4.0 HPSR 09-09-2004Ci t~ver MEMORANDUM TO: Heritage Preservation Commission FROM: Stephen Rohlf, Building and Environmental Administrator DATE: September 9, 2004 SUBJECT: Items on the September 28, 2004 Planning Commission Agenda Attached to this memo is the September 28th Planning Commission Agenda and a map showing the locations of the requests. The City's recent Archaeological Modeling and the State Historical Society Office's (SHPO) list of known archaeological site were referenced in regards to the items on the Planning Commission's agenda. The following is a summary of the agenda items and their potential to conflict with any known cultural, historical or archaeological resources: 5.1 -Plat of Windsor Meadows - (P 04-18) -There are no known SHPO sites and the model shows the site as low to moderate archaeological potential. Since there will be grading associated with the plat improvements -Staff recommends the standard condition listed below is placed on this request. 5.2 -Parking lot expansion for Guardian Angels - (CU 04-26) -Although no known archaeological sites have been identified on the property, the project will involve grading and the potential to unearth something of archaeological significance. Staff recommends the standard condition listed below is placed on this request. 5.3 -Home occupation - (CU 04-01) - No issues. 5.4 -Change in land use designation - (LU 04-03) - No issues. 5.5 -Rezoning (ZC 04-07) - No issues. 5.6 -Plat of Jackson Avenue Villas (P 04-16) -The property involved with this request is rated as having low to moderate potential for containing archaeological significance. Staff is not recommending archaeological testing prior to approval of the plat, but -Staff recommends the standard condition listed below is placed on this request. 5.7 -Plat of Jackson Square - (P 04-19) -The archaeological model shows this property as a low potential area for archaeological resources and SHPO does not list any know archaeological sites for this area. The HPC has already made their opinion that the area has local historic significance known to the City Council. -Staff recommends the standard condition listed below is placed on this request. 5.8 -Plat of Bluff Block - (P 04-20) -The archaeological model shows this property as a low potential area for archaeological resources and SHPO does not list any know archaeological sites for this area. The HPC has already made their opinion that the area has local historic significance known to the City Council. -Staff recommends the standard condition listed below is placed on this request. 5.9 -NAPA Auto Facility - (CU 04-25) - No known SHPO sites involved with this request, but the archaeological model indicates the site has a moderate to high potential for archaeological significance (mainly due to being on a bluff adjacent to a main travel route, the Mississippi River). Since the site was previously disturbed by the plat of Mississippi Ridge, staff is not recommending archaeological testing prior to approval, but - Staff recommends the standard condition listed below is placed on this request. 5.10 -Medical Building - (CU 04-27) - No known SHPO sites and the model indicates low potential for archaeological significance, but grading will be involved. -Staff recommends the standard condition listed below is placed on this request. 5.11 -Plat of Carson Business Park - (P 04-11) -There are no known SHPO sites on this property, but the model indicates high potential for archaeological significance. The plat improvements involved with this request will result in extensive grading of the property, but the property has already been previously disturbed. Therefore staff is not recommending archaeological testing prior to approval, but -Staff recommends the standard condition listed below is placed on this request. 5.12 -Ordinance Amendment - (AO 04-03) - No issues. Standard Condition: "Any item or condition found that indicates the site is likely to yield information important to prehistory or history shall be reported to the city immediately. Further, the city reserves the right to stop work authorized in its approval until the site is appropriately investigated and work is authorized to continue by the city." One of the Commission's functions is to hold public hearings and make recommendations to the City Council. The City Council makes all final decisions on these matters. Elk River City Ordinances require that certain documents and information be included in applications. The Planning Commission may postpone consideration of an application that is incomplete and may, for other reasons, postpone final action on an application. For each item the Commission will receive reports prepared by the City staff, open the hearing to the public, and discuss and act upon the application.
