SUBJECT: Fred McCoy Variance, Case No. V 09-01
This memo is provided as an update to a recent City Council decision. No action is
necessary.
The City Council, on February 17, 2009, approved the variance for the proposed expansion
of Fred McCoy's storage and deck area. The variance allowed encroachment into the
required bluff setback line and an increase of impervious surface.
Copies of the Findings of Fact, staff report, and City Council minutes from the meeting
were sent to the DNR on February 24 for their review.
On March 25, Dale Homuth, Regional Hydrologist for the DNR, responded denying the
application. On Apri19, 2009 staff met with Mr. Homuth. After a site inspection, he
advised Mr. McCoy to contact him regarding his option to appeal. Any appeal needs to be
placed before Apri124. On April 15, staff met with Mr. McCoy explaining options and
offering assistance.
