AND GRDERING A PUBLIC HEARING GN THE IMPROVEMENT
TN THE MATTER GF THE WINDSOR MEADGWS FINAL LIFT ~F
BITUMTNaUS AND QTHERANCILLARY ITEMS IMPRGVEMENT CAF 2009
WHEREAS tl~e Feasibility Report ordered by the Council ita Resolution 091711as been prepared ~vitla
reference to tlae Windsor Meadours Final Lift of Bituminous and ether Ancillary Items
improvement and was received by tlae City on August 17, 2009; and
WHEREAS tl~e Feasibility Report reconunends t11at the proposed improvement is feasible;
NnW THEREFaRE, BE IT RESOLVED by tlae City Council of tl~e City of Elk River, Minnesota.
1. The City Council will consider the Windsor Meadows Final Lift of I~iturninous and ~tller Ancillary
Improvements as described in the Feasibility Report and t11e assessment of certain property abutting
tlv.s proposed itnprovernent for all or a portion of tl~e cost of the improvement pursuant to
Minnesota Statutes, Section 429, at an estimated total cost for tlae unprovement of X76,000,
2. A public hearing shall be held before the City Council on the proposed improvement on the 2T5t day
of September, 2009, at G;30 o'clock p.tn. at the Ells River City Hall Council Chambers.
The City Clerl~ shall provide two published notices one week apart} in the official newspaper, with at
least three days between tlae last publication date and the hearing, and mailed notice ten days to the
hearing as required by law.
