cti®n equeste Requesting that the Council review the administrative citation process and provide staff guidance on whether or not this is an enforcement tool staff should utilize. ack r~undl ~scussa~n Earlier this year the State Legislative bodies passed law that allows cities and police departments to utilize administrative citations fox traffic enforcement. Prior to this passage, the use of these citations was improper and not allowed. Although this passage allows the utilization of these citations the use is restricted. The only offenses at this point that the citation can be used fox are: Speeding violation nine miles an hour and less over the posted speed limit. ~ Failure to stop fox a stop sign. ® Equipment violations such as cracl~ed windshields. There are further restrictions to enforcement, most specific. ~fficexs can not reduce speeds to meet the requirements. ~~n other words, officers can't stop someone for doing 42 mph in a 3o zone, and then reduce the speed on the ticl~et to 39. The citation has to be issued fox actual speed.} The Minnesota Chiefs of Police and Sheriff Associations firmly believe that next year there will be additional violations added to the chargeable list, They state that this first introduction of the law was sifnply to allow both passage of law and acceptance of practice, ~Zowever, the law will face continued lack of support from the State as it directly impacts the State budget as it relates to revenue generated from normal tt•affic citations. See attached memo and fee journal fox details} If the Council directs staff to implement the administrative fines, there are ten steps that must be undertal~en. These steps are clearly laid out in a tool lit provided by the League of Minnesota Cities. The kit contains model policy and resolutions. The steps to be tal~en are: 1} Pass a resolution that authorizes police use of administrative traffic citations for AGO per violation. It also must obligate the city to provide a neutral third party to hear and rule on challenges. Finally it S,~Council~Police~2Q09~Admin I'ines,doc must bar police officers from issuing administrative citations in violation of this law. Model policy available} 2} An appeal process must be setup using neuttal thud-party hearing officers fox those who wish to contest their administrative traffic citation, The legislative intent is that this hearing officer be someone other than city staff ox City Council} 3} we must notify the Com~Dissioner of Public Safety that the Council passed a resolution allowing police officers to issue these citations. ~A model letter is available} 4} we shall develop an information sheet to be given to anyone who is issued an administrative citation describing to the driver how they may contest their violation. ~A model flyer is available} 5} we must purchase the new prescribed Department of Public Safety uniform traffic citation from the Commissioner of Public Safety. The cost for these has not yet been established} we must t~.•ack the number of administi.•ative citations issued and the money collected. ~I`he City Finance Department is fully p~.•epared fox this p~.•ocess.} The state auditor must then collect this information from all cities once each year. 7} Divide the money that is collected so that two~thirds of the fine ~~40} remains with the city, and one-third is paid to the State Com~x~issioner of Finance, 8} The state's share of the money must be submitted to the MN Management and Budget, Treasu~.y Division using the Administrative Citation Fine Remittance Form. Model Supplied} 9} Use one~half of the city's share ~~20} fox law enforcement purposes. These funds must be used to supplement, but not supplant the annual police budget, I O} Issue citations for the three violations allowed, but l~now that no administrative citation maybe issued to anyone who possesses a commercial d~•iver's license. The largest unl~own at this point, is how we would appoint the impartial hearing officer, Thoughts thus far have been to utilize a local attorney ox law firm, a retired judge, or one of two hearing officer corporations that have been quicldy formed herein the state. It is impossible to judge how many citations would be issued. ~Ue do not typically write many speeding ticl~ets at less than nine over, A more palatable citation that does not go on a d~•iver's record, and costs less, might encourage our officers to write more citations at lesser speeds, Especially in those neighborhoods where speeding is a concern} There is also no l~nown indicator as to how many citations would be contested and what the cost of a heari~a.g would be, rt would not tape many hearings to drain any revenue gained from the citations when our income is only X40. ~Ioweve~.•, it may however be possible that the hearings would be very few, The four judges in Sherburne County recently voiced their opinion of this administrative citation process dux~.g a Criminal Justice Communication Committee meeting, They stated the following; They felt that the administrative citations were a revenue mechanism supported by cities, and one driven by a strong desire to bolste~.• diminishing city budgets. They feel that this impacts the purpose of ti.•affic citations themselves, which is justice versus income. They also felt that the hearing officer process was a lacy of official due process, and one that would shortly be before the cou~.•ts themselves as a matter for judicial review. S:~Council~1'o~ice~2U0{1~~.dmin rines,dac Zn fairness, it should be pointed out that many in the state have been concerned about this process from the beginning. As you will see in the financial poxrion of this memo, the state potentially stands to lose a great deal of revenue that is normally granted them when regular citations are used. ~Ie are requesting that the Council review all of this information, and give direction to staff on whether or not we should proceed with the administrative citation process. ~nancia~ lrnp~c ~1'e l~now of few specifics on the financial impact of this process for several reasons. First, the state has not announced the costs of the new citation yet. we used to pay $4,500 per printed batch of regular traffic citations, I would expect that the cast might be in that area, ~1'e no longer pay for citation printing since we went paperless. That option is nat available far these citations} There will be a small amount of staff time to enter the tickets into our police database and to have finance track, collect, and disseminate the f~a.e money. I do not believe that these costs will be very signif cant. The model resolutions, forms, and letters are all available to us at no charge from the League. The revenue stream is very difficult to estimate due to the limited number of offenses these citations can be used for. If an estimate could be made, ~ would suggest that we might issue Sod of these citations each year to start. That would generate $10,00 of supplemental revenue for the police department, and $10,000 for the city budget, we would subtract from there the costs of the tickets and the hearing officer. Normally, a $~Z5 speeding ticket would generate ~2C in fine revenue for the city. Based on the same number of tickets ~500~, we would see $3,000 in fine revenue for the city, or $7,000 less than the administrative citations. Taping out $4,500 in tickets costs and an estimated $1,000 a yea~.