Dear Council Members:
We have tabulated the bids that were received on Thursday, August 22nd, for the above-
referenced project. There were a total of nine bidders. The following list provides the
bidder and total bid.

As you are aware, there was no feasibility done for this project, since it is funded with
state and local money and the portion to be assessed was petitioned for, waiving their
rights to appeal the assessment. The low bid submitted by Bauerly Brothers, Inc., is
slightly below the Engineer's estimate for the project. Bauerly Brothers, Inc., has
previously completed similar type projects; therefore, we are prepared to recommend
award to them as the lowest responsible bidder.
One of the conditions in the Cooperative Agreement between MnDOT and the City of Elk
River is that MnDOT must concur in writing to the award of the contract to the low
bidder. We have submitted the necessary paperwork and asked for their concurrence.

As of the date of this memo, we have not received written concurrence. Therefore, the
award of this project should be conditioned upon that concurrence. Attached is a draft
resolution for the City Council's consideration which would award the project to Bauerly
Brothers, Inc., contingent upon MnDOT approval.
If you have any questions regarding this, I will be in attendance at Monday evening's City
Council meeting.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ACCEPTING BID AND AUTHORIZING
EXECUTION OF CONTRACT IN THE MATTER OF THE
JOPLIN STREET/TH 10 INTERSECTION AND NORTH FRONTAGE ROAD
IMPROVEMENT OF 1996
WHEREAS
WHEREAS
pursuant to Resolution 96-54, competitive bids were solicited and received for the
Joplin Street/TH 10 Intersection and North Frontage Road improvement as set
forth in the bid tabulation attached hereto and incorporated herein by this
reference; and
the City Council has considered the amount of the bids and the responsibility of the
bidders and determined that Bauerly Brothers, Inc., is the lowest responsible
bidder;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
The Mayor and City Administrator are authorized and directed to execute, on behalf of the
City, such contract with Bauerly Brothers, Inc., as is approved by the City Attorney for
the completion of the Joplin Street/TH 10 Intersection and North Frontage Road
improvement according to the approved plans and specifications designated in Resolution
96-54.
This award is contingent on the City receiving written concurrence to the award from
MnDOT.

The City Administrator is authorized and directed to forthwith return to all bidders the
deposits made with their bids upon execution of the contract above specified.
