RESOLUTION NO. 01 - 85
A RESOLUTION TO AMEND THE URBAN SERVICE AREA MAP OF THE
COMPREHENSIVE PLAN TO INCLUDE CERTAIN PROPERTY IN THE
URBAN SERVICE DISTRICT PRIOR TO 2007
Case No. LU 01-10
WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the procedure
for amending the Comprehensive Plan, and
WHEREAS, the Planning Commission held a public heating on Tuesday, December 4,
2001, and recommended approval regarding the Comprehensive Plan amendment request for the
property generally described on the attached Exhibit A, and
WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request
and finds the following:
THE PARCEL IS CURRENTLY IDENTIFIED IN THE COMPREHENSIVE
PLAN AS MEDIUM DENSITY RESIDENTIAL AND WITHIN THE URBAN
SERVICE DISTRICT;
2. THE DEVELOPER WILL BE ABLE TO EXTEND UTILITIES EAST FROM
TWIN LAKES ROAD ALONG 175TM AVENUE TO THE PROPERTY;
3. THERE IS NO FINANCIAL IMPACT TO THE CITY OF ELK RIVER FOR THE
EXTENSION OF URBAN SERVICES TO THIS PARCEL;
4. THE PARCEL CAN BE SERVICED WITHOUT IMPACT TO OTHER PARCELS
WITHIN THIS AREA OF THE URBAN SERVICE DISTRICT°
that the
2001.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River
date for extension of urban services to be extended to this parcel be amended from 2007 to
PASSED by the City Council of the City of Elk River this 17th day of December, 2001.
