DATE: July 22, 1996 SUBJECT: Request by the City of Elk River for Rezoning, Public Hearing Case ZC 96-10 Issue: The City of Elk River has initiated a rezoning request to rezone approximately 60 acres of Cargill's property lying south of 165th Avenue and east of Highway 10. The property is currently zoned RIA (Single Family Residential) and the request is to change this zoning to I1 (Light Industrial). This action the Council has been asked to consider is the final step in implementing the Comprehensive Plan. The Council may recall that during the Comprehensive Plan process, the urban service boundary that was originally proposed to include a majority of Cargill's property was reduced in size to now include an area of approximately 250 acres, generally bordered by Highway 10 on the west and the railroad tracks on the east. This urban service boundary includes the 60 acres considered for rezoning this evening. As a follow up action to establishing the urban service boundary, the City Council also amended the Comprehensive Land Use Plan Map for the subject 60 acres, changing the land use to reflect a LI (Light Industrial) land use designation. These two actions, the urban service boundary adjustment and amendment of the Comprehensive Land Use Plan Map, have obviously been completed and adopted by the Council leaving the action of rezoning the property to light industrial to comply with the Comprehensive Land Use Plan Map. It is important for the Council to understand that staff is making every attempt to understand Cargill's operation and in no way wishes to jeopardize the future of their existing structures south of 165th. It has been our intention all along as evidenced in downscaling the urban service boundary to concentrate on Cargill's property that lies within the Highway 10 corridor for consideration of urban service development. The remaining 750 (+ or -) acres currently zoned Rla is being considered for any change to infringe upon Cargill's operational needs. 13065 Orono Parkway · P.O. Box 490 · Elk River, MN 55330 · (612) 441-7420 · Fax: (612) 441-7425 At this point, staff recognizes that Cargill has raised concerns regarding the rezoning of their 60 acres lying south of 165th that may merit further discussion with Cargill to better understand their current and long term needs. One option the City Council could may this evening is to defer action on the rezoning of the 60 acres for one month to allow staff the opportunity to meet with Cargill and discuss in more detail issues related to this proposed rezoning. However, it is staffs full intention to continue to implement the Comprehensive Plan as adopted including initiating appropriate rezonings unless the plan is amended by the City Council. Recommendation: Staff would recommend the City Council defer action on this item for one month to allow staff the opportunity to meet with Cargill and further discuss the issues relating to the rezoning and present those to the City Council next month. s:Xcouncil\zc96-10c.doc
