elk River), dated August 28, 2007, contract number 5-
2008, is amended as follows:
PART 11. Section 1.
1. DURATION: This Agreement shall remain in force from October 1, 2008 until
September 30, 2009 (the °expiration date°).
PART III. Section 1.
1. COMPENSATION: For the services covered by this Agreement, Elk River shall pay
MMUA an annual fee of thirty-one thousand fifty-three dollars and 60 cents ($31,053.60)
for the 2008-09 annual period. Such compensation shall be due and payable according
to the selected payment terms below.
Payment terms for the fee agreed to above shall be based on one of the following
options (select one):
^ Annual Payment ($31,053.60)
^ Quarterly Payments ($7,763.40 each)
For any term of less than twelve full calendar months, the fee shall be a portion of the
annual fee, pro-rated based on the number of calendar months or partial calendar
months in which the services were provided as a percentage of twelve (12).
The parties hereby accept the terms of the Agreement as modified.

PROJECT OVERVIEW: Annual OSHA Training and Inspection

Anoka Technical College's -Corporate Center will provide a safety and compliance
program to the City of Elk River. This program will consist of three parts; Annual
OSHA mandated training, inspections of buildings owned by the City of Elk River,
and participation on the cities safety committee. Each of these three areas, are
broken down below.
Safety Committee
...............
Anoka Technical College's -Corporate Center will play an active role on the City of
Elk River's Safety Committee. Every month the committee meets, the Corporate
Center will have a representative on the committee. If requested by the committee,
the Corporate Center will also bring an OSHA instructor for specific questions and
inspection recaps. We propose that these monthly meetings be held on 3rd
Wednesdays of every month at 1:30pm.
Inspections
...............
Anoka Technical College's -Corporate Center will inspect all buildings owned by the
City of Elk River. These inspections will consist of a thorough walk-through by an
individual competent in workplace safety. The manger of that building will be
required to walk along on the inspection. Each building will be inspected a minimum
of once a year, with some buildings require additional visits. Below is a list of
buildings to be inspected and an estimate of how many times a year they will be
inspected.

• Elk River Senior Center
• Administration Building
• Westbound Liquor
• Northbound Liquor
• Program Facility Building
Twice a Year:
• Pinewood Golf Course
• Ice Arena
• Police/Fire Station #2
• Fire Station #1
• Various Water Dept. Well Houses
Three Times a Year
• Streets Building
• Parks Building
• Wastewater Treatment Plant
These inspection visits are estimated, and will vary depending on previous
inspections or the needs of the City of Elk River. The proposed cost of this service
is based on the above numbers, plus two extra inspections (optional, if needed).
The City of Elk River will only be financially responsible for inspections that are
completed.
Monthly Training

Every month, Anoka Technical College's -Corporate Center will develop, customize
and deliver various OSHA training topics. These training courses will cover a
variety of topics including OSHA mandated annual training and other related safety
topics. These classes will vary in length and number of times during the day they
will be offered. This variance will depend on hours required for each topic, depth of
topics and how many employees it affects. The yearly training calendar will be
decided on by Anoka Technical College's -Corporate Center and the City of Elk
River's Safety Committee. Attached is a list of possible OSHA courses that would
benefit the City of Elk River.

other classes that the city requests.
Also attached, is a sample of the proposed 2009 annual training program. The
training calendar will be set up a year in advance to give the City of Elk River the
ability to inform their employees in a timely manner. We recommend that these
classes be offered on the 2"d Thursday of each month, at various times throughout
the day.

Working Surfaces
These training programs will be customized to meet the City of Elk River's needs
and will be a combination of hands-on learning and lecture. Upon completion of
each training course, students will receive a certificate of completion.
There are other courses that are required by OSHA, but can't be completed in a
short time frame and consequently are not listed on the proposed agenda.
Examples of these courses are Trenching and Excavation Competent Person
Refresher (6 hours), Power Limited Continuing Education (8 hours) and Forklift/
Medium Duty Equipment Training (4 hours). We can offer these classes on site or
affected city employees can enroll in these courses at Anoka Technical College.
Extra courses like the ones above or others above the 12 annual programs will be
kept separate from this proposal. For any special requested classes, a proposal will
be written and submitted to the Safety Committee for consideration.
OSHA Training Online:

Anoka Technical College -Corporate Center will work on various options to also
deliver online OSHA safety courses to the city. These courses would be available
to all employees who were not able to participate in the scheduled class sessions.
There is currently no time line for the delivery of this training, but Anoka Technical
