Staff recommends that the Board of Adjustments approve the variance request, as illustrated on drawings
dated 6/29/09, for the following reasons:
1. All criteria for granting a variance are met.
Background/Discussion
An Elk River Citizens Sign Committee is leading an effort to construct a "Welcome to Elk River" sign
along Highway 10 near the eastern city limits. The sign will be similar to the west entrance sign by Lake
Orono.
In October 2008 the City Council approved an ordinance amendment that allowed city entrance
monument signs on city or private property.

Analysis
The property is zoned Commercial Reserve Transition (CRT) which has a minimum lot size of 20
acres. The proposed plat will subdivide the property into two lots. Lot 1 will be 50.39 aces and Lot
2 will be 0.05 acres. Lot 2 Block 1 will be utilized fora "Welcome to Elk River" sign. The property
will be split by the administrative subdivision process for a simple plat, which requires "Council
only" approval (scheduled for review at the July 20, 2009 City Council meeting).
A variance is required because Lot 2 does not meet the 20 acre requirement of the CRT zoning.

7. Literal en orcement of the ordinance will cause undue hardship.
The purpose of the lot split is not to evade the regulations for profit. Literal enforcement of the
regulation would require the lot to be 20 acres, financially unfeasible for the non-profit group to
acquire the property.
2. The hardship is caused by sbecial conditions and circumstances.:vhich are peculiar to the~rot~erty and the
structure involved and which are not characteristic o~ or ai~t~licable to, other lands or structure in the same area.

The site for the sign was chosen in part because of its visibility to Highway 169/ 10. In addition
to this visibility, the site required a willing seller, and relative proxitnity to the City border. The
lot for the sign is sized that there is no other value for the lot; it is too small to develop.
3. The .c~ecial conditions and circumstances are not a consequence of the~etitioner's oavn action or inaction.
The 20-acre minimum lot size was intended to prevent parceling out large parcels into multiple
small one, because, in the event of development or redevelopment, larger parcels are more
attractive to the development industry. This parcel, small, immediately adjacent to the street, will
provide an amenity, and will likely not be the subject of redevelopment.
4. The literal a~~lication ofthe~rovisions of this ordinance avould derive the~etitioner o~rights en~oyed by other
~ro~erties in the same district under the terms of this ordinance.
This criterion does not apply, as other properties will not be installing a City Monument Sign.
5. The variance avill not be inlurious to or adversely a~fect the health, sa~et o~~are of the residents of the city or
the neighborhood avhere the~ro~erty is located and rarill be in keeling with .r~irit and intent of the ordinance.
The variance will not be injurious to or adversely affect the health, safety or welfare of the
residents of the city or the neighborhood.
