Action Requested
Approval of a transient merchant license to Allen Pantelis to sell wood carvings, windsocks, kites, and
ground spinners from the parking lot of Wash-n-Fill on weekends from June 12 through September 27
with the following conditions:
1. One 24 square foot sign shall be allowed.
2. The merchandise displayed shall not occupy more than 100 square feet [Section 38-414(6)].
3. Applicant must remain on the asphalt surface and no product can be displayed in the grassy areas.
4. The license shall expire on September 28, 2009, and sales shall not exceed 30 days within this
period.
5. No electrical service shall be across any drive or walling surface.
6. If traffic becomes a problem around the temporary site, the sales area shall be delineated with a
barrier to restrict traffic.
7. The area shall be maintained free of debris and kept in an orderly condition.
8. No overnight storage of equipment or merchandise.
Background/Discussion
Allen Pantelis has applied fox a transient merchant license to sell wood carvings, windsocks, kites, and
ground spinners from the Wash-n-Fill parking lot on weekends from June 12 through September 27.
Based on the information Mr. Pantelis has provided, no permits are required from the planning
department.
Elk River City Code states `~Vo transient merchant license shall be issued for more than 365 days, during which sales
shall be limited to 30 days, unless a longer period of time is approved by City Council. " `A license is for the calendaryear or
part thereof for which it has been issued. "
Mr. Pantelis has submitted all application materials and successfully passed a police background check.
The applicant stated he will not need any signage.
