Consider a request by Elk River Station LLC. for final plat approval of the first phase of Elk
River Station.

The property is located north of the Burlington Northern Railroad tracks and north of the

Overview
Project Description
The proposal includes approximately 70 acres on the east side of Twin Lakes Road,
northeast of the Burlington Northern Railroad tracks at 171st Avenue. The property is
adjacent to the proposed commuter rail station, which is to be located on the west side of
Twin Lakes Road. The project is a mixed use development that includes townhomes,
apartments, a commercial/office component and senior housing.
Background Information
In August of 2001 the City Council approved a land use plan amendment to include this
property in the Urban Service Area and to change the land use designation to CC
(Community Commercial) and MR (Medium Density Residential). In November 2002 the
City Council approved the zone change to PUD, the conditional use permit for the PUD
and the preliminary plat.
Final Plat
The final plat for Elk River Station includes 17 lots and 8 oulots. At this time 17 townhouse
lots consisting of 106 townhouse units in the central portion of the project are being platted.
The buildings will be a mix of 6, 8 and 10 units. Outlots E, F and G are future commercial
sites, Outlot D is the future apartment site, Outlot H will be future townhouses and Outlots
A, B and C will remain undeveloped and used as open space and drainage ponds. Three
streets will also be platted, 172nd Avenue, 171st Lane and Olson Street.
The layout of the lots is consistent with the approved preliminary plat. The outlots will have
to be platted as lots in future phases prior to being developed.
The configuration of the streets is also consistent with the approved preliminary plat. Access
to the most of the townhouses will be provided from private drives.
Grading, drainage and utility issues are addressed in the City Engineer's memo.
The Park and Recreation Commission recommended cash dedication based on a per unit
basis for the townhouses. Park dedication for the remainder of the townhouses, the senior
cooperative, the apartments, the commercial/office portion of the project will be paid when
they come in for final plat approval. The Park and Recreation Commission also requested a
30' easement for pedestrian purposes parallel to the railroad right-of-way in the southwest
corner of the site.

Recommendation:
Staff recommends that the City Council approve the attached resolution granting final plat
approval for Elk River Station with the following conditions:
A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED OUTLINING THE
TERMS AND CONDITIONS OF THE PLAT APPROVAL AND INSTALLATION OF
IMPROVEMENTS PRIOR TO RELEASING THE PLAT FOR RECORDING.
2. A PLANNED UNIT DEVELOPMENT AGREEMENT BE PREPARED AND EXECUTED
PRIOR TO RELEASING THE PLAT FOR RECORDING.
3. A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF 100% OF
THE COSTS OF PUBLIC IMPROVEMENTS.
UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM
ACCEPTED BY THE CITY, A WARRANTY BOND IN THE AMOUNT OF 25% OF THE
IMPROVEMENT COSTS SHALL BE SUBMITTED TO THE CITY FOR A ONE YEAR
PERIOD.
SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE CITY
AT THE TIME OF FINAL PLAT BE PAID PRIOR TO RELEASING THE PLAT FOR
RECORDING.
6. SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE CITY ENGINEER BE
PAID TO THE CITY PRIOR TO RELEASING THE PLAT FOR RECORDING.
7. THE NECESSARY DRAINAGE AND UTILITY EASEMENTS BE DEDICATED ON THE
PLAT AS REQUIRED BY THE CITY.
8. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED.
9. ALL APPROPRIATE WETLAND PERMITS MUST BE OBTAINED PRIOR TO
COMMENCING WORK ON THE SITE.
10.
GRADING AND EROSION CONTROL PLAN AND DVELOPMENT PLAN BE
SUBMITTED AND APPROVEDBY THE CITY ENGINEER PRIOR TO THE ISSUANCE
OF BUILDING PERMITS.
11. ALL GRADING WILL NEED TO BE CERTIFIED PRIOR TO THE ISSUANCE OF
BUILDING PERMITS.
12. STREET LIGHTS SHALL BE INSTALLED AS RECOMMENDED BY ELK RIVER
MUNICIPLAL UTILTIIES.
13. WATER AVAILABILTY CHARGE BE PAID PRIOR TO RELEASING THE PLAT FOR

Dear Mr. Harlicker:
As you requested, we have reviewed the final plat for the first phase of Elk River Station. The plat
was prepared by Westwood Professional Services, Inc., and consisted of five sheets. Based upon
our review of the plat, we would offer the following comments:
o
The outlots bordering on Twin Lakes Road (Tyler Street) should have a ten-foot drainage
and utility easement along the frontage with Twin Lakes Road.
All of the outlots bordering on 171st Lane and 172"d Avenue should also provide ten-foot
drainage and utility easements along their frontages.
There should be a drainage and utility easement over the wetland in Outlot A.
There will need to be an additional easement provided in Outlot A from 172th Avenue to the
wetland area to provide for the emergency overflow and piped outlet from the pond
proposed in Outlot B.
There is a proposed storm sewer line running between Lots 5 and 6, Block 1. At the
northern corner of these two building sites, there is not ten feet of drainage and utility
easement area provided. The building pads should be adjusted slightly to provide a
minimum of ten feet of drainage and utility easement in these areas. The same is true
between Lots 1 and 5, Block 2, on the eastem edge.
Lot 3, Block 2, is situated so close to Olson Street that it does not provide the required ten-
foot drainage and utility easement along the street right-of-way. Building Site 3 should be
adjusted to provide this easement area.
With the changes noted above, we would recommend approval of the final plat for the first phase of
Elk River Station Addition. If you have any questions regarding any of these comments, please call.

A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
Elk River Station
Case No. P 02-P01-05
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on November 18, 2002; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
It is hereby determined by the City Council for the City of Elk River as
follows:
The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.

The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
The physical characteristics of the site, including , but not limited
to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.

The proposed subdivision will not cause substantial environmental
damage.
The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.

The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
This final plat approval shall expire one year from the date of this
resolution if the final plat is not recorded within that time.
