Consider Initiating Ordinance

Request
Consider initiating an ordinance amendment that would allow used car sales
in the light industrial zoning districts.
Overview
Staff has been working with a Mr. Rueben Penske who would like to locate
his business at the northeast corner of Highway 10 and 165th Avenue. Mr.
Penske would like to lease some space in the recycling center building that is
located at the described property. Mr. Penske's business of used car sales is
currently not allowed in the light industrial zoning districts, therefore, he
has requested that the city consider amending its ordinance to allow used car
sales in the light industrial zoning district.
Attached is a letter from Mr. Rueben Penske describing his business and his
request to have the City Council consider amending the ordinance.
If the City Council wishes to initiate this ordinance amendment, staff would
present this to the Planning Commission at their August 27th meeting, and,
upon a recommendation from the Planning Commission, have the issue
brought back to the City Council on September 16th.
Recommendation
The City Council is asked to consider initiating an ordinance amendment and
directing staff to schedule a public hearing and present the issue to the
Planning Commission at its next available meeting.

The business of Penske Auto Connection Inc. & Rivers America Inc. is
listed below and will be operating on the shared business site of
16501 Hwy. 10
have recently received license from the state of Minnesota for operating
used car & truck / repairable car & truck business- # 22675
PENSKE AUTO CONNECTION
-Buying, repairing, reconditioning of repairable used & late model
cars and trucks.
-Brokers of cars and trucks. This service provides for customers
who the service of locating specialized vehicles they wish to
purchase.
-Sales of automotive products and accessories: security equipment,
a unique fuel additive, called "X-tra Mile", which increases fuel
efficiency.
RIVERS AMERICA, INC.
- Marketing and sales of cusome designed Pre- Paid Phone cards and
customer incentive programs to businesses and non-profit
organizations
Also, as a result of my business being located on the 16501 site, there
will be an added benefits of our investment into site improvements and
maintenance.
My business plan is designed to serve the Elk River community in ways
that will enhance community relationships. As I havea Masters Degree in
counseling and have served as the Executive Director of
Creative Life Resources, my intention is to continue to offer to the
community, training programs for couples for building communication and
relationship skills.
My plan is to begin to set up this business operation July, 1996

Request for Assignment of Ordinance
Please consider my request for writing an additional ordinance to include
Hithway Commercial use at 16501 Hwy 10, that would allow the
establishment of and operation of a used car sales lot for Penske Auto
Connection, Inc.
The property that I wish to have the ordinance attached is described as:
where the Recycling Center is currently located on 16501 Hwy 10,
which is currently zoned for "light industrial".
