All canine training and care shall take place inside the subject building 2. All comments of the Fire Chief memo dated January 7, 2009 shall be addressed. 3. The Dog Daycare shall be limited to 25 dogs per day. 4. The number of Boarding Kennels shall be limited to 96. 5. The applicant shall obtain a Commercial Kennel License from the City of Elk River. 6. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all require permits. 7. A sign permit is required for each sign allowed on the property. Background/Discussion Elk River K9, LLC (Formerly known as Elk River Canine Connections) has provided quality pet care and training for the Elk River Community since 2004. They are currently operating a similar business at 9942 Highway 10 and were granted a Conditional Use Permit by the City Council in January 2004 for this location. The applicant is asking for, at the subject property, the same type of CUP they already have but would like to also provide boarding of dogs. Although the CUP runs with the existing site, the applicant does not intend on running two businesses. They will be relocating from the existing site into the subject property. Day Care The dog daycare and boarding will be completely contained within the structure. The daycare plans to limit the number of dogs to 25 per day. Boarding The applicant is proposing a 96 suite themed kennel. They will provide 24 hour per day managed care for their clientele. They also hope to provide web cam availability for clientele to see their companions at the facility. Analysis The property is zoned Planned Unit Development (PUD) and the PUD agreement lists Commercial Kennels (indoor) as Conditional Uses. Dogs will be supervised when taken outside on a leash to an elimination area for digestive relief only. There are no current state regulations with regard to pet waste so the waste will be disposed of in the trash. Classes are proposed to be run during the daytime, evening and on weekends. Hours of operation will be as follows: Mon. -Fri. (6:00 am to 9:00 pm) Sat. Signage will need to adhere to the city ordinances. A permit is need for any wall or freestanding sign. There is no need for any outdoor storage. There is no state licensing required but the applicant will be required to obtain a Commercial Kennel License from the City of Elk River. Parking and Access Access to the three building complex has a shared drive off of Jarvis and parking easements that are shared amongst the campus buildings. The subject property has 40 parking spaces and with the combination of the two other campus buildings, there is approximately another 30+ additional parking spaces. Special events may be the only time a need to use other buildings parking. There appears to be adequate parking for the facility. Comprehensive Plan The Light Industrial category includes industrial uses that are lower in intensity of activity. These uses ]unit the potential for adverse impacts on adjacent land uses due to factors such as noise and odor. Examples of Light Industrial uses include offices, enclosed storage and warehousing, research laboratories and light manufacturing. The proposed use meets these requirements. Applicable Regulations Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 7. 1Vill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience orgeneral avelfare of the neighborhood or the city. 2. Will be consistent avith the comprehensive plan. 3. Dill not impede the normal and orderly development and improvement of surrounding vacant property. 4. Dill be served adequately by and will not adversely affect essential public facilities and services including streets, police and fireprotection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create tra~c congestion or interference avith tra~c on adjacent and neighboring public thoroughfares. 5. lYlill not involve uses, activities, processes, materials, equipment and conditions of operation that avill be detrimental to any persons or propery because of excessive tra~c, noise, smoke, fumes, glare, odors, dust or vibrations. 6. 1-Ylill not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. 7. 1-Ylill fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license orpermit to establish and operate the proposed use in the city. In the review of the standards for CUP as outlined, it appears that the request is consistent with all of these standards. West, Fire Chief DATE: January 7, 2009 SUBJECT: Update on Site Visit at Dog Training facility Fire Marshal Cliff Anderson and Building Official Bob Ruprecht visited the Dog Training facility on December 17, 2008 and I would like to make the following comments: 1. Conditional Use Permit, Case No CU 09-01- Request by Maureen Ivers for Dog Training Facilitv,15703 Jarvis Street ~L3, B1, Ar-Mon Commercial Park 2nd Addition The applicant of the dog teaining facility was advised of an additional fire lane shall be added in the southeast corner of approximately 60 foot in length to meet the fire lane access standard as stated in the International Fire Code. The International Fire Code Fire Lane standards states a 20 foot wide roadway shall be provided and an additional 60 feet in length shall be needed in the southeast corner of the existing building as approved by Elk River Fire Marshal Cliff Anderson. The applicant shall ensure that all life safety devices in the proposed facility are in working order prior to occupancy of the building. (Formerly known as Elk River Canine Connections.) has provided quality pet care and training for the Elk River Community since 2004. Elk River K9 currently staffs 10 of the finest Training Instructors in the Twin Cities area. Our regular clientele base comes from the local Elk River and surrounding area, to as far as Shakopee, Minnesota. Elk River K9 also draws people from beyond the Minneapolis-St. Paul metropolitan area for special events and to attend workshops with our highly recognized trainers. We justifiably take great pride in our quality training programs, excellent customer service and keeping service and safety a first priority. For years, clients and the general pet owning population have approached us and requested that we offer boarding services. We recognize the value added benefit to our business as well as the convenience and peace of mind this service would offer to our customers. The challenge has been that our current location prevents us from achieving these goals. While searching alternate locations, we have discovered a site that would provide ample room to add boarding to our all ready recognized and successful business. Once added, the boarding part of the business will be completely contained within the structure. Dogs will be well supervised and taken outside on leash to an approved elimination area for digestive relief only. All other exercising will be contained within the building training areas. Our goal for the boarding portion of the business is projected to commence in the year of 2010. Doi Training Our dog training classes and curriculum are structured for the family wanting awell- behaved companion. We hope to plant the seeds of responsible dog ownership and encourage people to continue developing their relationship with the companions to the highest level possible. Here is a sampling of some of the courses we offer which provide a wide assortment of training opportunities for the community including but not limited to: Puppy Kindergarten Puppy Agility Adolescent Training Classes Basic Beginners Obedience Small Dog Obedience (For dogs under twenty pounds) Advanced Obedience Rally Obedience Senior Obedience (55+) Agility Conformation (Show Training) Therapy Dog Training Tricks and Acting Freestyle Frisbee Private Lessons Il~~~l ©5s' Our classes generally run 60 minutes in length and the facility will allow us to conduct three classes per allocated time slot. To continually provide the best training experience, our class sizes are limited to 10 dogs per class. This allows us to provide individualized assistance and attention to the dog and handler teams. We will be running daytime, evening, and weekend classes. Our experience has shown that the evening class times are the most convenient for the majority of the community. Elk River K9's Operational hours are: Monday through Friday from 6:00 A.M. to 9:00 P.M. and Saturday from 7:00 A.M. to 6:00 P.M. Dog Daycare In Today's society, dogs are not just "dogs" anymore but are treated as family members. Companion animals play a much larger role in our lives and people are choosing to provide them with the best lives possible. Busy animal lovers are utilizing the ever expanding number of animal related care facilities across the nation, creating better lives for their pets and a peace of mind for themselves. Elk River K9 provides training services integrated with daycare services, which sets Elk River K9 apart from the competition. All dogs that will potentially attend our Dog Daycare program will be screened to ensure appropriate dog and people friendly behaviors are present. Screening is done on each dog, and is important for the health and safety of all concerned that the dogs attending are not have aggressive tendencies, show excessive shyness, are not food or toy possessive, are not overly protective of territory and are not easily stressed in new situations. In addition to the screening mentioned above, dogs accepted into our Daycare Program will need to have proof of vaccinations and proof of licensing from their community. Elk River K9 goes to great lengths to ensure the safety for all of our clients and visitors. The daycare plans to limit the attendees to 25 dogs per day. Currently the planned hours of operation Monday through Friday from 6:00 A.M. to 6:00 P.M. and Saturday from 7:00 A.M. to 6:00 P.M. Boarding Elk River K9 proposes to operate an upscale 96-suite themed kennel. This luxurious accommodation will provide high-end, 24-hour per day, managed care for our clientele. In addition to the excellent care available for the pets, we hope to provide web cam availability for clientele to see their companions enjoying their stay at the facility. This aspect of the business has great potential for people traveling on vacation too. They will be able to drop off their pets and then take the conveniently located North Star Rail system to the airport. All build out to be approved per building codes and permits prior to construction meeting all applicable building codes. Events On Occasion Elk River K9 hosts trial events such as Fun Matches and Obedience Trials. Fun Match Events: This is generally used as a trail run for the competitors in obedience. Often conducted as a mock trial so people can prepare for the "real" show. This allows dog owners to work in a more formal show ring setting so they can familiarize their dogs and themselves to the sensations of a dog show. This helps dog and handler teams to achieve the best possible results for their obedience show career. 06edience Trail Events: This is an event where a dog can be brought to test out for American Kennel Club Titles, United Kennel Club Titles or additional recognized club obedience event titles. Handler and dog teams would earn points and awards that enhance the ability and recognition of their Champion Companion. This is a true accomplishment not only for the handler, but for the dog as well. These trials are mainly held on weekends and the competition is usually offered on both Saturday and Sunday. Typical hours for obedience trials run from 7:00 A.M. to 6:00 P.M. Seminars and Community Enhancement Events: Elk River K9 hosts education seminars for all levels of dog lovers. By educating the community on safety for their dogs and children we hope to enhance their lives to so they are safer and happier with their companion animals as well as other peoples. Each Spring we team up with local veterinarians and sponsor a vaccination clinic and open house for families and friends to attend to learn more about dog training, canine health and what enjoyable sports there is available for their companions. Disposal Of Dog Waste and Elimination Area We have apre-approved elimination site within the premises in which we take extreme measures to ensure sanitation. We are very particular and extremely strict with our clients as to the designated location of our elimination area. Any person(s) violating this part of the program will be dismissed from the premises and not allowed to participate in any further programs offered by Elk River K9. We find that people are generally respectful when given instructions and comply. Waste will be disposed of in the trash per City of Elk River.
