Issue
John Weicht and Associates is requesting to vacate drainage and utility
easements within R.R. Industrial Park.

Analysis
John Weicht and Associates is working with Mr. Hickman in the
development of Furniture World at the northwest corner of Jarvis and
Highway 10. Prior to this property being developed, it went through the
process of being replatted to accommodate a lot size that would facilitate the
development of a 90,000 sq. ft. commercial building. The plat basically
involved replatting some of R.R. Industrial Park property which had
previously been platted. Those lots that were previously platted contained
drainage and utility easements that are typically requested. Given the
replatting of this area and dedicating the new easements to accommodate
Mr. Hickman's development the previously platted easements are no longer
necessary.
Recommendation
It is recommended that the City Council approve Resolution No. 96-__,
vacating the drainage and utility easements along the lot lines of Lots 1, 2
and 3, Block 1, R.R. Industrial Park and as further described in the attached
exhibits.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE AND UTILITY
EASEMENTS
Case No. EV 96-2
WHEREAS,
the property owner abutting the street, drainage, and utility
easement has requested the City Council in a petition dated August
5, 1996, to vacate such easement according to law; and,
WHEREAS,
a public hearing was held on August 26, 1996, before the City
Council at the Elk River City Hall on such petition after due
published and posted notice had been given as well as personal
notice to affected property owners on August 7, 1996, and all
persons interested were given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve
such petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the drainage, and utility easement described as follows is hereby
vacated:
