(Arbys), Public Hearing Case No. CU 96-14 Issue Franchise Associates, Inc. is requesting a conditional use permit for site plan review to construct a Class II restaurant facility in Elk Park Center planned unit development. Location Lot 5, Block 2, Elk Park Center (generally located directly west of Wendy's Restaurant) Zoning/Land Use PUD (Planned Unit Development / HB (Highway Business) Attachments · Revised development plans · Report to the Planning Commission dated June 25, 1996 Overview Arbys is proposing a 4,515 square foot Class II restaurant facility in Elk Park Center planned unit development. The. restaurant will include a typical Arby's menu selection, as well as a Sbarro pizza and pasta counter. The drive-thru lane along the south side of the building will wrap around the east side of the building where two pickup windows will be located. The first pickup window will allow customers to pick up both Arbys and Sbarro orders and the second window will be specifically for Sbarro pizza pickup. The interior of the restaurant will include a seating area with a total of 92 seats spread out over a variety of tables and seating booths. 13065 Orono Parkway · P.O. Box 490 · Elk River, MN 55330 · (612) 441-7420 · Fax: (612) 441-7425 Memo to the Mayor and City Council/CU 96-14 July 15, 1996 Page 2 Drive-thru Lane Representatives from Arbys have indicated that the project's design includes a drive-thru lane that will be wide enough to allow customers wishing to pick up their Sbarro pizza order to bypass the customers waiting for the first pickup window. Staff has discussed with Arbys the width of the driveway and the concern that the width may not be wide enough for some vehicles to pass vehicles waiting in line to pick up their previously ordered menu items. Arbys' architect has made some adjustments to the plan to help improve the drive-thru lane; however, staff is still cautious in accepting the width as wide enough for two vehicles to be passing one another. It should be noted that the drive-thru lane is on private property and for the most part, if the drive- thru lane does not function as intended by Arbys, it will not cause a public safety problem but more of an operational problem for Arbys. Site Plan Review The Elk Park Center planned unit development requires all site plans to receive approval from the City Council prior to construction. Staff has conducted a full site plan review of the plans submitted by Arbys and have detailed comments outlined in the report to the Planning Commission dated June 25, 1996. The architects representing Arbys have made several adjustments to the plans to meet most of staffs issues outlined in the report. Generally speaking, the following items have not been reflected in the most recent revised development plans: A.1.) The width of the drive-thru lane will continue to be an issue; however, as mentioned above, this a vehicular movement that will occur on private property and is probably more of a concern for Arbys than it will be for the city. However, staff wanted to make mention of this issue since we felt the width was inadequate. $.2. & 3.) Both these conditions have to do with having the plans reflect the appropriate landscaping. Representatives of Arbys have not indicated any concern or issue with these conditions and staff expects these conditions to be reflected on the final plans. Signage Arbys' sign proposal included a few signs that were not in conformance with the Elk Park Center planned unit development or city ordinance. The two primary sign issues dealt with the proposed directional signs and wall s:\councilXcu96-14.doc Memo to the Mayor and City Council/CU 96-14 July 15, 1996 Page 3 signage. The directional signs which are located along the main driveway between Arbys and the primary retail center (Target) are located off-site and are not allowed by ordinance. The Planning Commission did permit the locating of one directional sign off site to identify the direction to "enter" the drive-thru lane at Arbys. However, the secondary off-site directional sign identifying the "exit" was eliminated. The next sign issue dealt with the wall signs on the east side of the building facing Freeport. As part of the sign requirements for Elk Park Center, each business is allowed to have one wall sign for each building frontage on a public right of way. The Arbys proposal has frontage on one public street and that being Freeport. The Arbys sign proposal includes two wall signs; the first on the north side of the building and the second, on the east side facing Freeport. The sign on the east side is really intended to identify the two pickup windows. The Planning Commission and staff have recommended that the wall signs along Freeport be changed to better reflect their purpose, which is to identify each pickup window for the drive up customers. By doing this, it will avoid additional wall signage on Freeport and maintain a consistent interpretation of the wall sign requirements for Elk Park Center. (Additional wall signage by businesses in Elk Park Center have been denied by the Planning Commission and City Council in the past). Architecture Lastly, the architecture of the building has been revised to reflect the intent and guidelines of the architectural control of Elk Park Center. A brick material has been included on the building to complement the others built in Elk Park Center. Planning Commission Recommendation The Planning Commission recommended approval of the conditional use permit request by Arbys to construct a 4,515 square foot Class II restaurant facility with a drive-thru lane with the conditions outlined in staffs memo dated June 25, 1996, as well as the following conditions: B. Landscaping The landscape plan be revised to include landscape material within the island southwest of the building. 