Issue
Phoenix Enterprises LLC is requesting a Conditional Use Permit to locate a
Now Horizon Daycare center in a C-3 zone.

Background
Phoenix Enterprises, LLC is requesting a conditional use permit to locate a
New Horizon Daycare Center in a C-3 zoning district. Licensed daycare
facilities are a conditional use in this zoning district. The daycare center will
be housed in the Hillside Crossing South strip mall. Most of the necessary
site improvements were addressed in the plat approval for Hillside Crossing
South.

Hours of Operation
The Daycare center is proposed to operate between the hours of 6:00 a.m. -
7:00 p.m., Monday- Friday.
Number of Children
New Horizon Daycare is licensed to have 114 children at any given time. The
children range in age from 6 months to 12 years old.
Traffic
The traffic associated with the daycare center will be heaviest in the morning
and early evening hours when parents are dropping off and picking up their
children. According to New Horizon, the traffic is concentrated between 6:00
a.m. and 9:00 a.m. and between 3:00 p.m. and 7:00 p.m. There is a drop-off
zone in front of the daycare center, which was approved as part of the plat.
Landscaping
The center is proposing to have paved paths around the play area for younger
children to be pushed in strollers. The paths around the building will be
paved with bituminous, and the paths in the play are will be concrete. Areas
not used for paths or play areas will be sodded. A five foot high fence will
enclose the rear play area. The fence will be constructed of high grade
plastic.
The play area will include 2 sandboxes with shade covers, a basketball court,
two four-square areas, and two playground areas.
Signage
New Horizon Daycare will be allowed one wall sign, as per the Hillside
Crossing South site plan. This wall sign will be placed on the west elevation
of the building and will be in the "Individual-Letter" style as approved by the
development plan.
Planning Commission Recommendation
The Planning Commission recommended approval of the conditional use
permit. The Planning Commission was concerned that the handicapped
parking is not near the daycare center entrance. Staff has contacted Kevin
Johnson at Phoenix Enterprises, who has indicated that the handicapped
parking will be moved closer to the daycare center entrance. New Horizon

staff is also available at the drop-off area to assist handicapped children in
and out of the center.
Recommendation
Staff and the Planning Commission recommend approval of the conditional
use permit to allow a daycare center in a C-3 zone with the following
conditions:
1. The landscape/site plan as submitted by Blumentals Architecture, Inc.
shall be adopted and included as part of this application.
2. One wall sign will be allowed for the daycare facility. The applicant must
receive a sign permit prior to placing any signs on the property.

Phoenix Enterprises, LLC is requesting a conditional use permit to locate a
New Horizon Daycare Center in a C-3 zoning district. Licensed daycare
facilities are a conditional use in this zoning district. The daycare center will
be housed in the Hillside Crossing South strip mall. Most of the necessary
site improvements were addressed in the plat approval for Hillside Crossing
South.

However, the landscaping for the rear yard in the daycare center is not
addressed in the approved site plan. Staff has received a detailed plan of the
play area from New Horizon Daycare. Basic information is enclosed in this
packet, but additional information will be available at tonight's meeting.
The rear yard will be fenced with a five foot high fence. New Horizon is
proposing to use a high grade plastic fence in the play area. The plastic fence
is currently being used in their Fridley and Champlin facilities, and New
Horizon Daycare believes the plastic fence is more attractive than traditional
chain]ink fence. Attached is some informational material on the proposed
fence.

Conditional Use Permit

the Elk River Ordinance. Staff believes that the applicant meets these seven
standards.
Recommendation
Staff recommends approval of the conditional use permit to allow a daycare
center in a Co3 zone with the following conditions:
