SIGNALS AT UPLAND AND ASSOCIATED GEOMETRIC IMPROVEMENTS
Dear Council Members:
Gary Dirlam, the District 3 Traffic Engineer, has approached the City staff regarding the
two projects mentioned above. MnDOT has both of these projects programmed for the
next fiscal year. They have the money available, but do not have the resources to prepare
the plans and specifications for construction. Therefore, they have asked if the City is
interested in taking the lead on these projects with MnDOT paying their fair share through
the cooperative agreement process. The two projects in question are developing a left turn
lane for Simonet Drive and signalization and associated geometric improvements including
realigning the frontage road at the Upland Avenue intersection.
Approximately one week ago, I met with the MnDOT District 3 staff who would be
involved in this project and got a good understanding of the scope of services involved in
each one. The first step in this process would be to have the Council consider the two
attached resolutions, which essentially ask MnDOT to enter into a cooperative agreement
on each of these projects. From this point, we would define a scope of services and a cost
which would be approved by MnDOT. The way the funding would work is, MnDOT
would expect the City to front-end the design costs until the contract is let on these
projects. Once the contract is let, MnDOT will reimburse their share of the design fees
and all of the construction costs. At that point, the City would then pay the Contractor as
the work is performed. So, essentially, the City could be expected to recover their
carrying costs for the up-front design work during the construction process.
If you have any questions regarding these two projects, or the attached Resolutions, I will
be in attendance at your June 17, 1996, City Council meeting.

S.P. 7102-88 (T.H. 10) - Left Turn Lane for Simonet Drive
District 3 has scheduled the above project within 3'our communib,. Due to limited district resources, we are asking your
assistance to keep these project on schedule. We are inquiring as to the City's willingness to manage a consultant to deliver
the Preliminary Design, Final Design, Traffic, Materials, Surveys, Hydraulics and Construction activities for these projects.
The district would review the consultant's work.
The State would reimburse the cib' for the consultant costs after receipt of a fully executed cooperative agreement. (This is
after plans are ready for letting).
;e State provides the cib, with the full State participation after a fully executed agreement and receiving an invoice from
me City. Thus, while the city is "carr54ng" the Slate for consultant costs up to construction, the City will have the construction
dollars for making pa~vrnents to the contractor. Such payments are on a graduated basis as the contractor completes the work.
Therefore, we feel the city should recoup its handling costs for the project development consultant.
We appreciate your initial positive phone response and look forward to the Council's approval. We would request the city
to have its consulting engineer prepare a scope of service and fee proposal for the project. The district would review and
comment to the city. Mr. Dave Solsrud, Preliminary Design Engineer and Mr. Bob Busch, Final Design Engineer will be
contacts with respect io consultant's proposal.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION REQUESTING MINNESOTA DEPARTMENT
OF TRANSPORTATION TO ENTER INTO A
COOPERATIVE AGREEMENT FOR IMPROVEMENTS TO
WEST TRUNK HIGHWAY 10 AT SIMONET DRIVE
WHEREAS,
the City of Elk River is requesting the Minnesota Department of Transportation to
participate in certain improvements along a portion of Trunk Highway No. 10
located in the City of Elk River in Sherburne County; and
WHEREAS, MSA Consulting Engineer representing of the City of Elk River has met with
MnDOT District 3 in the planning of said improvements; and
WHEREAS, said improvements will provide a protected left turn lane for west bound Trunk
Highway 10; and
WHEREAS, said improvements will improve the safety of west bound turning vehicles;
WHEREAS, said improvements are programmed by MnDOT Districts 3 (S.P. 7102-88);
NOW, THEREFORE, BIT IT RESOLVED by the Council of the City of Elk River, Minnesota:
That the State of Minnesota, Department of Transportation is requested to enter into an
agreement for improvements on the aforesaid portion of Trunk Highway 10 consisting of
construction of a protected left turn for west bound vehicles and a possible relocation of
the Simonet Drive intersection with Trunk Highway 10 to the east.
BE IT FURTHER RESOLVED that following approval by the Minnesota Department of
Transportation of plans and specifications for said improvements of said Trunk Highway and
before a contract is awarded for the construction of said improvements:
The State shall enter into an agreement with the City which shall provide that the State pay
its share of the cost of the requested improvements as determined by the State in keeping
with the latest edition of MnDOT Policy Guidelines (a copy of which has been received
for the Minnesota Department of Transportation's District Engineer); and

If the City lets the construction contract, the State will deposit with the City, upon demand
after execution of this agreement and before the start of construction, a sum equal to an
estimate of the State's share as prepared by the Minnesota Department of Transportation.

including the adjacent frontage roads.
BE IT FURTHER RESOLVED that following approval by the Minnesota Department of
Transportation of plans and specifications for said improvements of said Trunk Highway and
before a contract is awarded for the construction of said improvements:
The State shall enter into an agreement with the City which shall provide that the State pay
its share of the cost of the requested improvements as determined by the State in keeping
with the latest edition of MnDOT Policy Guidelines (a copy of which has been received
for the Minnesota Department of Transportation's District Engineer); and

The City shall, in addition to paying its proportionate share of the cost of the proposed
work, obtain all necessary right-of-way easements and construction permits for the work
to be performed outside the limits of the trunk highway or established City streets and
roads, together with all drainage outlet rights where necessary. Such easements, permits
and rights shall be obtained and certified copies of them furnished the Department of
Transportation before and contract for the proposed work is awarded.
