City Administrator June 17, 1996 King and Main Public Hearing The HRA is in the process of acquiring three parcels at the intersection of King and Main for a redevelopment project which will ultimately include the approval of a Tax Increment Financing District. State statutes require that the City Council hold a public hearing on the early acquisition of this property. Action Requested At the meeting the City Council should open the public hearing for public comment. Box 490 · Elk River, MN 55330 ° (612) 441-7420 · Fax: (612) 441-7425 CITY OF ELK RIVER CITY COUNCIL RESOLUTION NO. 96- A RESOLUTION AUTHORIZING EARLY ACQUISITION OF INDIVIDUAL TRACTS PRIOR TO TI-IE APPROVAL OF A REDEVELOPMENT PLAN AND PROJECT The City Council of the City of Elk River (the "City"), acting pursuant to its authority in Minn. Stat. § a69.028, hereby f'mds, determines and resolves as follows: WHEREAS, the City of Elk River Housing and Redevelopment Authority (HRA) has the opportunity to acquire individual tracts of real property located in the vicimty of King and Main Street: and WHEREAS, the HRA and the City Council has yet to prepare and approve a redevelopment plan and project as provided in Minn. Stat. § 469.028, Subd. 2; and WHEREAS, the HRA has determined the location of a proposed redevelopment project to be implemented in the vicinity of King and Main Street; and WHEREAS, Mina. Stat. 469.028, Sub& 5 authorizes the early acquisition of individual tracts of real property prior to the approval of a redevelopment plan and projects; and WHEREAS, the subject matter of this resolution has been noticed for public hearing as required by Minn. Stat. § 469.028, Subd. 5; and WHEREAS, the City Council of the City of Elk River deems it advisable to approve the early acquisition of individual tracts of real property in the vicinity of King and Main Street; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, as follows: Acquisition of individual tracts of real property within the vicinity of King and Main Street by the Elk River Housing and Redevelopment Authority will contribute 'to the elimination of blight or deterioration within that area of the City; There is a feasible method for relocation of individuals, if any, to be displaced by the proposed acquisition; and The acquisition of individual tracts of real property in the vicinity of King and Main Street depicted on Attachment A is hereby authorized and approved by the City of Elk River prior to the approval of a redevelopment plan and project. The City Council finds and hereby determines that the acquisition and disposal of the said property has no relationship to the City's comprehemive plan.
