Preliminary and Final Plat Request
for the Heying Addition (Pat Heying),
Public Hearing Case No. P 96-11
Issue
Consider preliminary and final plat approval by Pat Heying for the Heying
Addition.
Background
This application has been postponed by the Council at previous meetings due
to some concerns that staff has raised regarding the proposed development.
The developer is working closely with some prospective purchasers of the
lots, namely, Holiday Companies, Blockbuster Video, and Applebee's
Restaurant. The fourth lot as proposed on the plat does not have a specific
tenant identified with the parcel, however, has been designed for general
retail purposes. Staff has been working closely with the developer and
specifically, Holiday, since they have submitted their application for review
and consideration. Both of these plans for the plat and Holiday's
development plans have been tracking closely together, as both the plat and
the development plans are to compliment one another. However, staff has
raised a number of issues with the proposed plat that have an impact on
Holiday's development plans. Therefore, when one changes, the other is also
impacted. At this time staff believes that there are still issues that need to
be addressed as part of the plat before a recommendation could be made to
the City Council.
The primary issues staff has raised with the developer and Holiday include
the following:
· The proximity of the first access point into the plat north of School Street
· The design of the storm drainage ponds
· The number of access points onto Freeport

Staff has discussed these issues with the developer and they are in the
process of making adjustments to the plat as well as the development plans
to address these concerns. In discussing these with the developer last week,
the changes that will be made and presented to the Council Monday night
include the following:
· Shifting the first driveway entrance north of School Street further to the
north to a location immediately south of the existing pine trees
· Redesigning the storm water ponds by removing the proposed retaining
walls (5 ft. high) and flattening the slope out to a 4:1 side slope
· Reconfiguring some of the entrances from Freeport into the development
to allow for safer ingress and egress.
By making some of these changes, staff believes both the plat and the
potential development of each of the parcels can then take place without
compromising the bigger issues such as troffic, storm drainage and overall
development of the property.
Concept Plan
At Monday night's meeting the developer and his engineer will be present to
answer any questions the Council may have. The intent Monday night is to
have the Council review the preliminary plat, as well as a sketch drawing
that will be handed out, addressing some of the concerns addressed by staff.
The developer is prepared at this point to ask the Council to postpone any
action on the preliminary and final plat and have the item addressed at the
January 21st City Council meeting.
Action Requested
It is recommended the City Council postpone action on the preliminary and
final plat request by Pat Heying (Heying Addition) until the January 21,
1997 City Council meeting. It is also requested that ff the Council has any
additional issues they would like to share with the developer regarding the
plat, these be brought up Monday night so they can be incorporated into the
revised plans to be submitted back to the Council in January.
