SUBJECT: HAZARDOUS PROPERTY
JAMES AND KIRT CHAREST
The Council is aware of the situation with the Charest property located on
east Highway 10 and staffs efforts to date to get the property cleaned-up. On
October 30, 1996 the City served James and Kirt Charest an order under the
Hazardous Property State Statute (Minn. Stat. 463.15) to clean-up the
property within thirty days. The law provides the City the ability to obtain a
court judgment allowing the City to remove the hazardous condition at the
site, if the order is not complied with in the specified 30 days.
A site inspection by Stephen Rohlf and City Attorney Kevin Johnson on
December 3, 1996 found progress on the clean-up of the property
unacceptable. Approximately forty junk vehicles remain on the site. Staff
will provide pictures from this inspection to the Council at Monday night's
meeting.
Staff recommends the City seek a court judgment that allows it to
clean-up this site. Staff cautions the Council that this clean-up will be
costly. The City can recoup its cost by assessing the property, but this can
take some time to collect.
