PAUL WASECA At the public hearing held on August 5th, 1996, the City Council elected not to proceed with municipal improvements and permanent street reconstruction in the Riverview Heights area. The direction that the Council gave to staff was to review the streets and return with a recommendation relative to an overlay project to be completed in 1996. Following that direction, Phil Hals and I have reviewed the entire Riverview Heights area, including the Grandview Additions and Palmer's Addition. It would be our recommendation that an overlay project be accomplished on all of the streets, with the exception of Macon Street and the portion of Riverview Drive adjacent to the Country Crossing 3rd Addition. It is our belief that an overlay of these two streets will have a useful life much longer than the Developer of Country Crossing 3rd will be willing to wait before sewer and water to serve his project. Phil believes that, with some maintenance effort, he will be able to keep these streets in satisfactory condition until such time that the development of Country Crossing 3rd Addition would require sewer and water and street reconstruction of these streets. I have contacted the Developer of Country Crossing 3rd Addition, Mr. Tony Emmerich, and he confirmed that he would like the improvements as soon as possible. Since the August 5th City Council meeting, we have worked on a time line and a cost estimate for the overlay project. Based on the cost estimate, we believe that the area can support an overlay project at the same assessment rate as last year. As you recall, that was $1,300 per unit. In working through the time line necessary to accomplish the required hearings and still allow sufficient time to get the project bid, we have prepared four resolutions for the Council's consideration. They are as follows: The first resolution orders the feasibility study. The second resolution receives the feasibility study and orders the public hearing for September 9th at 6:30 p.m. We have started work on the feasibility study and believe that it will be available on Monday, August 19th. The third resolution orders the preparation of plans and specifications and directs us to solicit competitive bids upon completion of the plans and specifications. The fourth determines the assessed cost and orders the preparation of the assessment roll. We would then send out assessment notices, also calling for an assessment hearing on September 9th at 6:30 p.m. An Equal Opportunity Employer Honorable Mayor and City Council August 9, 1996 Page Two Our time line indicates that bids could be opened on September 4th and they would be available for the public hearing and assessment hearing on September 9th. If bids come in better than expected, the assessment rate could be lowered at the assessment hearing for each of the properties. At the September 9th public hearing and assessment hearing, the Council would then consider resolutions ordering the project, awarding the contract, and adopting the assessment roll. As the City Council is aware, this is a City initiated project; therefore, it will require a 4/5 City Council vote. If you have any questions regarding this project, I will be in attendance at your August 19, 1996, City Council meeting. Sincerely, MSA, CONSULTING ENGINEERS TJM:tw Attachments 338-0906.aug RESOLUTION 96- A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION OF THE CITY OF ELK RIVER ORDERING A PRELIMINARY FEASIBILITY REPORT IN THE MATTER OF THE RIVERVIEW HEIGHTS AREA OVERLAY IMPROVEMENT OF 1996 WHEREAS the City has determined that it should consider improving certain property by overlayment of the streets within the Riverview Heights 1, 2nd, and 3rd Additions, Grandview 1st and 2nd Additions, and Palmer's Addition, except Macon Street from County Road 30 to Riverview Drive and Riverview Drive from Macon Street to Joplin Street (the improvement); and Council must first secure a preliminary feasibility study in order to consider making the improvement; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: This matter shall be referred to MSA, Consulting Engineers, who is requested to provide to the City Council a report advising, in a preliminary way, whether the proposed improvement is feasible and whether the improvement should thus be made as proposed or in connection with some other improvement and the estimated cost of the improvement as recommended. Thackeray, City Clerk 338-0906.aug RESOLUTION 96- A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION RECEIVING THE FEASIBILITY REPORT AND ORDERING A PUBLIC HEARING ON THE IMPROVEMENT IN THE MATTER OF THE RIVERVIEW HEIGHTS AREA OVERLAY IMPROVEMENT OF 1996 the Feasibility Report ordered by the Council in Resolution 96- has been prepared with reference to the Riverview Heights Area Overlay improvement; and the Feasibility Report provides information regarding whether the proposed project is necessary, cost-effective, and feasible; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: The City Council will consider the Riverview Heights Area Overlay improvement as described in the Feasibility Report and the assessment of the property abutting this proposed improvement for all or a portion of the cost of the improvement pursuant to Minnesota Statutes, Section 429 at an estimated total cost for the improvement of $161,200. A public hearing shall be held before the City Council on the proposed improvement on the 9th day of September, 1996, at 6:30 o'clock p.m. at Elk River City Hall Council Chambers. o The City Administrator shall provide ten