Given the City Council's discussion concerning the funding of the Lowell Avenue
improvements when the feasibility study was presented, staff would like to suggest a
change to the project schedule. Rather than hold the public hearing in mid-December,
we would suggest that the project be bid first and a public hearing and assessment hearing
be held the same evening in early 1997 after the bids are opened and the actual
construction costs determined. This should give the City Council the needed information
to discuss the amounts of the assessment for the project. Once the bids are received, staff
will be prepared to make some recommendations to the Council regarding the assessment
of this project, prior to scheduling both the public hearing and assessment hearing.
As we have discussed previously, we are recommending that the Orono Lake 3rd
Addition and Joplin Street improvements also be bid with the Lowell Avenue project.
The Joplin Street improvements, as you are aware, are not proposed to be assessed,
although the Developer of Country Crossing 3rd Addition is obligated to pay 50 % of the
cost. The Orono Lake 3rd Addition improvements have already gone through public
hearing and, after bids are received, it will be necessary to schedule an assessment
hearing for that project.
The attached resolution approves the plans and authorizes the advertisement for bids. We
would recommend Council adoption of this resolution. If you have any questions, I will
be in attendance at your meeting on December 2nd, 1996.

RESOLUTION 96 -
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS
AND ORDERING THE ADVERTISEMENT FOR BIDS
IN THE MATTER OF THE ORONO LAKE 3RD ADDITION
IMPROVEMENT OF 1996
WHEREAS
pursuant to Resolution 96 - 62, the Project Engineer has prepared plans and
specifications for the Orono Lake 3rd Addition improvement, which plans and
specifications have been reviewed by the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
Such plans and specifications, a copy of which is attached hereto and incorporated herein
by this reference, are hereby approved.
The City Administrator shall prepare and obtain the publication of an advertisement for
bids for the making of the improvement pursuant to the attached plans and specifications.
The advertisement shall be published once each week for three consecutive weeks, shall
specify the work to be done, and shall state that the bids will be received by the City
Administrator until 10:00 a.m., on January 7, 1997, at which time the bids will be
publicly opened in the Council chambers of the City Hall by the City Administrator and
the Project Engineer and will then be tabulated for consideration by the City Council at
a meeting thereof at 6:00 o'clock p.m. on January 22, 1997, in the City Council chambers
at City Hall. No bids will be considered unless sealed and filed with the City
Administrator and accompanied by a cash deposit, cashier's check, bid bond, or certified
check payable to the City Administrator in the amount of 5 % of the amount of such bid.
