As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all require permits. 2. The commercial kennel shall be limited to ten (10) animals over the age of 6 months. Additional animals will require an amendment to the Conditional Use Permit. 3. Animal waste shall be disposed of per Section 10-9. 4. The applicant shall receive a commercial kennel license from the City Council. 5. All animals must be licensed and vaccinated. 6. All animals shall be on a six (6) foot or shorter leash when outside of the kennel. 7. No more than two (2) animals per supervisor shall be allowed outside of the kennel. 8. All dog waste shall be cleaned up immediately when dogs are off of the subject property. 9. Applicant shall provide proof of liability insurance in at least the sum of $1 million. 10. No dogs designated as dangerous or potentially dangerous are allowed to be kept at the kennel and keeping of a dangerous or potentially dangerous dog shall be grounds for revocation. Summary The applicant currently has three dogs, three cats and 12 puppies and is applying for a Commercial Kennel CUP. Planning Commission Discussion A great deal of discussion happened regarding noise, number of dogs, and commercial vs. private kennel. They also discussed possibilities of limiting the amount of time the dogs could be outside (barking) and if barking collars, which the applicant suggested, should be required. It was decided that a time frame and collars would be difficult to monitor and enforce. The Planning Commission came to a determination that 15 dogs (staff recommendation) was too many and suggested 10. Since the Planning Commission meeting, staff has had conversations with the City Clerk and the City Attorney and is recommending two additional conditions: • Applicant shall provide proof of liability insurance in at least the sum of $1 million. • No dogs designated as dangerous or potentially dangerous are allowed to be kept at the kennel and keeping of a dangerous or potentially dangerous dog shall be grounds for revocation. Public Comment Several neighbors expressed concern about the barking noise and the number of dogs. They also stated it is not the size of the lot that is significant, but the proximity to neighbors. The subject property and the property to the south are each near 10 acres in size, but the house on the neighboring lot is only 140-145 feet away from the one kennel. One comment was there are so many dogs so close to so many neighbors. The applicant stated the dogs are not out at night for more than 15 minutes at a time, there are other barking dogs around, their puppies are the ones that bark, and that all the animals would be their pets. He later stated that they would be breeding dogs for sale. In May of 2006, this property did receive a CUP for 15 horses on the property. That operation has since ceased use for more than a year, lapsing the CUP. The subject property= is almost 10 acres in size. Commercial Kennels are defined as: means any~iremises avhere more than three animals over six months of age are boarded, trained or bred for compensation or are offered for sale, except for animals being raised as agricultural livestock, an animal hospital, a veterinary clinic or a pet shop. The applicant is requesting a Commercial Kennel Conditional Use Permit for 15-20 animals. Because of anticipated noise and waste reasons, staff is recommending that the number of animals not exceed 15 animals. The proposed kennel spaces will be located in a heated shop under the garage and also in the detached pole building. There is an existing fenced area attached to the pole building and the applicant is proposing adding another fenced area attached to the shop area of the house. Dn February S, ~oD9 our delightful Chocolate Lab, wham we named Dakota, was born to Cheesy and frock, both chocolate labs awned by Kim and John Meyer. After responding to a sign advertising chaco~at~.l~b pupp~e~, my husband Tom and I visited their hope in the hopes of adopting one of the puppies. Their home and yard was clean and well kept, even though they were in the midst o~ moving. I was expressly impressed by the behavior and temperament of their two adult labs, Cheesy and Srock. In my experience, dogs make themselves knawn by barking when a visitor arrives. This, however, was not the case, Seth frock and Cheesy were well tempered and quiet open our arrival, and exhibited gentle and obedient traits. That is one of the many reasons why we chase Dakota as our ~ami~~ doh. Dath Srock and Cheesy were very well behaved during our visit which lasted a~prnximately two hours. bath Kim and Jahn seemed to love and take very good care of their dogs and the puppies, ensuring that they had enough food, treats, and space for adequate exercise. In addition, they gave very good advice an how to care for Dakota ~ to include timing of proper vaccinations and veterinarian visits, feeding schedules, house breaking, kenneling, hygiene, exercise, and also some basic obedience training. Kira Meyer kept detailed records of the doffs including their breeding lines and veterinary documentation, which she provided copies ol: at the time of adoption. She also seemed quite knowledgable in the traits of a good laboradore, camrnenting an what the vet should be looking at during visits ii.e, hip measurements and signs and symptoms of illness. the also welcomed any future photos and updates on Dakota, and seemed to be sincerely attached to the puppies, Since adapting Dakota, we have been mare than satisfied with our decision. Dakota is a remarkable deg a a true family dog, lie is very well mannered and hardly ever barks or cries, except for when he really needs your attention. He is very gentle and loving with our six children.
