I have been in contact with Don Schumacher of Cretex Companies, Ken Beaudry of
Beaudry Oil, and Dr. Jarmoluk concerning the Lowell Avenue upgrade. Both Don
Schumacher and Dr. Jarmoluk are very much in favor of the improvement and are willing
to sign a petition waiving their rights to appeal. Ken Beaudry indicated support for the
project but concern regarding the timing of the improvement. He is very much against
any improvement that would be constructed yet this fall. As you are aware, he is in the
process of constructing a new office building on Proctor Avenue. Currently, he is
operating his entire business out of his Lowell Avenue facilities. By the spring of 1997,
the bulk of his operation will be operated out of the Proctor Avenue facilities. He
indicated that he would support a project if it were done in 1997.

Given this, I would suggest that the project go through the normal improvement project
process, whereby a feasibility is ordered, public hearing held, project bid, and an
assessment hearing is held before awarding the project. There is ample time to get these
steps completed and still have a project under construction in the spring of 1997. This
would also allow the City time to include Sherburne County in the hearing process, so
there will be no need to negotiate with them relative to paying their assessments.

Attached is a draft resolution ordering the feasibility. Without a petition from the
abutting property owners, this would be a City-initiated project; it therefore requires a 4/5
vote to proceed. We have already done the preliminary survey work, anticipating a 1996
construction schedule. Therefore, the feasibility study would be a rather simple
document, primarily detailing costs and assessments. During the preparation of the
feasibility, I plan to meet with the affected property owners and work out any details on
a preliminary design so that all property owners are happy with the project before the
public hearing is held.

In the spring of 1997, I believe there will be other projects that this could be tacked onto
for bidding purposes. Jarvis Street improvement is the first thing that comes to mind.
I am sure that there will be other projects available that this could be tacked onto to
ensure a reasonable bid.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION OF THE CITY OF ELK RIVER
ORDERING A PRELIMINARY FEASIBILITY REPORT IN THE
MATTER OF THE LOWELL AVENUE IMPROVEMENT OF 1996
WHEREAS
WHEREAS
the City has determined that it should consider improving certain property by
reconstructing Lowell Avenue (the improvement); and
Council must first secure a preliminary feasibility study in order to consider
making the improvement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
This matter shall be referred to MSA, Consulting Engineers, who is requested to provide
to the City Council a report advising, in a preliminary way, whether the proposed
improvement is feasible and whether the improvement should thus be made as proposed
or in connection with some other improvement and the estimated cost of the improvement
as recommended.
