MEMORANDUM Mayor and City Council Scott I-Iarlieker, Planning Assistan September 16, 1996 Administrative Subdivision Request by Brent and Janet Cotton, Public Hearing Case No. AS 96-7 Request Brent and Janet Cotton are requesting an administrative subdivision to subdivide 9.98 acres into a 2.62 acre parcel (parcel 1) and a 7.36 acre parcel (parcel 2). Location The property is located east of Tyler Street and north of Twin Lakes Road, PID# 75-126-4204, northwest 1/4 of the southeast 1/4, Section 26, Township 33, Range 26 Zoning/Land Use Rla (Single Family Residential) / LR (Low Density Residential) Attachments · Location map · Zoning map · Survey of subdivision Overview The Cottons are proposing to subdivide their property into 2 single family lots. The property currently has a single family house, detached garage, a storage shed and a horse barn. The residence and accessory structures are located on the south side of the parcel about 150 feet back from Tyler Street. 13065 Orono Parkway · P.O. The survey shows that both parcels will comply with the minimum lot size requirements even though the area included in the right-of- way for Tyler Street has not been included in the lot size calculations. However, since the existing buildings are not shown on the survey, it is not possible to determine if the setback requirements are met. The apphcant should show on the survey the location of the existing structures. Right-of way and Easements The survey shows a 33 foot half right-of-way for Tyler Street. In order to accommodate future improvements to the street, a 40 foot half right-of-way is necessary. This will require an additional 7 feet of right-of-way be granted to the city shghtly reducing the size of parcel 1, but the required 2 1/2 acres can be adjusted for by revising the proposed property hnes. Drainage and utility easements are required on the property lines and along the right-of-way for Tyler Street. The survey will have to be revised to show easements along all existing and proposed property lines as well as along the right-of-way for Tyler Street. It also appears that there is a NSP transmission line located near the northeast corner of the property. If the easement associated with this transmission line is on the Cotton's property, it should be shown on the survey. Park and Recreation Commission Recommendation The Park and Recreation Commission has recommended a cash dedication in heu of land to satisfy the park dedication requirements for the one new lot that is being created. Recommendation It is recommended that the City Council approve the request by Brent and Janet Cotton for an administrative subdivision to subdivide 9.98 acres into two residential lots with the following conditions: A grant of easement be prepared and executed granting an additional 7 feet of right-of-way along Tyler Street. The additional 7 feet shall apply to both parcels included in the subdivision o Payment of park dedication fee in the amount of $550 for the new lot being created to be paid prior to recording the administrative subdivision. s:\plannin g\scott\as96-7.doc o Payment of surface water management fee in the amount of $61.80 for the new lot being created to be paid prior to recording the administrative subdivision. The existing structures and setbacks be shown on the survey of the subdivision.
