This business requires a conditional use permit because it involves construction features not normally found in a residential dwelling and it will be serviced by a delivery vehicle on a regular basis. Recommendation Staff and the Planning Commission feel this request meets the seven standards for a conditional use permit as outlined in Section 900.20 of the Elk River City Ordinance, as well as the Elk River Home Occupation Ordinance. Staff is recommending approval of this conditional use permit to operate a hair salon out of the applicants home, with the following conditions: 1. Hours of operation be from 7:00 a.m. to 10:00 p.m. as per City Code. 2. No exterior storage related to this business shall be allowed. 3. Signage will be limited to two square feet and mounted fiat on the wall of the dwelling. 4. A maximum of one full time employee or equivalent, other than those persons who customarily reside on the premises, shall be employed. 5. If valid complaints are received, this item will be brought back before the Planning Commission and City Council for review. 6. The applicant will not have any outside employees and she will have only one work station. Number of Employees~Hours of Operation Ms. Bistodeau will be the only employee of the hair salon. Hours of operation are proposed to be Monday through Thursday, 9:00 a.m. to 9:00 p.m. and Saturdays from 9:00 a.m. to 1:00 p.m. by appointment only. The ordinance allows home businesses to operate between the hours of 7:00 a.m. and 10:00 p.m., therefore, st~f finds no problem with these proposed hours of operation. Parking Ms. Bistodeau will be the only employee of the salon; therefore, the number of customers generated will be limited. It is anticipated that no more than two customers will be at the salon at one time. The applicant is proposing to use an existing class five driveway and parking area in the back of the house for customer parking. Ms. Bistodeau has indicated that the salon will be wheel chair accessible. Cliff Skogstad, Building Inspector has examined the plans and asked that the applicant meet with the building officials to ensure that the appropriate codes are met. Equipment The equipment is the same as is normally found in a commercial salon. One styling chair, one shampoo sink and chair, one hair dryer, one supply closet and one utility sink. Conditional Use Permit The conditional use permit for a home occupation must meet the seven standards outlined in the Elk River Ordinance Section 900.42. Staff believes these seven standards have been met. Recommendation It is staffs opinion that this request meets the seven standards for a conditional use permit as outlined in Section 900.42 of the Elk River City Ordinance, as well as the Home Occupation Ordinance, Section 900.25. April 4, 1996 Dear Planning Commission, I am requesting a conditional use permit to open a hair salon in my home. I will be the sole owner and operator. I will be open by appointment only. M.~ approximate hours will be 9:00 a.m.-9:00 p.m. Monday thru Thursday and some Saturdays 9:00 a.m.-1:00 p.m. I am requesting to work out of my home so that I can be home to get my children off to school and be there when they get home. With the rising costs of daycare for three children it has not been real profitable to work outside the home. I have 14 years of experience as a cosmetologist and am currently working part time at McLearls Hairstylist in Rogers, MN. I feel with the declining family structures in this world it is important for me to be able to have the flexibility, of working at home to meet the needs of my family. We have an existing class 5 gravel driveway going to the back of the house. There is enough parking for 2 vehicles and a cement sidewalk leading to the salon entrance. The salon will be located in the basement of our home. It will be wheel chair accessible and has a bathroom for salon use. There will be only one styling chair, one shampoo sink and chair, one hair dryer, one supply closet and one utility sink. There will be doors shutting off the salon from the living quarters. There is one window that is large enough to meet a fire exit requirement.
