MEMORANDUM City Council Scott Harlicker, Planning Assista~ August 19, 1996 Request by Roger Johnson for Administrative Subdivision, Public Hearing Case No. AS 96-4 Request Roger Johnson is requesting an administrative subdivision to subdivide 9.2 acres into a 3.6 acre lot and a 5.6 acre lot. Location The property is located at 16110 Jarvis Street NW, Elk River, Mn. PID # 75-013- 1405, Southeast 1/4 of the Northeast 1/4 Section 13, Twp. 32, Range 26 Zoning/Land Use I2 (Medium Industrial) / MI (Medium Industrial) Attachments · Location map · Zoning map · Survey of subdivision Background The property is zoned I2 and the surrounding properties are also zoned I2. The adjacent property to the south has a house and a metal pole barn; the property to the north is a residence; the property to the west is vacant and to the east is Jarvis Street with residences on the east side of Jarvis. The property currently has an existing single family house, a detached garage and two other outbuildings. To the rear of the buildings associated with the residence, there is an industrial building and outdoor storage area that is 13065 Orono Parkway · P.O. On May 20, 1996, Kober Excavating was granted a conditional use permit for outdoor storage at this site. Natural Features The residence, shop and outdoor storage area are located at the south end of the property. The north half contains a wetland, pond and small cornfield and is also lower than the south half with a three or four foot drop in elevation. There is a significant row of mature pine trees along the rear or west property line and some mature deciduous trees in the area around the house. The wetland area will need to be delineated on the subdivision survey and encumbered with a drainage and utility easement. Lot Size This proposed subdivision will split the property in such a way that the industrial building and the outdoor storage area will be on one lot and the residence will be on the other. The 3.6 acre lot (Parcel A) will contain the residence and the 5.6 acre lot (Parcel B) will contain the shop and the outdoor storage area. Parcel A will have 630 feet of frontage and parcel B will have 100 feet of frontage. The proposed lots comply with the dimensional requirements for the I2 zone. However, the 25 foot setback requirement between the shop and the proposed east property line of parcel B is not met. The survey shows 23.67 feet between the shop and the property line. The proposed property line should be shifted so that the setback requirement is met. Access Both parcels with be accessed from an existing driveway. This driveway will be paved and there will be a 24 foot wide private driveway easement over the existing driveway. These were included as conditions of approval for the conditional use permit for the outdoor storage area. A cross access agreement, incorporating the applicable conditions of the CUP for the outdoor storage, should be prepared and implemented so that both lots will be able to utilize the driveway. Right of Way There is currently 33 foot half right of way along Jarvis Street. The draft Transportation Plan has identified Jarvis Street as a minor arterial and as such it is recommended that the half right of way be expanded to 40 feet. Therefore, an additional seven feet will need to be granted to the City by way of an easement document. s :\planning\scott\as96 -4.doc Park and Recreation The Park and Recreation Commission recommended a cash dedication for the one new lot that is being created. The cash dedication for the new 3.6 acre lot would be $6300. Recommendation It is recommended that the City Council approve the request by Roger Johnson for an administrative subdivision to subdivide 9.2 acres into two lots with the following conditions: 1. A grant of easement be prepared and executed granting an additional 7 feet of right of way along the west side of Jarvis Street. 2. Payment of park dedication fee in the amount of $ 6300 for the new lot being created to be paid prior to recording the administrative subdivision. 3. Payment of surface water management fee in the amount of $ 2669.76 for the new lot being created to be paid prior to recording the administrative subdivision. 4. Any wetlands be delineated on the survey and drainage and utility easements be in place over those wetlands. 5. A minimum 24 foot wide driveway easement be in place over the existing driveway. 6. Proper cross access agreements for the existing driveway be prepared and executed prior to recording the administrative subdivision. 7. Ten foot wide utility easements be granted along each property line. 8. The east property line of parcel B be shifted to the east so that there is a 25 foot setback between the metal building and the east property line. 9.
