Ordinance Amendment Request by
City of Elk River, Public Hearing
Case No. OA 96-2
Overview
This particular ordinance amendment relates to amending the City's
ordinance to allow commercial and industrial development within the urban
service area prior to city water and sewer being available. This ordinance
amendment has been discussed both with the Planning Commission and City
Council at a joint meeting and individually at various meetings. This
ordinance amendment has received a lot of attention with the recent
expansion of the urban service area and with an earlier request by Dennis
Chuba to develop a commercial piece of property along west Highway 10 at
the City's western limits.
Planning Commission Recommendation
The Planning Commission held a pubhc hearing on April 23, 1996, to discuss
the ordinance amendment. There was no one in the audience to provide any
public comment regarding this matter. The Commission's action at that
meeting was to table this item indefinitely for the following reasons:
· Allow the Patchin appraisal of the east Highway 10 corridor to be
completed.
· To allow the City Council, ff desired, to hold a public hearing regarding
the east Highway 10 sewer and water project.
· Because of the importance of this issue, review the matter further with
the City Council because of its importance in terms of the City's growth
management strategy.

I support the Planning Commission's recommendation to delay action on this
ordinance amendment until the events described in the memo take place. I
also concur with the Planning Commission's description that this is a very
important issue to the City's growth management strategy and should be
closely examined before any ordinance amendment is to be considered.
