1. Call Meeting To Order
Pursuant to due call and notice thereof, the meeting of the Elk River Board of Adjustments
was called to order at 6:30 p.m by Chair Scott.
New Planrvng Commissioners Eric Johnson and Paul Bell were sworn in at this time.
2. Consider September 15.2009 Board of Adjustments Agenda
MOVED BY COMMISSIONER ANDERSON AND SECONDED BY
COMMISSIONER LEMKE TO APPROVE THE SEPTEMBER 15, 2009 BOARD
OF ADJUSTMENTS AGENDA. MOTION CARRIED 7-0.
3. Consider August 11, 209_Board of Adjustments Minutes
MOVED BY COMMISSIONER ANDERSON AND SECONDED BY
COMMISSIONER LEMKE TO APPROVE THE AUGUST 11, 2009 BOARD OF
ADJUSTMENTS MINUTES. MOTION CARRIED 7-0.
4. Request bvAdam Kersten for Side Yard Setback Variance to Construct Deck Case No. V
09-05 -Public Hearin
Mr. Leeseberg presented the staff report. He reviewed the variance criteria, stating that staff
felt the applicant meets all five of the standards and recommends approval of thequest.
Chair Scott opened the public hearing. There being no public comment, Chair/Scott closed
the public hearing.
Commissioner Westberg asked if the proposed deck would impact the neighbor's satellite
dish. Mr. Kersten, the applicant, stated that he has spoken with the neighbor and agreed
there would be no problem with the location.
MOTION BY LEMKE, SECONDED BY WESTBERG TO APPROVE THE
REQUEST BY ADAM KERSTEN FOR A SIDE YARD SETBACK VARIANCE,
CASE NO. V 09-05. MOTION CARRIED 7-0.
