SUBJECT: Building Materials for the Furniture
World Building on Jarvis and Hwy. 10
Overview
As the City Council is aware, Larry Hickman is in the process of constructing
a 90,000 sq. ft. commercial building at the northwest corner of Jarvis and
Highway 10. This building is being constructed in a C3 (Highway
Commercial) zoning district and therefore, is subject to the commercial
standards. The Planning Commission and the City Council had an
opportunity to review the proposed plat for the furniture store; however,
since the business is considered a permitted use in the C3 district, the
development plans were reviewed at an administrative level prior to issuance
of a building permit.
One of the items required for site plan review is a drawing detailiug the
building elevations and outling the type of material to be used on the
building. When the contractor (John Weicht) initially submitted the plans
for review, it was indicated that stucco would be used on two sides of the
building; however, the plans did not have any notation to the type of material
used on the other two sides. During review of the plans, the question came up
as to the type of material that would used on the two sides of the building
that were not labeled on the plan sheet. As it turns out, these two sides of
the building will be constructed with what the contractor is labeling
"architectural metal siding". The metal siding proposed for the Furniture
World building is very similar to the Alltool building in the Elk River
Industrial Park.
Ordinance Requirements
Currently, the City Ordinance allows architectural metal siding to be used as
the primary building material on buildings in both the industrial and
commercial zoning districts. To complement the approved materials listed in
the ordinance (see attached excerpt of the Zoning Ordinance) other materials
such as a non-architectural metal panel can be used on buildings to make up

25% of the wall area in commercial districts and 75% of the wall area in
industrial districts. The ~if~qcult issue staff is struggling with is
determining, "what is architectural metal paneling?" If the metal paneling
used on the Furniture World building is an acceptable architectural metal
siding, then that product could be used on all four sides of a commercial
building in any of the City's commercial zoning districts. I am not sure
whether it is the Council's intent to have this type of metal used for
commercial buildings throughout the City including the Highway 169 and
Highway 10 corridors.
Action Requested
I raise this issue with the City Council because I'm afraid the interpretation
of '"'architectural metal siding" is being used a httle loosely. Therefore, ff the
Council is asked to either direct staff to review the performance standard of
the Zoning Ordinance to determine appropriate materials to be used on
buildings in commercial and industrial zones, and to clarify the definition of
architectural metal panels; or, continue with the current ordinance and
accept the architectural metal panels being used today as an acceptable
material in the City's commercial districts.

Exterior Buildinq Finish
i. Standards for the R-3, R-4, C-l, C-2 and PUD
zones. One hundred percent (100%) of the exterior
building finish shall consist of materials comparable
in grade and quality to the materials on the list of
exterior building finishes referenced in this section.
ii. Standards for the C-3 zoninq. A minimum of
seventy-five (75%) of the exterior building finish
shall consist of materials comparable in grade and
quality to the materials on the list of exterior
building finishes referenced in this section.
iii. Standards for the I-1 and I-2 zones. A minimum of
twenty-five percent (25%) of the exterior building
finish shall consist of materials comparable in grade
and quality to the materials on the list of exterior
building finishes referenced in this section.

On Thursday, August 15, 1996, we opened bids for the street improvements on 171st
Avenue and Ulysses Street. There were a total of six bidders. The table below provides
a listing of the bidders and their total bid:

Prior to starting the project, two items remain to be accomplished. The fin-st is to receive
MnDOT approval of the plans. We anticipate that will happen sometime this week. The
second item is to reach agreement with the four property owners, Charlie and Greg
Houle, Tim Snyder. and Roger Eull, from whom we need easements. We have met with
all of these parties and anticipate that very quickly we will reach agreement on the cost
of easement acquisition. The tim_al party from whom we need easements is the LeFebvres.
Their easements will be provided through the final platting of their property.
W. B. Miller, Inc.. has successfully completed similar sized projects; therefore, we are
prepared to recommend award to them as the lowest responsible bidder. Anticipating
MnDOT approval and successful completion of the easement negotiations, we would
recommend to the City Council that they award the project to W. B. Miller, Inc.,
contingent on those two items. This will allow the paperwork to be done concurrently
with MnDOT approval and completing easement negotiations. We would anticipate that
construction should be ready to begin shortly after Labor Day.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ACCEPTING BID AND AUTHORIZING
EXECUTION OF CONTRACT IN THE MATTER OF THE
171ST AVENUE/ULYSSES STREET IMPROVEMENT OF 1996
WHEREAS
WHEREAS
pursuant to Resolution 96-_, competitive bids were solicited and received for the
171st Avenue/Ulysses Street improvement as set forth in the bid tabulation attached
hereto and incorporated herein by this reference; and
the City Council has considered the amount of the bids and the responsibility of the
bidders and determined that W. B. Miller, Inc., is the lowest responsible bidder;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
The Mayor and City Administrator are authorized and directed to execute, on behalf of the
City, such contract with W. B. Miller, Inc., as is approved by the City Attorney for the
completion of the 171st Avenue/Ulysses Street improvement according to the approved
plans and specifications designated in Resolution 96- , contingent on MnDOT Office of
State Aid approval of the plans and successful completion of the easement negotiations.
The City Administrator is authorized and directed to forthwith return to all bidders the
deposits made with their bids upon execution of the contract above specified.

Terrace Mobile Home Court, pursuant to Minn. Stat. § 327C.095 et. seq. This
correspondence and the enclosed notices comply with Minn. Stat. 327C.095 with respect to
notification to the local planning agency.

of each mobile home. If a public hearing is necessary under Minn. Stat. § 327C.095, subd.

Dear Ms. Cody:
The purpose of this letter is to comply with the provisions of Minnesota Statute §
327C.095, Subd. 1. The undersigned, owners of the Elk River Terrace Mobile Home
Court have sold the mobile home park and the Park will be closed. The Park will close
following compliance with all terms and conditions of Minnesota Statutes § 327C.095, and
all residents have vacated the Park. This notice must be sent to you at least nine months
prior to closure. A copy of this notice will also be submitted to the City of Elk River.
The Park will be converted to a mixed commercial use, following the vacation of all the
residents. The entire Park will be converted and there will be no lots available and none
of the Park will be operational.

Associated Developers of the Twin Cities, Inc. ("Purchaser") for the sale of the Park you
occupy. The Purchaser has notified us that it intends to close the Park and convert it to
a mixed commercial use development, once the Park is vacated pursuant to Minnesota
Statutes § 327C.095. Along with this notice you will also received a Closure Statement,
pursuant to Minnesota Statute § 327C.095, Subd. I regarding your vacation from the
Park.
Minnesota Statute § 327C.095, Subd. 6 requires us to give you a four-five (45) day written
notice of the intent to close the Park and convert to another use.
PLEASE CONSIDER THIS LETTER TO BE THE FORTY-FIVE (45) DAY NOTICE OF
THE INTENT TO CLOSE THE PARK AND CONVERT IT TO ANOTHER USE.
