Action Requested
A Council motion to approve a temporary sales and storage fireworks license to Karen Herrman,
Hometown Fireworks, to sell fireworks from June 25, 2009 through July 5, 2009 from a tent on Lot 2,
Block 1, Elk River Crossing (the grass lot south of the Anytime Fitness parking lot) with the following
condition:
^ The area on and around the location of the sales tent shall be mowed. A buffer area
around the tent of 25-feet shall also be mowed.
Background/Discussion
The applicant has submitted all the necessary application materials required for this license. A background
check was completed by the police department and the fire chief has reviewed the site plan.
The applicant also needs a general planning permit from the planning department in order to conduct his
sales.

Planning Permit for Tent Sales, Case No. GP 09-05 Reviewed by

Approval of the general planning permit request for temporary fireworks sales in a 1,200 square foot tent
on a grass area of 18130 Zane Street as indicated on the site plan, with the conditions outlined in this
report: .
1. No electrical services shall be across any drive or walking surface.
2. All applicable fire codes shall be met.
3. If traffic becomes a problem around the temporary site as determined by the Police
Chief or his designee, the sales area shall be delineated with a barrier to restrict traffic.
4. The sales tent be maintained free of debris and kept in an orderly condition.
5. The location of the tent is consistent with the submitted site plan.
6. The tent area shall be removed by July 9, 2009, and the site returned to its previous
condition.
7. The area inside and within 25 feet of the tent shall be mowed per Fire Chief s
requirements.
8. One 24 square foot banner, advertising the fireworks, shall be allowed.
9. No other signage shall be allowed on site or on the tent.
Background/Discussion
Karen Herrman, on behalf of Hometown Fireworks, is seeking approval to operate the facility June 20 to
July 5, 2009; however, the tent may be set up a couple days prior to the sales starting. The tent would be
located on a grassy area. It appears that in this location the tent will not disrupt traffic flow nor will it
create any parking problems. The Fire Chief, in his review, is requiring the grass in and within 25 feet of
the tent to be mowed. Parking is available to the north; no parking will be available at any time on Zane
Street to the east.
