Action Requested
Staff recommends that the City Council postpone the Administrative Subdivisions request, as illustrated
on drawings dated 6/29/09, for the following reasons:
1. To allow the Parks and Recreation Commission to review the plat for appropriate Park
dedication vehicle.
2. To allow staff to further evaluate the transportation possibilities.

Summary
The applicant is requesting and Administrative Subdivision by Simple Plat for Baldurin Family Farm
Addition.
An Elk River Citizens Sign Committee is leading an effort to construct a "Welcome to Elk River" sign
along Highway 10 near the eastern city limits. The sign will be similar to the west entrance sign by Lake
Orono. In October 2008 the City Council approved an ordinance amendment that allowed city entrance
monument signs on city or private property.
The property owner, Baldwin, is selling a portion of his property to the Elk River Citizens Sign
Committee. The .05 acres represents the portion he is selling. Lot 1, Block 1 would be retained by the
property owner.
Analysis
The property is zoned Commercial Reserve Transition (CRT) which has a minimum lot size of 20 acres.
The proposed plat will subdivide the property into two lots. Lot 1 will be 50.39 acres and Lot 2 will be
0.05 acres. Lot 2 Block 1 will be utilized fora "Welcome to Elk River" sign.
A variance was approved for Lot 2 which does not meet the 20 acre requirement of the CRT zoning.
Through the analysis, two major issues have been identified, Transportation and Park Dedication:

Transportation
The anticipated extension of Twin Lakes Road, linking the east side of Elk River (as part of the pending
FAST study) to limited intersections with Highway 10/ 169 will pass through this parcel. However,
regional planning has not been completed to identify the most appropriate route though this property.
Park Dedication
The ordinance requires park dedication be provided fox any land that is platted. Park dedication is
collected at the time of final platting. The dedication would be in the form of cash or land, based on the
recommendation of the Parks and Recreation Commission. The Parks and Recreation Commission is
scheduled to review the application at their meeting on August 12, 2009.
Based on the Ordinance and the Council adopted fee schedule, the park dedication (in cash) for the
subject parcels, as platted, would be as follows:
Lot 1, Block 1 50.39 acres x $7,298/ acre = $367,746.22
Lot 2, Block 1 .05 acres x $7,298/ acre = $364.90
Again, the Parks and Recreation Commission have not provided a recommendation as to whether cash or
land is the appropriate dedication. These fees would be due before release of the final plat for recording.
As an alternative, staff has identified two alternate options that give the Elk River Citizens Sign
Committee necessary rights to construct the sign:
Plat Lot 1 as an Outlot. This makes it non-buildable and when platted in the future, park dedication
is due at that time.
Another option includes acquiring a permanent sign easement across the area of property needed fox
the sign. This does not require platting nor park dedication.
