As seen by the graphs in the financial section, July was a peak month for electric and water production. The August sales graphs next month will reflect July's consumption. Our large electric projects continue to make good progress. We will update you at our meeting. As we start the budgeting process, we are starting to look at next years electric and water load increases. Residential load increase will continue to be slow due to building slow down and high gas prices, although Liberty Heights Estates development is moving forward. This development has 469 lots per the attached drawing. The commercial/industrial development remains very strong. The attached sheet titled `2007 Commercial/Industrial Electric Growth' reflects estimated projects and electric load growth. This is an approximate 15% increase for commercial/industrial electric load. This project will probably require an additional well for the 2008 watering season with construction in late 2007. Copper and aluminum metal prices continue to remain high. The attached article titled "Price of scrap includes Death" explains what happens to thieves taking copper out of transformers. Attached is a copy of a letter dated 8-4-06 to ISD 728 concerning the use of an irrigation well at Twin Lakes Elementary School. By Felisa Cardona Denver Post Staff Writer DenverPost.com A body found in an Aurora field provided grim evidence that the soaring price of scrap copper has would-be thieves taking extraordinary risks. A man, whose identity was not released Monday, apparently was electrocuted late Sunday night as he broke into an electrical transformer in search of copper wiring. "He's a victim of his own miscalculations," Aurora police Sgt. Rudy Herrera said. Denver firefighters found the body in a field in the 19600 block of East 64th Avenue in Aurora after 11 p.m. Sunday. Rescue workers were called to the area by a man who accompanied the victim to the transformer. Police questioned him regarding the theft and the electrocution and let him go, but the case remains under investigation, Herrera said. Police throughout the metro area have seen copper thefts rise along with the price of the metal, especially on construction sites. The price of copper is hovering around $3.50 a pound, according to the New York Mercantile Exchange. Since 2003, copper's prices have nearly tripled as supply, largely from Chile, failed to keep pace with increasing construction demand. "It's just simply for profit. That is the bottom line," Herrera said. "It would seem that this is at least somewhat profitable because folks continue to do it. In this case, this man risked his life in order to get his hands on some of that copper." The theft of other metals, such as aluminum and silver, is also popular as their prices increase. Recently in Westminster, thieves stole sections of aluminum bleachers from Wolff Run Park. Even stamping the city's seal on bleachers did not stop a recycler from accepting them, police said. In May, a man was trapped after several copper pipes fell on his leg while he was trying to steal them in Centennial. The man was accompanied by his pregnant wife and 20-month-old child. His family had to call for help. The Aurora transformer that was broken into Sunday belongs to Xcel Energy, but the company believes that it's the first time an attempted theft like that has occurred. "Quite frankly, there is kind of a natural sense here that you are probably not going to take metals from live equipment," said Xcel spokesman Mark Stutz. "I don't know if he thought it was not active, but there is a sound generated when electricity is flowing. We don't usually see this. It's pretty rare, and we hope it stays that way." The Adams County Coroner's Office is expected to perform an autopsy to determine how the man died. During construction of this school, this well was used for construction purposes until the municipal water system became available. It is now your desire to permanently use this well for irrigation purposes. It is the desire of the Elk River Municipal Utilities that this well be permanently and properly sealed for the following reasons: a) The Elk River Municipal Utilities has located a municipal well adjacent to this school site, that will be constructed in the near future. Having a private high capacity well adjacent to the municipal well will have a detrimental effect on the municipal well. b) Elk River Municipal Utilities policy and City ordinance, requires all new facilities to connect to the municipal water system if the municipal water system is available, which in this case is. In existing residential areas where the municipal water system is extending into the area, customers are given an allotted time to connect to the water system but are allowed to keep their existing wells for irrigation. These wells are low capacity and often shallow wells. c) One of the goals of the Elk River Municipal Utilities Wellhead Protection Plan, is to seal all the wells in the urban service district to prevent possible contamination of the aquifer. d) Ground water is a valuable and limited resource. The Elk River Municipal Utilities rate structure is designed to encourage customers to use water wisely and consciously irrigate only when necessary. The school district historically has been very aggressive in their lawn sprinkling practices. e) The revenue derived from customer water use pays for the operation and maintenance of the water infrastructure to support domestic and fire protection needs. Fire protection does come at a cost. As a compromise, the Elk River Municipal Utilities would allow the school district to use the existing well for irrigation purposes only until such time that the Elk River Municipal Utilities starts construction of a municipal well adjacent to this elementary school site. At that time, the school district will immediately stop use of this well, and properly seal it at their expense. If this compromise is acceptable to you, please sign, date and return this letter. PAGAN, P.E., P.L.S. Has government regulation of land development gone too far? overnmental authorities, at just about all levels, may be stifling reasonable development of our nation's resources. I am motivated to write a column on this subject as I scan the first of 23, 36- by 24-inch site plan sheets for a 20-acre piece of property that is being considered for develop- ment The site is in asemi-residential municipality, not too far from where I live and practice engineering. Most, if riot all, of the environmental and other concerns listed on the site plan should be addressed. Each item, taken individually and out of context, appears to be reasonable. But the listing of information required to seek and get approval for the project, when taken as a whole, may be excessive. For example, the various, local deliberative bodies assess the following information and restrictions in deciding whether to approve site development: • building floor area proposed; • a "Bulk Requirements" listing of 88 types of use permitted or regulated, primarily by the municipality -including perform- ance standards involving fire hazards, radioactivity, smoke, atmospheric pollutants, liquid and solid waste, vibration, noise, odors, glare, and tragic; • type of land use permitted; • free-standing sign requirements -five types are noted; • regulations regarding attached signs (different from free-stand- ing signs), including the number, location, maximum dimen- sion, and total area of all signs; • four standards describing flag poles -only one is permitted with only one flag flown and only specified types of flags (U.S., state, county, or foreign country), the maximum height is 40 feet or 5 feet above the principal building, whichever is less; • buffers for residential and non-residential areas listing visual separation requirements; • environmental protection standards listing flood damage prevention, potable water protection, well monitoring, mining specifications, stormwater management rules, and control rate of runoff specifications; • street grades, curb return radii, sight easements, street and pave- ment material, and pavement thickness design standards; • sidewalk specifications, including widths, required illumination levels, maximum light fixture heights, maximum lawn gradients, embankment slope reyuirements, and minimum gradients; • detailed loading dock standards; • parking saturation and specifications regarding the type of angle parking permitted; • minimum two-way and one-way driveway widths, minimum widths for 90-degree parking, parking lot gradients, and spac- ing data for the handicapped; and • landscaping requirements, including minimum tree and shrub size and parking lot shade tree density-at least one tree per 25 parking spaces is required. Other required data and restrictions include on-line septic disposal rules, conservation area(s), permitted shoreline develop- ment (if applicable), stream encroachment rules, wetlands data, seasonal high water data, soil removal specifications, and permitted solid waste collection and disposal details. Another listing on the same cover sheet spelled out many additional requirements, such as a saturation parking plan, pursuant to minimum parking provision requirements; architectural renderings, including side and rear eleva- tions; and a statement regarding sanitary sewage volumes permitted. Also, rerycling must comply with local requirements (Does this need to be stated?)> all utilities must be underground, and curbing must be made of Belgian block or concrete. Additionally, a stormwater drainage report must be provided, groundwater monitoring wells are required, and a minimum distance of 25 feet from wetlands must be maintained. Wetlands must be protected prior to construction with snow fences and filter fabrics. The following variances and waivers also are fisted: • the scale of the drawings will be 1 / 16 inch, although in this case, the permitted scale is 1/8 inch scale; • the plan meets Americans with Disabilities Act requirements that differ from the municipal requirements; and • the ordinance requires 9- by 20-foot parking space site, but a 9- by 18-foot size is provided to reduce impervious area and permit more landscaping area. I have not included all of the requirements or data shown on this one sheer, but you get the idea. One is titled "Indiana Bat Restrictions," banning tree removal during the breeding season for that endangered species, since the site is habitat for the Indiana bat. To summarize, local control of medium to large commercial projects is good for the environment, as well as for the people who live near them. But sometimes this leads to governmental overkill. The project discussed here may be such an example. As an aside, since I sometimes review projects such as this one in my consulting practice, perhaps I should shut up, do my reviewing, and just get paid for the work. But maybe less bureau- cratic overkill is necessary to ensure a high quality of life in and around acreage that is being developed. Governmental regulation of land development projects proba- bly has not gone too far. But perhaps detailing all of the precau- tions that must be taken should be left to the design professionals who have the responsibility -and expertise - to protect the environment, rather than to bureaucrats trying to anticipate all possible variations on the theme of land development. ^ glfred R. The environmental business case: There is a sound business case for be- ing environmentally proactive. The rising expectations of middle-class consumers worldwide are a potential strain on resources, but a certain op- portunity. The essence of capitalism is look- ing forward, not fighting to maintain the status quo. Capitalism's success in spurring economic growth is rooted in "creative destruction," as described by economist Joseph Schumpeter. The success of Toyota and Honda vs. troubled General Motors and Ford is partly attributable to the Japanese firms' aiming for future markets (sub- compacts in the 1970s, hybrids in the present), while the U.S. firms stub- bornly focused on successful profit- able products (high-margin gas guz- zlers in both eras), and fought at- tempts to mandate higher mileage standards. What are the building blocks of the path toward apost-petrol future? Market-driven: Government can- not effectively mandate disruptive shifts to energy sources of the future. But it can play a leading role by seed- ing the landscape, as it did during the Cold War era by funding basic re- search, which became the foundation of Silicon Valley. Forward-looking: Subsidize future technologies, not current political di- lemmas. For the right, glorifying SUVs as a symbol of liberty is dangerous in an era when we are threatened by oil-producing countries that fund a range of toxic societies and ideologies worldwide. For the left, serious con- sideration ofunpalatable alternatives like nuclear energy and Alaska drill- ingshould bepart of the solution. lh-olutionarY alternatives: It is im- possible to predict tomorrow's energy efficiencies precisely. But a variety of existing technologies have the poten- tial to reduce oil consumption incre- mentally, and together, they can put us on the path to the post-oil era. Ethanol is one obvious example. And cellulos- ic ethanol -made not from corn but from carbon-based waste products such as switchgrass, sewage sludge and wood chips - is attracting a lot of investor attention. Revolutionary alternatives: Future generations will consider us wise if we invest additional billions now in basic research, pursuing radical ad- vances in safer nuclear energy pro- duction and disposal, cold fusion, batteries, and solar, wind and water- driven energy. About 150 years ago, the United States was a rapidly growing eco- nomic and social force, in the era when coal and whale oil were the energy foundations of our economy, and petroleum was considered near- ly worthless.