5. Recommendation It is recommended the City Council approve the conditional use permit request by Arbys to construct a Class II restaurant with a drive-thru lane with the following conditions: Page 4 o All of the comments outlined in the memo dated June 25, 1996, to the Planning Commission be incorporated into the revised set of plans. All of the comments stated in the City Engineer's memo dated June 19, 1996, be incorporated into the revised set of plans. Four sets of complete plans be submitted to the building department for review and approval prior to issuance of a building permit. The landscape plan be revised to include landscaping material within the island southwest of the building. All disturbed areas be sodded. This is one more space than is required by city code. The interior design of the restaurant offers a traditional Arby's service counter in addition to a Sbarro pizza and pasta counter. The common seating area will have a total of 92 seats with a variety of tables and seating booths. Elk Park Center Planned Unit Development The Elk Park Center approved development plan identified a building pad shghtly smaller (about 100 square feet) than proposed by Arby's. The plan did not reflect a drive-thru lane for a restaurant; however, given the conceptual nature of the plan, shght modifications axe and have been accepted. For the most part, the proposed building, associated parking and setbacks meet the development plan that was previously approved. Building Location Staffhas briefly discussed with the architect the possibility of sliding the building and parking about 10 feet to the west. This may possibly accomplish the following: · Establish additional green space between the drive-thru lane and Freeport Avenue. · Provide enough space along Freeport Avenue for a monument-style sign to be located and meet the 10 foot minimum setback requirement. · Provide an opportunity to adequately locate an electrical transformer as required by Elk River Municipal Utilities. · Increase the sidewalk area to meet the six foot width requirement. The architect will explore this suggestion and may have a response at the Plsnning Commission meeting. Site Plan Review A. Parking and Circulation Staff has some concerns with the width of the drive-thru lane. Supposedly, the drive-thru lane is wide enough to allow two lanes of traffic; however, staff questions whether the 16 feet is actually wide enough for two cars to pass one another. Page 3 Relocating the traffic/landscape islands that were previously installed by the developer will need to be made part of the plans to define the end of the parking rows. This improvement is reflected in the plans and should be included in any revisions. Landscaping Underground irrigation will need to be provided throughout all landscaped areas. The existing ornamental trees shown along Freeport Avenue and the 191st Lane entry are not installed as shown on the plan. These trees should be installed as part of the landscaping improvements. Grouping of medium-sized shrubs should be incorporated along with the existing trees along the 191st Lane entry and along Freeport to soften the appearance of the drive-thru lane. Pedestrian Circulation Consideration should be given to providing a sidewalk connection from the restaurant fae. ility to the sidewalk along Freeport Avenue. This a similar improvement that has been made to other facilities along Freeport Avenue (i.e., Wendy's). Sidewalk along the west side of the building should be increased in width to six feet. Dr~i.age and Utilities 1. Please refer to the attached memo dated June 19, 1996. Si_¢nace The proposed monument-style sign at the southeast corner will need to be relocated to meet the 10 foot setback requirement. Attached to this report is a memorandum from Kendra Lindsh] regarrl~ng the proposed signage. The signage requirements outlined in the Elk Park Center PUD shall be met. The proposed directional signs beyond the project's property limits shall be eliminated. All signs associated with the business will need to be on the same lot as the development. F. Architecture The Elk Park Center planned unit development agreement identifies a brick material be used as part of the building. The current plans presented Arby's do not include any type of brick material; however, staff has met with the architect to discuss this and revisions are being made to incorporate some brick. It is anticipated that the revised plans will be awi]able for the Planning Commission's review at the meeting Tuesday night. Based on our review and comments received at the staff review meeting, we would offer the following comments: A 5-foot wide concrete walk is shown on the west side of the building. Parking stalls adjacent to this walk are 18 feet deep. This depth of parking stall is allowed anticipating that a vehicle could overhang the concrete curb and gutter by two feet. If this occurs, the usable walk area would be reduced along the side of the building from five feet to three feet. We believe that the walk area should be widened, anticipating the overhang of cars parked adjacent to it. We would also recommend that the sidewalk continue to the north and provide another access point over the curb for vehicles that would choose to park north of the restaurant. 2. The sign shown in the southeast comer of the site is located within an existing 10-foot utility and drainage easement. At the staff review meeting, Glenn Sundeen of the Elk River Municipal Utilities raised the question of where his electrical box would be located. He indicated that the code requires it to be located 10 feet away from doors, windows, or flammable walls. Consideration should be given to where this electrical box can be located on the site. OFFICES IN: MINNEAPOLIS PRIOR LAKE ST. PAUL WASECA We understand that the restaurant will have two drive-up windows, one for Arby's and the other for Sbarro. We question whether the drive-up lane is wide enough to allow vehicles to pass each other to access the two windows. We believe with the tight radius on the corner and 17 feet of width on the east side drive-through, that it will be very difficult for cars to bypass the first window and access the second window without causing conflicts. However, the drive-through lane is wide enough for vehicles to attempt these types of moves. We believe that the drive-through should either be widened to provide for these types of moves safely, or narrowed to discourage these types of movements. The drive lane is shown as 26 feet wide, so there is ample opportunity to make adjustments to provide the longer parking stalls. o The information provided on the grading plan is rather confusing. At several locations, there are elevations provided with the notation "TOC", which we assume is top of curb, and "BOC" which we assume is bottom of curb. In some locations, this is shown as a half a foot difference, in other locations it is shown as .25 feet difference, and in yet other locations the "BOC" is shown higher than the "TOC". In any case, there is ample opportunity for grading the site and allowing for drainage to the existing catch basins. However, we would suggest that the grading plan be reviewed and corrected as needed, such that the City will have a correct version in their files.
