The City Council is asked to approve the pay estimates as stated below.
Background/Discussion
Below are pay estimates submitted for approval. These pay estimates have been reviewed and approved
by department head in charge of the project.
A supplemental agreement has been submitted for the 193`d Avenue Street Improvement in the amount
of $95,778 for three main items: 1) Blending of topsoil, .due to the fact that the topsoil found on the side
does not meet MnDOT specification. 2) Steel sheet piling shoring; this is due to a changed soil condition
along the length of the wall. 3) Modular block retaining wall (Minnesota School of Business); at the time
that the plans were prepared, this was a vacant lot, and so no retaining wall was included. These items
have been reviewed by Terry Maurer, Public Works Director and MnDOT; in addition, MnDOT
concurred on the cost of the items. At this time, based on how the project is going, we anticipate the
majority of this change order to be covered by under runs on other project items.

Phis Contract is between the Local Government Entity and Contractor as follows:
WHEREAS: This Contract provides for, among other things, construction of a collector
roadway and city utilities; and
WHEREAS: This Contract further provides for soil retainage by means of steel sheet
pilling; and
WHEREAS: The Contract provides for topsoil spreading; and
WHEREAS: The contractor has provided additional soil boring data showing the
conditions differ from those found in the project geotechnical investigation;
and
WHEREAS: The onsite topsoil material is marginal in organic content and its ability to
sustain reasonable growth; and
WHEREAS: The conditions differ with the recent construction of the Minnesota school
of Business site; and
WHEREAS: The Engineer has determined that additional steel sheet piling shoring,
Topsoil blending, and additional modular block retaining wall is needed;
and
WHEREAS: The Engineer has further determined that this constitutes Changed
Design.
NOW, THEREFORE, IT IS MUTUALLY AGREED AND UNDERSTOOD THAT:
1. The Contractor will provide additional steel sheet pile and tie backs as shown in
design by Wenzel Engineering Dated 7/6/09 between stations 56+85 and 57+55
2. The contractor will blend the salvage topsoil with the excavated peat material at a
ratio of 50% topsoil / 50% peat prior to respreading on all disturbed areas except
4+00 to 38+00

3. The Contractor will construct a two tier modular block retaining wail from station
5+80 to 7+00 adjacent to the Minnesota School of Business with steps to provide
access required by Elk River Fire Department.
4. Contract time will not be revised except as may be provided in Mn1DOT
Specification 1806.
5. The Contractor will not make claim of any kind or character whatsoever for any
other costs or expenses that he may have incurred or that may be hereafter
incurred in performing the work and furnishing the materials required by this
Agreement.
