Attached is a copy of the complaint case spreadsheet. The shaded cases have either been resolved or were not in violation of any ordinance. The City has 7 unresolved cases from 1995, and we have received 36 new complaint cases in 1996. 1995 Complaint Cases Of the 7 remaining cases from 1995, only three of them are expected to be resolved in the near future: 1. Case #95-17 may be resolved due to the fact that the former occupant has moved. 2. Case #95-59 will be resolved when the second phase of Mississippi Oaks is completed. 3. Case #95-67 should be in compliance by the end of the month when the required trees are expected to be planted. Case 95-31 The other four cases are unlikely to be resolved in the near future. One case that causes staff particular concern is Case #95-31. This is an issue where a site plan for outdoor storage was approved in July 1995. However, the applicant never complied with the approved site plan and has essentially been operating a junk yard on this site. Staff has been in regular contact with the property owner. Staff has been working with property owner to achieve compliance with the ordinance regulating outdoor storage. The property owner has done a tremendous amount of grading on the site without a permit. This has caused run-off problems for the adjoining property owner and the wetland on this site. The property owner recently submitted an incomplete application for a conditional use permit to operate a junkyard in an I-1 district. If the City Council approves the ordinance amendments proposed for this district tonight (OA 96-04), junkyards will no longer be a conditional use in this district. The applicant would not be able to have a junkyard in this zoning district and would need to comply with the current ordinance. In staffs opinion, ordinance compliance is crucial in this case because of all of the environmental problems associated with this site. Staff will keep the Mayor and Council updated on this case. 1996 Complaint Cases Of the 36 new complaint cases: 6 were not in violation 18 have been resolved · 12 are on-going The majority of the 1996 cases that are still open should be resolved within the month. Staff is working with these property owners to get them into compliance with the current ordinance. These complaint cases were all reported by residents. In no case did staff seek out these code violations. The majority of the complaints received by staff involve vehicles parked on the lawn, junk vehicles, commercial vehicles in a residential zone or miscellaneous debris. In the summer months, one of the complaints staff receives has to do with unmowed lawns, weeds, or lack of an established lawn.
