Dwight Kirkeide Requests
A number of meetings ago, Dwight Kirkeide came before the City Council
with some issues that he needed resolved. These issues included street
signage off of Highway 10, garbage collection service, identification on the
911 system, and determination of the legal status of the road/cart path that
accesses his home.
The street/park superintendent has advised me that a 173rd Avenue street
sign has been installed off of Highway 10 at the access point to the Kirkeide
homesite.
The fire chief has advised me that this homesite is now identifiable on the
911 system. The fire chief has worked with the county to ensure that this
location "shows up on the system" if an emergency takes place and 911 is
dialed.
Staff recommends that Mr. Kirkeide be exempt from the city mandatory
garbage and recycling service beginning in 1996. The 1995 fees have been
assessed against this property.
The main issues with Mr. Kirkeide appear to be resolved. The legal issue
regarding the status of the cartway may take more time. There is more than
one cartway issue in the City of Elk River so we need to be careful on how
this one is resolved. For example, if the cartway is abandoned, the property
goes to the adjacent landowners. If this happens, there is no legal access to
the Kirkeide property. On the other hand, if the cartway is declared a public
street, the city is obligated to maintain it. Additionally, if the street is
upgraded to city standards, the benefited property owners are assessed.
These are just a few of the legal issues that need to be sorted out and this
situation is an example of why the city discourages long private roads or
easements across other properties for access to single family home sites.
