SUBJECT: Environmental Updates
RESIDENTIAL GARBAGE CONTRACTS
The City of Elk River contracts with Corrow Sanitation, Peterson
Brothers/Woodlake/BFI, and East Tonka Sanitation to provide residential
garbage and recycling service to all Elk River residents. The existing
contracts expire on October 31, 1996, and staff is working to get new
contracts signed before November 1, 1996.
After much research and discussion, staff believes that the city has two
options:
1. Continue with the existing contract and negotiate new payment terms, or
2. Contract with Sherburne County for a lower tip fee at the RDF plant, then
negotiate contracts with the haulers for the city to pay the tip fee at the
RDF plant. We would pay the haulers to collect the garbage and collect
and recycle the recyclables.
Staff believes option #2 is the best option for the City of Elk River for several
reasons:
1. It simplifies the transfer of the city contract from East Tonka Sanitation
to Randy's Sanitation.
2. It simplifies potential future contract transfers, by eliminating the need
for haulers to negotiate with Sherburne County for a contract.
3. It ensures that our garbage goes to the RDF plant.
4. It ensures equality between the three districts
5. It allows the City to react more quickly to changes in the garbage market
and pass the savings onto the residents.
As the Council is aware, Sherburne County has imposed a $20.00 annual
solid waste assessment to fund a tip fee subsidy at the RDF plant. Staff

believes that the new hauler contracts will reflect a rate decrease which wil!
offset this assessment.
Staff will seek County approval of a contract with the City of Elk River for a
lower tip fee. The proposed contract is tentatively scheduled for the October
15, 1996, County Board meeting.
Staff will proceed with contract negotiations with the haulers, and would like
to have a contract ready for Council approval at the October 28, 1996, City
Council meeting. If we stay on schedule, we can have the new rates reflected
in the November billing statement.
Council Action Requested
Council should direct staff to proceed with contract negotiations with
Sherburne County and with Elk River's three existing residential haulers.
CODE ENFORCEMENT UPDATE
Staff has had 55 complaint cases in 1996. We also have 7 complaint cases
carried over from 1995.
1995
The 1995 cases are some of the more difficult issues in the city. They are
move intense issues that will take longer to resolve. There are a couple of
these cases that staff hopes to have resolved in 1996.
One of the cases will be addressed by the Council at the October 21, 1996,
meeting. Jim Charest (Case #95-31) will be requesting a zone change, land
use plan amendment and conditional use permit to operate a junkyard on his
property. If the Council approves a junkyard for this site, the complaint case
will be resolved.
Staff is working closely with the property owner on Case #95-67. This is an
issue where the conditional use permit requirements have not been met, but
staff believes this issue will be resolved this year.
1996
In 1996, the City received 55 code complaints. Most of the 1996 cases are
progressing as anticipated, as most residents have been willing to work with
staff to correct the problem issues.

Of those 55 cases:
· 44 have been resolved
· 11 are on-going
Two of those eleven cases on-going cases are long term issues that are
unlikely to be resolved in the near future. One example is Case #96-40 which
is a home with tall grass and weeds. It does not look like the lawn has been
mowed all summer. Staff has not been able to contact the property owner as
the certified letters have not been accepted by the owner. Another example is
Case #96-42 which is a home with three junk vehicles, three detached
accessory buildings and miscellaneous debris. The property owners have
been very slow to comply with the ordinance, but staff is working closely with
the owners to work out a reasonable arrangement.
SHERBURNE COUNTY HOUSEHOLD HAZARDOUS WASTE
COLLECTION EVENT
On Saturday, September 21, 1996, Sherburne County hosted a household
hazardous waste clean up event. Elk River residents have not had a local
hazardous waste disposal event offered for several years. Although Elk River
residents can always use the Tri-County Household Hazardous Waste drop-
off facility in St. Cloud, many residents are reluctant to drive that far to
dispose of hazardous materials.
The event served 110 Sherburne County residents on that rainy Saturday.
Sherburne County staff estimates that about 80% of the participants were
Elk River residents. The City of Elk River provided three employees to work
at the event, and we believe the event was very successful given the weather
conditions that day.