• in hearing officer costs and the revenue gained is almost the same regardless of which choice the Council makes. Zt should be painted out, however, that if more violations are added to the allowable offenses next year, the ability to gain more revenue from the administrative fines is greatly increased. Factually, if we could use these for all moving violations except far the serious driving offenses ~Dw~}, we could see a 40% increase in fine revenue each year. This report p~:ovides a breal~ down of where the f~ae amounts are allocated to. There axe four different areas that monies are allocated to. First let me explain what each of the columns represent I believe the receipt number, party/case number, date and totals column are self explanatory. The fee totals coluin~ is the amount that is then allocated to one of the remainder columns, Column 71EL~]ARE receives portions of base fine money, auto~~latically calculated by the state, urhen chaxgii.~g statutes starting with ~ 52 ox 340 are used. The State receives this money for the DARE Program. Column 71EL~I'RSCT receives ~.noney fox prosecution costs when ordered by the court. This is true in cases where a citation/charge is dismissed but the court feels the defendant should pay fox prosecution costs. Money allocated to this area is tl.~en provided to the City. Columns 7~.DP~ELK and ?ZDI~RELR receive fine money when charges axe fxo:m. State Patrol ox the DNR. Mone~T allocated to these columns is submitted to the respective agency and no allotments are received by the City of Elk River, Column 71EL~~3 is no longer receiving funds as of July 1~r unless the charges are from prior to this date. Coluint~. 71ELI~1~0 receives money fror~~ parl~ing violations that are past due and have been forwarded to the City Attorney for a formal complaint and fees are paid through count. Column 71ELY~23 is 2/3ras of tla.e money that is received by the City from the base fine amount. ~ will use a speeding citation as an example to provide ~rou with the break down of how the money is allocated. For this specific example there would be ~ 125.00 in the totals colufnn. X75.00 is allocated for the State surcharge; X10.00 is then allocated to the law library the two amounts are not shown on the report which leaves a base fine of $40.00. 2/3c~s of X40.00 is ~26.6G which is then allocated to colu~.x~n 71 ell~23, this is the City of Ells River's portion and 1 /3`~ of $40.00 is $13.34 and is allocated to the Municipal Supreme Court. No funds are received by the City when the Sherburne County Attorney's Uffice handles the prosecution. Nate that ~. the party/case # column, two codes are used to differentiate between types of cases. CR means the violation. is a mandatory court appearance and VB is payable petty misdemeanor violations. ~n some instances where the code CR is used you will find that no money has been allocated to any of the payable columns. This is due to those cases being prosecuted by the County Attorney where no funds are received by the City. Hopefully this brief explanation urill benefit ~. understanding how the money is allocated. The Minnesota Legislature debated the issue in recent years, Finally, in 2009, the Legislature enacted a new statute, Minn, Stat. ~ 169.999, to authorize the issuance of administrative citations and prescribe criteria for them, Clicl~ here to see the Ian ~ ua e of the ~~ew statute: scrap. down to Sec. 6. This new statute contains detailed requirements which local units of government will have to follow to implement an administrative citations program, Reso~u~xon required The new law requires the governing board of a local unit of government to pass a resolution before it issues a citation. The resolution must; authorize issuance of administrative citations; obligate the local unit of government to provide a neutral third party to bear and rule on challenges to administrative citations; and bar peace officers from issuing administrative citations in violation of tl~e new law. Because of this requirement, local units of government with existing administrative penalty programs for traffic violations must pass a new resolution to bring their programs iota compliance with the new law. The law requi~•es local units of government to notify the Commissioner of Public Safety after they pass the requi~•ed resolution. Stat. ~ ~ ~ 69.46 - 169.68 and ~ 69.69 - 169.75 primarily equipment-related vioiations~. Uniform Adminis~ra~ive Citation The Comrrlissianer of Public Safety must create a uniform adn~inistrative citation on or before October 1, 2009, after consulting on the form and content of the uniform administrative citation with representatives from the Sheriff s Association of Minnesota, the Minnesota Chiefs of Police Association, and the Minnesota Police and Peace off cers Association. The law requires the use of this new uniform administrative citation, The Commissioner of Public Safety is required to prescribe the detailed form of the uniform administrative citation and revise it as necessary and proper, The uniform administrative citation must include notice that the person has the right to contest the citation. fight to Contest an Administrative Citatioza The local unit of government using the new administrative citation program must provide a civil process for a persona to contest the administrative citation, and peace officers who issue administrative citations must inform the vehicle operator of his or her right to contest the citation, The person must be allowed to challenge the citation before a neutral third party. The local unit of government may employ a person to hear and rule on challenges, ar may contract with another local unit of government or a private entity to do so. Amount, ~xstribution and Use of the Fine The fine for an administrative violation is set at $60. Two-thirds of this amount is to be credited to the general revenue fund of the local unit of gove~°nment, and one-third to be transferred to the Commissioner of Management and Budget for deposit in the state general fund, A local unit of government receiving administrative fine proceeds must use one-half of the funds far law enfo~•cenaent purposes, This money "must be used to supplement but not supplant any existing law enforcement funding." The State Auditor will annually report information concerning administrative fines collected by local units of. government to the Commissioner of Public Safety. Conclusion The new law provides clarity by granting and defining the authority local units of government will have to issue administrative citations.
