O'Meara stated purpose of meeting is to better understand the issues and come to a negotiated resolution without litigation. ISD 728 was planning to submit request for water appropriation to use both wells but delayed for outcome of this meeting. 2. With opening comments by Adams and Bratlie, group reviewed Elk River Municipal Utilities letter dated December 20, 2006 and DNR response on December 26, 2006. Adams stated this irrigation well issue started three to four years ago when property was being acquired. Elk River Municipal Utilities letter on August 4, 2006 was discussed, Adams stated this offer was off the table because ISD did not respond, yet proceeded to drill an additional well at Lincoln for irrigation purposes. 3. Bratlie implied it was ISD's intent to construct more irrigation wells as a cost saving measure instead of paying higher water rates. 4. All agreed ISD can do a better job of following sprinkling restrictions and use moisture meters to help reduce irrigation needs. 5. City and Utility ordinance was discussed. ISD is not convinced City can preclude them from utilizing a well. (Language is weak, again verify with Peter Beck.) 6. DNR &MRW commended on requirements of wellhead protection plan. DNR stated ISD's proposed wells will influence the municipal well. Due to Elk River having only one aquifer, they are correct in being protective of this water source. 7. DNR commented on Elk River conservation plan and Elk River is carrying forward the DNR request to promote conservation through rates. DNR stated that Elk River's 10 year appropriation will carry a requirement to monitor Mt Simon aquifer with test wells. Apparently DNR is somewhat concerned with Mt Simon aquifer quantity and level of drawdown. 8. ISD asked why Zimmerman and Rogers allows irrigation wells but not Elk River. Adams, DNR and MRW responded "we do not know, each case is to be reviewed separately." (Possible reasons are no city ordinance, no wellhead protection issue do not take water conservation seriously. If schools provide irrigation, city does not have to provide infrastructure.) 9. ISD did not understand City on providing potable water only and not irrigation water. City does not operate two systems, potable and irrigation. Existing irrigation well is not grouted and therefore cannot be used for potable water. 10. MRW and DNR stated this is a state wide issue and not just Elk River. ISD is looking at this issue from a money perspective $30-$40K/yr. at this time with more wells in the background. MRW, DNR and Adams looking at it from ground water protection, conservation, protecting revenue streams to pay bonds with more cities watching the outcome. 11. DNR would desire a negotiated settlement so they aren't the bad guy. Other communities where this issue arose, the local parties found a solution before DNR had to rule. DNR is getting weak kneed. If they do not support Elk River Municipal Utilities, DNR's entire conservation plan becomes obsolete state wide. State Statute requires DNR not approve the permit for ISD if City objects and they stated such. Because City Park and Recreation Department uses school facilities, maybe City wants to finance some of the irrigation costs - (not likely to happen). 12. Who is really pushing this irrigation well issue, ISD or MN Well Drillers Association of which Roger Renner is very active? 13. O'Meara suggested Elk River allow ISD to use wells for one year until solutions could be found. Adams suggested municipal water system is available for their use at established rates. If ISD uses <1,000,000 gal/year, they do not need a DNR permit but that is not enough water to meet their needs and would be in violation of City ordinance. A special rate for a governmental entity would be in violation of conservation rate structure. Even City pays the current rates although Utilities pays some of City's electric. Multiple irrigation wells to take advantage of the 1,000,000 gallon rule would not be approved by DNR. 14. It was suggested to get an opinion from the Attorney General about City ordinance and DNR's position. Time to get this opinion does not fit ISD's time frame and DNR was not interested in picking up the costs. 15. Adams and Waterius to discuss this issue further to find resolution Three Options a) Do nothing --ISD will get lower water rate ($1.40/1,000 gal.) for Twin Lakes Elementary School for one year only. Lincoln well and Twin Lakes well to be sealed. b) Let school do as they wish. c) Honor August 4, 2006 compromise but now Lincoln well must be properly sealed. Elk River Municipal Utilities 13069 Orono Parkway Flk River, MN 55330 December 20, 2006 Ms. Laurel Reeves D1vR Water 500 Lafayette Rd Box 48 St. Paul, MN 55155-4048 Subject: Water lise Permit Dear Laurel, phone: 763.441.2020 Fay 7G3 44 ~ So99 Elk River School Distract #728 has a desire to bypass the Elk River municipal water system and utilize their own wells for lawn irrigation purposes. Eastern Elk River is in the beginnings of an approximate 1000 home development. See the attached conceptional composed map. The area contains a school named Twin Lakes Elementary that is currently under construction. Adjacent to this school is an area set aside for future well, treatment plant, police and fire station. There is a farm imgation well on the grade school property (remnants from the previous farm) the school district desires to use for irrigating their lawn and ball fields. This is a Mt Simon Hinkley Well. The well log is attached. The MN unique well ik\ number is.664852 and is built to non municipal standards. This existing well is approximately ~1~'~ ' 100 yards from the future municipal well and will be within the DWSMA of the future municipal well. The school district is also in the process of constructing a new well at Lincoln Elementary School at 600 School St., Elk River. The intent is to by pass the municipal water system and