SUBJECT: 1997 Administrative Fees
The city annually reviews its fees for services to ensure that the cost
of administration and enforcement are covered and to ensure that
the fees somewhat compare with surrounding communities of
similar size. Last year the following administrative fees were
adjusted by the City Council:

A majority of the Administration fee increases were based on the
1995 Municipal License and Permit Survey conducted by the
Association of Metropolitan Municipalities and compared to cities in
the 10,000 to 20,000 population range. This same survey was used to
compare fees for 1997. Based on the information in this survey, staff
is not recommending any changes to the administrative fees in 1997.
There are, however, some additional fees that were not included in
the 1996 fee schedule. These fees are as follows:

Single family and twin home building permits
In 1996 the City adopted the 1994 Uniform Building Code (UBC). The new
permit fee schedule with this code significantly increased building permit
costs. The Council decided to spread this increased cost out over two years.
They adopted the new fee schedule, but reduced the plan check fee from 65%
to 35% of the building permit price until 1997.
The following example using a house valued at $100,000 illustrates the
increase:

Staff is recommending the plan check fee is increased to 65% to be
consistent with the majority of other cities. If the council agrees, staff will
notify builders of the pending change.
Year to date, on single family and twin homes the City collected
approximately $65,000 of plan checks fees, charging at the rate of 35% of the
permit cost. At 65% of the permit cost the City would have collected
approximately $120,000. The City lost $55,000 in revenue thus far in 1996
with the 35% plan check fee.

Plumbing~ heating~ and other miscellaneous building permit fees:
All of these permit fees were reviewed and appropriately adjusted in 1996.
Staff is not recommending changes to these fees in 1997.
Commercial and industrial building permit fees:
The maximum allowed building and plan check fees for these permits are
being charged. Staff is not recommending changes to these fees in
1997.
ENVIRONMENTAL FEES
Mineral excavation licenses
The City increased this fee 33% in 1996 from $15 per acre to $20 per acre for
land mined, but not reclaimed. Staff recommended this increase to help
encourage reclamation; once the land is reclaimed no fee is charged.
However, a license fee should be equal to the cost of administering the
license. The current mineral excavation license fee adequately covers the
City's administrative costs. Staff is not recommending an increase to
this fee in 1997.
Solid waste licenses
The City charges $2,000 per year for a solid waste license. Elk River has
three such licenses currently: Elk River Landfill, NRG's RDF plant, and
UPA. The $2,000 license fee is to cover City staff time spent administering
the license. The license fee is not meant to cover the cost renewing these
permits, which is charged separately.
The $2,000 fee adequately covers UPA and NRG. Consultant time for these
permits is charged to them. The Landfill takes more than $2,000 worth of
staff time a year, but there is surcharge money that covers this. Staff is not
recommending an increase to this fee in 1997.
Garbage hauler license, grading permits~ and wetland permits
Garbage hauler licenses - $60 1st truck/$15 each additional truck
Grading permits - $25 plus consultant time
Wetland permits - $75 plus consultant time
Staff feels these fees are adequate for 1997 and are not
recommending changes.

Discuss Planning and Park Fees
Overview
Each year, the Planning Department conducts a survey of surrounding cities
and other developing communities in the metro area to get a list of their
respective planning and park dedication fees. This survey helps provide a
basis for adjusting the City of Elk River's fees, as well as recognizing what
other communities are charging for their development fees.
Last year, the City Council adjusted the following planning fees:
Conditional use permit (commercial/industrial) $300 (increase of $50)
Preliminary plat $500 plus $5 for each lot over 50 (added per lot fee)
Site plan review 250 (increase of $50)
Based on the amendments made last year and the survey conducted this
year, the planning department is not recommending any changes be made to
the existing planning application fees. However, I must point out to the
Council that in some instances, the existing application fees do not come
close to covering the staff time involved in reviewing and monitoring some of
the developments that are being proposed. For example, larger residential
plats involve several pre-application meetings with the developer, as well as
time spent preparing reports, secretarial time typing reports, and further
follow-up after the Planning Commission and City Council's meeting.
Therefore, I do believe that there is justification to adjust the preliminary
plat fee if it is the desire of the Council to have the application fee cover staff
time.
Park Dedication Fees
Another fee that is included in the annual survey is the park dedication fees.
As outlined in the survey, the park dedication fee for single family
developments has a wide range from $384 per lot in the City of Coon Rapids
up to $1,000 per lot in the City of Woodbury. The average of the cities

surveyed is $729.00 per single family lot. The City of Elk River's park
dedication fee is currently $550 per residential unit and will be increasing to
$600 per unit the first of the year.
The Park and Recreation Commission discussed the current park dedication
fees at their November meeting and recommended the Council consider
establishing a trail fee on a per lot basis to be used towards the development
of trails. Currently, the city's policy is to either credit a developer's park
dedication requirement for any trails that need to be developed within a
project or, ff the trail costs exceed the park dedication required, the city
would reimburse the developer for those trail construction expenses. As trail
development continues to be an integral part of developments and the city'
park and recreation system, the Council may want to discuss the financing of
developing these trails and the possibility of instituting some type of trail fee
for residential plats. The Park & Recreation Commission has recommended
the Council consider establishing a $100 per lot trail fee. Such a fee is not
uncommon as other cities have also established such a fee.
Recommendation
The City Council is asked to review the attached survey and consider the
city's current planning application fees and park dedication fees and provide
staff direction of any changes that may need to be made.

Renewal of Licenses and Fees
The City's licenses and fees are reviewed by staff on an annual basis.
The Council has requested that there be a worksession to discuss the
city's current fees and licenses. This worksession will be held on
November 25, 1996.
Attached is the material that was presented to the council in 1995 for
the 1996 fee and license structure. Also attached is the 1996 fee
schedule that was set by council.
Please be prepared to discuss the 1996 license and fee schedule. Also
be prepared to back-up proposed increases for 1997.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ADOPTING FEES FOR SERVICES FOR 1996
WHEREAS,
the cost incurred to process the various hcenses, services,
zoning and planning requests, etc., has been studies; and
WHEREAS,
the study of these fees has resulted m an increase in certain
fees; and
WHEREAS, this resolution reflects the fees charged by the City for 1996.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Elk River, Minnesota, that fees for services for the year
1996 shall be adopted as indicated on the attached Fee
Schedule.

Fuel-Gas Piping Permit Fees
The Chief Buila~ng Inspector, before iss~Jng any permit for the installation of
any fuel-gas piping, shall require the payment by the applicant for such
permit of fees in the amount herein provided.
Minim,~m Fee
In no case shall the fee charged for any permit issued by the Chief Building
Inspector be less than Eighteen Dollars ($18.00).
Basic Fees
The fees for all fuel-gas piping permits shall be computed on the basis of the
number of fuel-gas appliances. The fee for each appliance so, provided for
shall, except as herinafter other~'ise specifically provided, be Six Dollars
($6.00) for each fuel-gas appliance.
VVhere any such permit is issued for roughing in of fuel-gas l~nes for future
appliances, a fee of SLx Dollars ($6.00) shall be charged for each line or ]ines.

In addition to the Six Dollar ($6.00) charge for each fuel-gas appliance ancl
future fuel-gas lines run for appliance, a Six Dollar ($6.00) charge for the

The Building and Zoning Department is proposing to modify several of the
miscellaneous permit fees, the heating, ventilation, and air conditioning fees,
and building permit fees. Mr. Skogstad elaborates on these in his attached

In 1995, the city charged $15.00 per acre for land that was goihg to be mined
in the forthcoming year or was approved to be mined. In 1996, staff is
proposing this fee be increased to $20.00 per acre to cover the cost of
administering the gravel mining licenses.

