Ach, City Planner.~~ August 9, 1996 Rezoning of Area Between County Road 12 and County Road 13 At the last Council meeting the issue was raised regarding the zoning of Industrial Hard/acing and George Deschenes' property. The current zoning of both these properties is Rlc (Single Family Residential) with an underlying land use of LI (Light Industrial). The land use designation of light industrial was established as part of the comprehensive plan update in response to the need to identify future industrial opportunities. However, when the rezoning was presented to the City Council on March 18, 1996, to rezone Industrial Hardfacing, George Deschenes' as well as a portion of Waddy Schultz's and other properties in the northeast corner of County Road 13 and County Road 12, the rezoning as it was presented to the City Council was denied. There was some discussion by the Council regarding specifically Industrial Hard/acing and George Deschenes' property that there should be some consideration given to rezoning these two properties to light industrial. It was staffs understanding that the application that was presented to the City Council was denied in its entirety; however, if the Council would like to initiate a rezoning request for George Deschenes and Industrial Hard/acing, staff would be prepared to present this to the Planning Commission at the October meeting and forward this rezoning to the Council on November 18th. It was also discussed at the Council meeting on March 18 how the possible realignment of County Road 12 and 13 could better define a possible industrial area and use the roadway and wetlands to separate the industrial land use from residential further to the east. Staff is continuing to work with the County on these road alignments and once those are established, be in a better position to present some industrial land use options to the Council for consideration. However, ff the Council would like to proceed forward with the rezoning of Industrial Hard/acing and George Deschenes' property at this time, that application could be initiated by the City Council. 13065 Orono Parkway · P.O. Rezoninq Recluest by the City of Elk River, Public Hearinq Case No. ZC 96-6 Assistant Planner Scott Hariicker indicated that the City of Elk River is initiating a rezoning from R1~ (Single Family Residential to I1 (Light Industrial. The area under consideration is bounded by Sherburne Co. Road 13 on the north and west, Sherburne Co. Road 12 on the south and Tyler Street alignment on the east. Scott Harlicker presented the staff report on this issue. He indicated that the Planning Commission recommended approval of the request. Mayor Duitsman opened the public hearing. Mark Parranto of Delta Development indicating that he is representing a majority of the property owners that are affected by this request. He indicated that the Schultz's, Mulvaneys, Austs, and Christians are opposed to the request for zone change. Mayor Duitsman informed the residents of the transportation concerns in the area. Mike Mulvaney indicated his concerns regarding the increase in property taxes due to the industrial zoning. He indicated the tax base would triple and indicated that he is opposed to the zone change. /¥~ayor Duitsman closed the public hearing. Mayor Duitsman indicated he supported not rezoning the property at this time. Councitmember Holmgren concurred with the Mayor. Councilmember Diet7_ indicated his concern regarding the need for more industrial land in the eastern area of the city. Councilmember Scheel indicated that the City should consider rezoning industrial Hardfacing property and George Deschene's property as light industrial but to leave the remainder as R lc. Councilmember Farber indicated he ]i~,ared Councilmember Dietz's concern, however indicated that there are too :~any problems with the property and the rezoning would create a hardship for the residential property owners. Request by City of Elk River for Rezoninq, Public HearJnq Case ~ZC 96-7 Assistant Pfanner Scott Hariicker indicated that the City of Elk River is initiating a rezoning from ~:tA (Single Family Residential) to R le (Single Family Residential) The property is bounded by 177th Avenue alignment on the north, 173rd Avenue on the south, Burlington Northern Railroad tracks on the west and Tyler Street alignment on the east.