use the well for irrigating the school lawns and play area. It is not known if this well under construction will end in the Mt Simon Hinkley formation. This well is at the edge of the DWSMA for our municipal well #3 and may have a detrimental effect on our plans to utilize our municipal well #2 as an aquifer storage and recovery well. The utilization of the existing irrigation well at Twin Lakes Elementary and the well under construction at Lincoln School by the school district will have a negative impact on the municipal water system of Elk River. MN Statute 103I.111 Subd 3 states "....Apolitical subdivision may not regulate the construction, repair, or sealing of wells...." In other words, local ordinance can not prohibit the construction of water wells; this is reserved to the MN Dept of Health. MN Statute 103G.271 addresses appropriations and use of waters. Subd 2 states ".... A water use permit may not be issued under this section unless it is consistent with state, regional, and local water and related land resources management plans if the regional and local plans are consistent with statewide plans." The Elk River Municipal Utilities requests that water use appropriation permit for these two wells not be issued to Elk River School District #728 for the following reasons: 1) Elk River City ordnance and Elk River Municipal Utilities policies requires all building to connect to the municipal water system if available. See attached ordinance. The water system is available at both locations. This ordinance exists because the revenue from water sales pays for the infrastructure costs to furnish domestic water, fire protection, and water for irrigation. Allowing water customers to construct new wells for the irrigation use will substantially change the water revenue stream, there-by jeopardizing the ability to pay outstanding water revenue bonds. Other customers in Elk River have inquired about constructing irrigation wells. Allowing this is not consistent to local financial planning. 2) The Elk River Municipal Utilities has adopted, and the DNR has approved, our Well Head Protection Plan. The existing Twin Lakes Elementary School irrigation well, built to non municipal standards is in the DWSMA of the future municipal well. The well under construction at Lincoln School is adjacent to well # 3 DWSMA and is in the 10 to 20 year travel area. This well could also compromise the aquifer storage and recovery project for municipal well #2. This is not consistent with the Well Head Protection Plan. 3) The Elk River Municipal Utilities has adopted, and the DNR has approved, our Conservation and Emergency Plan. Part III of this plari addresses water conservation measures. In the past, the school district has not followed the sprinkling restrictions outlined in this plan. A conservation strategy as suggested by the DNR is inclining block rates. The Elk River Municipal Utilities has implemented this rate strategy. The school district responded it is more economical to construct an irrigation well than pay the Elk River Municipal Utilities rate structure. These rate sheets are enclosed. By allowing the school district to utilize these irrigation wells, you are allowing them to circumvent the conservation strategies of our water plan. This is not consistent with the water plan. 4) Ground water, particularly from the Mt Simon Hinkley aquifer, is a valuable natural resource. It is the only viable aquifer in the Elk River area. The public perception that ground water is "free" and "inexhaustible" can not be promoted, and must be highly discouraged. The current public policy of renewable and sustainable use of natural resources does not support the utilization of these two irrigation wells. We ask for your support in this matter call. During construction of this school, this well was used for construction purposes until the municipal water system became available. It is now your desire to permanently use this well for irrigation purposes. It is the desire of the Elk River Municipal Utilities that this well be permanently and properly sealed for the following reasons: a) The Elk River Municipal Utilities has located a municipal well adjacent to this school site, that will be constructed in the near future. Having a private high capacity vv~ell adjacent to the municipal well will have a detrimental effect on the municipal well. b) Elk River Municipal Utilities policy and City ordinance, requires all new facilities to coiLnect to the municipal water system if the municipal water system is available, which in this case is. In existing residential areas where the municipal water system is extending into the area, customers are given an allotted time to connect to the water system but are allowed to keep their existing wells for irrigation. These wells are low capacity and often shallow wells. c) One of the goals of the Elk River Municipal Utilities Wellhead Protection Plan, is to seal all the wells in the urban service district to prevent possible contamination of the aquifer. d) Ground water is a valuable and limited resource. The Elk River Municipal Utilities rate structure is designed to encourage customers to use water wisely and consciously irrigate only when necessary. The school district historically has been very aggressive in their lawn sprinkling practices. e) T'he revenue derived from customer water use pays for the operation and maintenance of the water infrastructure to support domestic and fire protection needs. Fire protection does come at a cost. As a compromise, the Elk River Municipal Utilities would allow the school district to use the existing well for irrigation purposes only until such time that the Elk River Municipal Utilities starts construction of a municipal well adjacent to this elementary school site. At that time, the school district will immediately stop use of this well, and properly seal it at their expense. If this compromise is acceptable to you, please sign, date and return this letter. As you are aware, we have also received a letter from the City of Elk River expressing concern about such plans. As the District considers the use of existing wells or new wells to irrigate school grounds, please be aware of the following potential issues: 1. Any use of water exceeding 1 million gallons per year and/or 10,000 gallons per day requires a water use permit from the Department of Natural Resources (DNR). 