Adoption of the New Building Code
and Fee Schedules
Provided for you in this memo, are many different areas that we wish to have
addressed at this time. Staffs intention is to update the following areas to be
' in comphance with State regulations and city codes. The following is
included with this memo:
Section 1000 of the City Code regarding the adoption of the 1994 State
Building Codes.
2. Adopting a new City of Elk River fuel gas piping permit fee.
Adopting a new City of Elk River Heating, Ventilation, and Air
Conditioning permit fee.
4. Adoption of the City of Elk River's miscellaneous permit fee schedule.
The first item is the adoption of the 1994 UnWorm Building Code.
Approximately every three years, the Uniform Building Code is updated by
the International Conference of Buildin g Officials and then published. Once
published, the code is presented to the State Building Code Division. The
State Building Code Division writes the new State Buildin g Code with
amendment to the Uniform Building Code. Once this code has been adopted
by the State, all municipalities can adopt the State Building Code with
amendments to the Uniform Building Code. The 1994 State Building Code
was adopted on March 20, 1995.
With the adoption of this new code, there are certain areas that need to be
brought to your attention. The State Building CSde Division never adopted
the 1991 code. The reason for this action was to start working on the 1994
code and have it adopted in 1995. The State Building Code was always
running about slx years behind in regard to the adoption of the Uniform
Building Cbde. The Building Code Division felt it was a good time to bring
all the codes up to date. Secondly, in regard to the adoption of the codes, two
building code chapters were added to this section of the ordinance, letters "S"

and "T". The Uniform Building Code Appendix, Chapter 15, regarding re-
roofing, assists building inspectors in the inspecting process on all re-roofing
projects and gives them a guideline for work being completed. This chapter
was in the 1988 Building Code, but was under Chapter 25 and not an
appendix chapter. Since it is now an appendix chapter, it must be adopted
with the city codes.
The Uniform Building Code Appendix, Chapter 33, for excavation and
grading, assists the building inspector for recognizing hazardous excavating
regarding cutting of soils for foundations and recommendations for protection
of these excavated sites. It also assists in the recommendations for soil
engineering reports and engineered grading requirements, erosion control,
and all necessary inspections for this type of activity. Once again, this
ch'apter was in the 1988 Uniform Building Code but was not an appendix
chapter.
One of the major changes with the adoption of the 1994 Uniform Building
Code is Table lA, for building permit fees. With the elimination of the 1991
Uniform Building Code, we have not seen a change in building fees for
approximately five years. With the adoption of this new code there has been
a dramatic change in the permit fees. Provided for you is a scenario of the
changes. Assuming a residential structure at $100,000 valuation, the 1988
Uniform Building Code permit price out of table 3A (which is our current
permit pricing schedule) would be a total price of $1,105.50. This does not
include a septic permit fee of $65.00 or a SAC charge of $1300. The same
house with a valuation of $100,000 using table lA from the 1994 Uniform
Building Code would be $1,527. This would be an increase of $421.50.
Again, this price includes permit fee, plan check fee, and state surcharge and
does not include a $1300 SAC charge or a $65.00 septic charge.
Staff feels that this may be a fee that would be a very heavy burden on
homeowners and contractors. A gradual increase may be better at this time.
Staffis proposing to leave the permit fee the same as what we have in Table
3A until the end of 1995 and start January 1, 1996 with commercial and
industrial permit fees based out of Table lA of the 1994 Uniform Building
Code. All residential projects would also have their permit prices based out
of Table lA of the 1994 Uniform Building Code, but instead of a 65% plan
check fee for residential, it would be a 35% plan check fee. The permit price
using the same scenario of $100,000 would be $1,258. This would be a
$152.50 increase from the 1988 Uniform Building Code permit fee schedule.
We would then go to a 65% plan check fee January 1, 1997. This will allow
us to give all residential contractors a notice of price changing on permit fees
and will give them the opportunity to put these price changes into their bid
prices. In addition, notice will be given to all commercial and industrial
contractors of the January 1, 1996, price change.

The second and third items are Exhibit A regarding fuel gas piping fees and
Exhibit B regarding heating, ventilation, and air conditioning. These two
items were combined in the current CiW Code and we wish at this time to
separate the two, as they are two completely different types of work. Exhibit
A for fuel gas piping requires a hcense with the city and also a bond. We
have found that many different contractors were runnin g gas lines without a
hcense or a bond. With this change, it will assist the inspectors to more
define this type of work and put hcensed pipe fitters on all gas piping.
Exhibit B is a fee that we wish to charge for all heating, ventilation, and air
conditioning projects. This fee is 1% of the total valuation of the work being
performed. In the past, we never had a price for this type of work but were
doing plan reviews and inspections. This allows us to charge for all the
inspections that are being performed.
The last item is Exhibit C regarding miscellaneous permit fees. St~W is
trying to base all valuations off of square footage with these fees. We have
learned from other municipalities that using a base price has put them into a
legal court system. Contractors felt that they were being charged too much
for the smaller projects and allowing the larger projects to be a lot less than
expected. Using square footage for valuation allows the smaller projects to
become a fair permit price along with the larger projects, thus allowing
unfair situations.
At this time staff is requesting the adoption of the 1994 State Building Code
with Appendix Chapter 15 and Appendix Chapter 33, and the residential
permit price change stated above. Also, the adoptions of Exhibit A, B, and C.

