As you are aware, the public hearing for the 1995 Overlay Improvement project is
scheduled for the June 26, 1995, City Council meeting. The areas to be overlaid aze
Greenhead Acres 1st, 2nd, and 3rd Additions, Country Side Acres, and the Avon Acres
CMLENGINEERINCa Area. As you recall from the feasibility study, the project is proposed to be 100% assessed
ENmaoNMRNTA` to the benefitting property owners at a rate of $1,505 per unit.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ORDERING THE IMPROVEMENT
IN THE MATTER OF THE
1995 BITUMINOUS OVERLAY IMPROVEMENT
VL'FIEREAS a public hearing relating to the 1995 Bituminous Overlay improvement was held
before the Elk River City Council after ten days mailed notice and two weeks
published notice of the hearing was given; and
WHEREAS the City Council has duly considered the Feasibility Report and those matters
presented at the public hearing by those persons desiring to be heard on the matter,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1. The 1995 Bituminous Overlay improvement is hereby ordered as recommended in the
Fusibility Report dated May 31, 1995.
Passed and adopted this 26th day of June, 1995.

• A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS
AND ORDERING THE ADVERTISEMENT FOR BIDS
IN THE MATTER OF THE
1995 BITUMINOUS OVERLAY IMPROVEMENT
WHEREAS pursuant to Resolution 95-29, the Project Engineer has prepared plans and
specifications for the 1995 Bituminous Overlay improvement, which plans and
specifications have been reviewed by the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1. Such plans and specifications, a copy of which is attached hereto and incorporated herein
by this reference, are hereby approved.
2. The City Administrator shall prepare and obtain the publication of an advertisement for
bids for the making of the improvement pursuant to the attached plans and specifications.
The advertisement shall be published once each week for three consecutive weeks, shall
specify the work to be done, and shall state that the bids will be received by the City
• Administrator until 10:00 a.m. on July 19, 1995, at which time the bids will be publicly
opened in the Council chambers of the City Hall by the City Administrator and the Project
Engineer and will then be tabulated for consideration by the City Council at a meeting
thereof at 7:00 o'clock p.m. on July 24, 1995, in the City Council chambers at City Hall.
No bids will be considered unless sealed and filed with the City Administrator and
accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to
the City Administrator in the amount of 5 % of the amount of such bid.

Dear Mayor and City Council,
We will be out of town on the 26th of June and therefore are writing to express our
concerns on the proposed overlay improvements in our neighborhood. Our residence is
on lot 2, block 1, Greenhead Acres 3rd addition.
The general condition of Vernon Street is pretty good. There aze a few small azeas
starting to break up, which some good quality patching would ensure another 5 yeazs of
maintenance free road for the city and its tax payers. We just don't have the volume of
traffic to justify resurfacing the entire street.
We have been residents of Elk River for 23 yeazs and have seen our taxes leaping every
year. I have seen the city discourage too many business prospectives that would have
lessened the tax burden, or at least supported our school system. We've reached the
extent of our ability to pay any higher taxes and relocation may become an unfortunate
possibility.