2. Minnesota Statutes, Section103G.271, Subd. 2, requires that a water use permit cannot be issued unless it is consistent with all local plans. As you are aware, the City of Elk River has advised us that City Ordinances and policy requires use of the municipal water supply system for all water use, if it is available. It is unlikely that we could approve a water use permit for the District, if the City objects. The City of Elk River has adopted and the state has approved a Wellhead Protection Plan. The City advises us that the well the District is considering using for irrigation may not be consistent with that Plan. If this is true, the DNR could not issue a water use permit to the District for use of the old irrigation well and the Department of Health could not issue any permit to construct or improve such an irrigation well. 4. The City advises us that they have plans to construct a new major water supply well within a few hundred yards of the well the District is considering using for irrigation. State Law sets up priorities for water use permits, and the City's water supply well will take priority over any irrigation well used by the District. The DNR would have to require that any use of the old irrigation well be reduced to the point where it does not interfere with any public water supply system well. 1n light ~f these facts, we urge the District to work closely with the City of Elk River in deciding how to irrigate its grounds. Based on our current understanding of the situation, it is unlikely that the DNR could approve a water use permit that would meet the District's lawn irrigation needs. A number of years ago, we started marketing Levington surge protectors as a strategy to educate our customers and minimize damage. Our marketing effort never really was successful. Border States, our wholesale supplier, has discontinued marketing this line. Elk River Winlectric has picked up this surge protection line. I see no reason for us to continue marketing these products. We have about a dozen customers that we have installed whole house surge protectors at the meter base, we monitor these surge protectors and charge $4.50/month to monitor and replace if they fail. None to date have failed. Some of our customers have called and inquired about purchasing these surge protectors instead of continuing to pay $4.50/month. At this rate, these devises have more than been paid for. Because we installed these devices, we have some ongoing liability if we discontinue this program. One solution is to give these devices to the customer and forgo the monthly charge if they sign an indemnity agreement. Attached for your reference is an indemnity agreement drafted by Ron Black. After our attorneys reviewed the agreement from OUE, it was recommended that we create and adopt policies to recognize our fiduciary responsibility to be in compliance with the Fair Credit Reporting Act, and establish repercussions for its misuse. The attached Policy is the result of that request. It has been reviewed by our attorneys and by OUE. Staff recommends its adoption. Elk River Municipal Utilities Personal and/or Credit Use 8~ Security Policy Elk River Municipal Utilities (ERMU) collects social security numbers and has access to credit information in order to better position the organization to be able to collect unpaid debts. ERMU will request and use personal and/or credit information solely in connection with credit transactions involving the consumer as to whom such information is sought, or for other "permissible purposes" as defined by the Fair Credit Reporting Act, 15 U.S. C. Section 1681 et seq. ("FORA") and to effect the collection of unpaid debts. 1. Effective Date The Plan's Credit Use Policy is effective XXX xx, xxxx. The Policy will remain in force until changed or rescinded by Management or Board Action. 2. Security Management Process Risk Analysis and Risk Management . Appropriate security measures are implemented to protect the confidentiality and integrity of this information described in this policy. Measures in place consist of limited dedicated user access to personal and/or credit information, employee signature acknowledging responsibility, computer passwords, locked cabinets, and locked facilities with limited access. Employee Sanctions ERMU will apply appropriate employee sanctions to any employee ERMU who violates the Personal and/or Credit Use and Security Policy. Sanctions can include termination of employment when appropriate. 3. Security Official The Plan(s) will officially designate a Security Official and maintain written record of the designation. The current Security Official designation is the Finance Director. Responsibilities of The Plan(s) Security Official include: a. Periodically evaluate this policy and the procedures implemented to protect personal and/or credit information. The Security Official will maintain reasonable and appropriate policies and procedures to comply with the FCRA Standards and make appropriate changes when necessary. b. Regularly review the activity of any information systems involved in the maintenance or transmission of personal and/or credit information to determine if information has been used or disclosed in an inappropriate manner. 