MEMORANDUM FROM: DATE: SUBJECT: Mayor and City Council Scott Harlicker, Planning Assista~ November 18, 1996 City of Elk River Request for Rezoning of Industrial Hardfacing and George Deschenes Properties, Public Hearing Case No. ZC 96-18 Request The City of Elk River is initiating this rezoning request from Rlc (Single Family Residential) to I1 (Light Industrial). Location The area under consideration for rezoning is generally bounded by County Road 13 on the north and west, 185th Avenue alignment on the south and Wilson Street ahgnment on the east. The properties are owned by George Deschenes and Industrial Hardfacing. Zoning/Land Use Rlc (Single Family Residential) / LI (Light Industrial) Attachments · Location map · Zoning map · Land use map · Ordinance No. 96- Background These properties were included as part of a larger area (area #8) that was considered for rezoning to hght industrial in March 1996. As part of the update of the comprehensive plan, the land use designation was changed to hght industrial. The rezoning was initiated in order to bring the zoning into conformance with the comprehensive plan. When the rezoning was originally 13065 Orono Parkway · P.O. During the course of the Council's dehberation, there was some discussion that there should be some consideration given to rezoning the properties owned by Industrial Hardfacing and George Deschenes. It was noted that the possible realignment of County Roads 12 and 13 would better define an industrial area and that these properties would hkely be within the boundaries of any future industrial zone. In hght of this discussion, the Council directed staff to look into the possibility of rezoning the Industrial Hard/acing and Deschenes properties. Existing[ Conditions The area under consideration for rezoning is approximately 13 acres in area. Current uses are Industrial Hard/acing hght manufacturing facility, a single family home and undeveloped land. There are 2 small wetlands and the vegetation is a mix of hardwoods, brush and volunteer growth. The surrounding properties are zoned Rlc with a land use designation of light industrial to the south and medium residential to the east, west and north. The properties are within the urban service area. Evaluation of Request In order to approve a rezoning request there must be a finding that a) the plan was in error when it was adopted, and therefore, should be changed or, b) the times and circumstances have changed since the plan was adopted, and a change is warranted. This rezoning is being considered in order that this area will be consistent with the land use plan. The updated land use plan designated this area as LI (Light Industrial). The proposed rezoning to I1 (hght Industrial) is consistent with that revised land use designation, and therefore, the second finding is met. Consideration should also be given to the existing conditions within the area directly and indirectly affected by the proposal, the use to which the property affected is being devoted at the time and the relevant portions of the land use plan. The Industrial Hardfacing property is currently being utilized in a way that is consistent with hght industrial zoning. The rezoning is consistent with the concept of providing industrial land within the urban service area and the ease that municipal services could be s:\planning\scott\zc9618cc.doc Memo to the Mayor and City Council November 18, 1996 Page 3 extended make this area very suitable for industrial uses. Furthermore, the area is accessed by County Road 13 which connects with Highway 169 Planning Commission Meeting The Planning Commission considered this request at their October 22, 1996 meeting. There was some discussion as to how the realignment of County Roads 12 and 13 will affect this area. There were no comments at the public hearing. Recommendation The Planning Commission and staff recommend that the City Council approve Ordinance NO. 96- rezoning certain properties from Rlc to I1 based on the following: The proposed rezoning is consistent with the Comprehensive Land Use Plan designation of LI (Light Industrial). o The area has access to a major arterial, Highway 169, by way of County Road 13. The area is within the urban service area with availability of urban services and utilities upon future development. ZC 96-18 The City Council of the City of Elk River does hereby ordain as follows: Section 1. The duly adopted Zoning Map of the City of Elk River is hereby amended to rezone the property described as: Section 2. findings: See Attached Exhibit A The rezoning is being approved based on the following 1. The proposed rezoning is consistent with the Comprehensive Land Use Plan designation of LI (Light Industrial). 2. The area has access to a major arterial, Highway 169, by way of County Road 13. 3. The area is within the urban service area with availability of urban services and utilities upon future development. 4. The proposed rezoning is consistent with the concept of providing industrial land within the urban service area. Section 3.