Overview
In 1992, the City Council adopted a resolution which adjusted the park
dedication fees on an annual basis by $50.00 for a three-year period. The
last adjustment as set forth in the resolution was made on 1/1/95 which
brought the fee up to $500 per dwelling unit for residential development.
Attached for the Council's review is a survey of other communities' park
dedication fees.
Park and Recreation Commission
The Park and Recreation Commission, at their September 13,.. 1995 meeting,
discussed an increase in park dedication fees. The Park and~ec Commission
recommended increasing the fee for single family and multi-family
development by $100 per lot annually for the next two years. The
Commission also recommended increasing the commercial park dedication
fee from the current rate of $1,500 per acre to $2,000 per acre in 1996 and
$2,500 per acre in 1997.

Commercial Park Dedication
Currently, the City of Elk River has a rural and urban park dedication fee.
The proposed resolution would eliminate the rural rate and equ,lize the
commercial dedication. There is not a lot of rural commercial development
and when it does occur, they are held to the same standards as urban
commercial. Therefore, staff believes the rate for urban and rural should be
identical.
Recommendation
The attached resolution establishes a park dedication fee increase as
recommended by the Park and Recreation Commission for residential and
the first year increase for commercial. Staff would like to review the
commercial park dedication rate later this year to determine ff an increase to
$2,500 per acre is appropriate or ff that fee should actually be higher.
It is recommended the City Council adopt Resolution 95- , amending the
park dedication fees as set forth in the attached resolution.

WHEREAS,
the City Council of the City of Elk River in Or3inance 87-1
estabhshed that the City Council can require a fixed fee to be
paid for Park Dedication purposes and that this fee shall be set
by resolution of the City Council; and,
WHEREAS,
the Elk River City Council has received and reviewed a
recommendation ~om the Elk River Park and Recreation
Commission that recommends that this Park Dedication Fee be
increased per residential and multi-family dwelling unit based
on the need for additional funds to provide recreation
opportunities and based on the increased land value in the City
of Elk River; and,
WHEREAS,
the Elk River Park and Recreation Commission recommends
the Park Dedication Fee requirements for commercial property
be increased based on the increased land value in the City of
Elk River; and,
WHEREAS,
the adoption of this resolution adjusts the Park Dedication Fee
for all residential dwelling units that was adopted in
Resolution 92-122.

Consider adjusting planning apphcation fees.
Overview
On an annual basis, staff conducts a survey of surrounding and other similar
developing communities to assess their fee structure as compared to Elk
River's. When considering an increase in application fees, staff reviews the
following:
· How does Elk River's fees compare to the surrounding and similar
communities?
· Which apphcations generally demand the greatest amount of staff time to
review, prepare reports and administer?
The last time planning apphcation fees were adjusted was January of 1994.
Since that time, it has become clear the applications which generally demand
the greatest amount of staff time are:
· Subdivisions (preliminary and final)
· Conditional use permits
· Site plan review
Therefore, the fees for these apphcations are proposed to be increased as
follows:

A special note should be made regarding the increase in preliminary plat
fees. This fee is being adjusted to maintain a base fee; however, include a
per lot fee. This is an attempt to try and make apphcation fees for
preliminary plats proportional to the size of the actual development.

1996 Administrative Fees
Fees for services are based on the direct cost of administration and
enforcement for the licensed service. The city annually reviews its fees to
ensure that the cost of administration and enforcement are covered and to
see how the fees compare with surrounding communities of similar size.
The recommendation for the fo]lowing fee increases is based on the cost of
administration and the average fees being charged by metropohtan
municipalities for cities of 10,000 - 20,000 population.
Listed below are the current administrative fees with the recommended
increases.

* The average fee for wine licenses was much higher than what the city is
currently paying. In this case, the City is recommending a below average
increase so as not to dramatically raise the fee in one year.