4. Workforce Security Employee authorization to access systems that obtains or transmits personal and/or credit information, including determination of appropriate employee clearance level, person authentication, and effective and timely termination of system access for employees who no Commission adopted longer qualify for system access will be the responsibility of the Security Official. The Security Official may delegate these duties to appropriate parties. 5. Security Awareness and Training The Policy will require any employee of ERMU who is involved in the administration or management of personal and/or credit information to certify in writing that they have received training and have read and understood The Personal and/or Credit Use & Security Policy. Employees will also be provided additional security training when available and appropriate. This training may include (but not be limited to) security reminders, protection from malicious software. At least once per year, the Security Officer will review the Personal and/or Credit Use & Security Policy with individuals involved in the administration and management of the information. 6. Workstation Use and Security Access and Audit Controls The Policy implements the following procedures to control access to personal and/or credit information and manage access to workstations that can be used to access personal and/or credit information. Employees will be assigned unique user names and passwords for systems used to access personal and/or credit information. The following workstation procedures will be implemented to rrunirnize the potential risk of inappropriate use of personal and/or credit information to the extent possible and reasonable. a. When accessing personal and/or credit information on a workstation, employees will reduce visible windows or close programs whenever they are not physicallypresent at the workstation or when individuals not authorized to access the personal and/or credit information can view the workstation. b. Workstation screensavers will be set to engage at a reasonablyshort timeframe. c. Workstations will be located in areas where viewing of personal and/or credit information by unauthorized individuals is unlikely. d. Users with portable workstations such as laptops or PDAs are not allowed to store personal and/or credit information on workstation drives. All personal and/or credit information should be stored on companyservers subject to securiryprocedures described in this policy unless the Security Officer determines it is necessary for plan administration purposes to store personal and/or credit information on portable workstations. Employees who have been granted access to personal and/or credit information according to the policies and procedures will be subject to the sanction policy if they allow unauthorized access to personal and/or credit information by circumventing access control (e.g. sharing their unique login I.D. and password). 7. Device and Media Controls and Integrity of Data, Destruction of Data Any personal and/or credit information stored by the company in electronic storage media will be subject to the following procedures to ensure that the personal and/or credit information is not inappropriately used. • All hardware, storage devices, and electronic media which contains or contained credit and/or personal information will be erased, re-formatted or rendered unusable in a technicallysufficient manner prior to disposal, or re-use for other purposes, to assure no unauthorized access to credit and/or personal information u possible in the future. Additionally, all papers containing Commission adopted personal and/or credit information will be destroyed by burning, pulverizing, or shredding so that the information cannot practicably be read or reconstructed. The Plan's Security Official will be responsible to ensure that electronic media is controlled in accordance with this policy and maintain any reasonable documentation necessary. Commission adopted Fair Credit Reporting Act Personal and/or Credit Use & Security Employee Responsibility Form I~ ,have read and understand Elk River Municipal (Employee Name) Utilities policies regarding the request and use of credit information received, as mandated by the Fair Credit Reporting Act, 15 U.S.C. In addition, I acknowledge that I have received training in Elk River Municipal Utilities policies concerning credit information use, disclosure, storage and destruction. In consideration of my employment or compensation from Elk River Municipal Utilities, I hereby agree that I will not at any time -either during my employment or association with Elk River Municipal Utilities or after my employment or association ends -use, access or disclose personal and/or credit information to any person or entity, internally or externally, except as is required and permitted in the course of my duties and responsibilities with Elk River Municipal Utilities, as set forth in Elk River Municipal Utilities privacy policy and procedures or as permitted under FORA. I understand that this obligation extends to any personal and/or credit information that I may acquire during the course of my employment or association with Elk River Municipal Utilities, whether in oral, written or electronic form and regardless of the manner in which access was obtained. I understand and acknowledge my responsibility to apply Elk River Municipal Utilities policies and procedures during the course of my employment or association. I also understand that unauthorized use or disclosure of credit information will result in disciplinary action, up to and including termination of employment or association with Elk River Municipal Utilities and the imposition of civil penalties and criminal penalties under applicable federal and state law, as well as professional disciplinary action as appropriate. I understand that this obligation will survive the termination of my employment or end of my association with Elk River Municipal Utilities, regardless of the reason for such termination.
