APPA's Congressional Rally in Washington D.C. is February 25 -March 1 2006. Jerry Talke and myself will be attending unless this commission desires otherwise. Also the MMUA legislative conference and winter conference is March 29 - 31 2006 in Bloomington, MN. I would again encourage this commission to attend as well. Attached is an action alert from the league of Minnesota Cities reaction to cities not being allowed to certify tenants delinquent utility charges (water & wastewater) to landlords or property owners. Two other update items are the 4`~' engine at the landfill and Aquifer Storage & Recovery project. The necessary air permit has been secured from the MPCA for the 4`~' engine. ~ The final hold up is a signed contract from Waste Management. Their attorneys are still reviewing it. On Monday, January 30, a working group will meet for the first time. The 'OS legislative session established the working group to examine allegations that cities should not be allowed to certify tenants' delinquent utility charges to landlords or property owners. The working group must report findings and recommendations to the legislature in 2006. Please contact me immediately if your city has received inquiries about this issue by anyone other than LMC. Read more about these concerns at the end of this Action Alert. Representative Olson and Senator Wergin -who are both on this working group - authored identical ("companion") bills (HF 1367/SF1009) during the 'OS legislative session that would have taken away cities' authority to certify tenants' delinquent water and sewer utility charges to the landlord or property owner. (As you know, the certified delinquent charges go to the county to be collected with property taxes.) These bills did not go forward because LMC and member cities told legislators how important it is to be able to collect tenants' delinquent utility charges from landlords or property owners through the certification process. The legislators on the working group are: Senator Wergin, Representative Olson, Representative Bill Hilty and Senator Wes Skoglund. Two people in the working group represent AN EQUAL OPPORTUNITY/AFFIRMATIVE ACTION EMPLOYER LMC Page 2 January 26; 2006 .cities, and two people represent rental property owners. One person represents tenant interests. Two people represent the general public, for a total of eleven members. The League is completing tabulation of a survey of cities (in which-your city may have participated) to assess the extent to which cities depend on existing statutory authority to certify delinquent rental property water and sewer utility charges. Those findings will be presented to the first meeting of a working group on Monday, January 30`h The League is also aware of another issue on which we are seeking immediate information: If your city has recently been contacted and questioned about whether your city supports the current practice whereby cities certify overdue water and sewer bills to the county for collection with property taxes, please contact me immediately. There has been at least one instance in which a city has been contacted in this manner without appropriate disclosure of the identity or intent of the individual who has inquired about current city practices in this area. Please also contact Representative Mark Olson and/or Senator Betsy Wergin as soon as possible. Tell them how important it is for your city to keep the authority to certify tenants delinquent water and sewer charges to be collected with property taxes. ~..~.,~.