days mailed notice and two weeks published notice on the hearing as required by law. Thackeray, City Clerk 338-0906. aug RESOLUTION 96- A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION ORDERING THE PREPARATION OF PLANS AND SPECIFICATIONS IN THE MATTER OF THE RIVERVIEW HEIGHTS AREA OVERLAY IMPROVEMENT OF 1996 WHEREAS it is the City's desire to consider an overlay improvement project in the Riverview Heights area to be accomplished in 1996; and WHEREAS the City Council has authorized the preparation of a feasibility report considering the overlay improvement in the Riverview Heights area; and WHEREAS the City Council will duly consider the feasibility report and those matters presented at a public hearing to be held at a later date; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: MSA, Consulting Engineers is hereby designated as Project Engineer for this improvement. The Project Engineer is directed to prepare plans and specifications for the making of the improvement and the solicitation of competitive bids. Thackeray, City Clerk 230/338-0911 .aug RESOLUTION 96- A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION DETERMINING ASSESSED COST OF IMPROVEMENT AND ORDERING PREPARATION OF PROPOSED ASSESSMENT ROLL IN THE MATTER OF RIVERVIEW HEIGHTS AREA OVERLAY IMPROVEMENT OF 1996 WHEREAS costs have been determined for the Riverview Heights Area Overlay improvement consisting of a contract price of $126,000 and expenses incurred or to be incurred by the City in the making of the improvement in the amount of $35,200 for a total cost of the improvement of $161,200. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Elk River, Minnesota: Based upon the City Assessment Policies, it is determined that the portion of this improvement to be paid by the City and not assessed to benefitted properties is $ - 0 -. The portion of the cost to be assessed against benefitted properties pursuant to the Elk River City Assessment Policies shall be $161,200. The assessments shall be payable in equal annual installments and shall extend over a period of five years, the first of the installments to be payable on or before the first Monday in January, 1997, with interest at the rate of 8 % per annum from the date of the adoption of the assessment resolution. o The City Administrator with the assistance of the Project Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece, or parcel of land, without regard to cash valuation, as provided by law, and shall have available to the City Administrator's office a copy of the proposed assessment roll for public inspection. Upon completion of the proposed assessment roll, the City Administrator shall notify the Council and schedule a public hearing upon the proposed assessment, causing notice of the hearing by publication and mail to be made at least two weeks prior to the hearing. PAUL WASECA This feasibility study was authorized by the City Council on August 5, 1996. Also on this date, a public heating was held with the Riverview Heights Area property owners to discuss an improvement project consisting of municipal utilities and permanent urban style streets with storm sewer. At the close of this hearing, the City Council decided not to proceed with the public utilities and permanent streets, but instead to consider an overlay improvement for the area. The location of Riverview Heights Area is shown in Exhibit 1. The Riverview Heights Area consists of Riverview Heights 1st, 2nd, and 3rd Additions, Grandview 1 and 2nd Additions, and Palmer's Addition. All of the streets in this area are to be overlaid with the exception of Macon Street between County Road 30 and Riverview Drive, and Riverview Drive between Macon Street and Joplin Street. These two roadways abut the recently approved Country Crossing 3rd Addition and it is anticipated the Developer will be looking for public improvements to service the lots which front these streets long before an overlay would have served its useful life. The streets to be overlaid are shown in Exhibit 2. The proposed improvement will consist of an average of a 2-inch overlay on all of the streets. The overlay typical street section is shown on Exhibit 3. Prior to the overlay, it will be necessary to repair areas that are badly deteriorated. In addition, the improvements would consist of milling and/or removal of a small portion of each driveway to ensure they can be made to match properly with the newly overlaid street. Taking into account the estimated cost of the proposed overlay and all preparatory work needed plus the typical overhead for this type of project, it is estimated that the total project cost would be $161,200. The number of units available to be assessed for the improvements is estimated at 124; therefore, the estimated assessment on a per lot basis would be $1,300. This is the same amount that properties involved in the 1995 overlay project were assesed. Lots to be assessed are shown in Exhibit 4. If an overlay is not done in a timely fashion, it will get to the point that deterioration will continue such that an overlay will not be a feasible alternative. Therefore, the improvements are deemed to be necessary. The area in question is large enough to be cost-effective as one project. From an engineering standpoint, the improvements are feasible. By authorizing preparation of plans and specs, preparation of the assessment role, holding the public hearing, and holding the assessment hearing at the same Council meeting, it will by possible to get the project bid and under construction in the late summer of 1996.
