5.3 Consider Request For Transient Merchant License By James Fitchie
To Sell Ice Cream From A Truck
Mr. James Fitchie has requested to sell ice cream novelties from a
vending truck in the City of Elk River. Mr. Fitchie has indicated that
he intends to sell ice cream at Orono beach. In 1993, the City Council
approved a Transient Merchant license for Mr. James Fitchie to sell
ice cream novelties from his vending truck at Orono beach excluding
the dates of the Fourth of July Celebration and the Community
Festival.
• Mr. Fitchie has submitted an application and license fee and the Police
Chief has signed off on the required background check.
RECOMMENDATION
Staff recommends that Council approve a Transient Merchant license
for Mr. Fitchie to allow the sale of ice cream novelties from a vending
truck in the City of Elk River and at Orono beach, excluding the days
of the Fourth of July Celebration and the Community Festival.
5.4 Consider Request For Cigarette License By Target
Target has submitted an application for a license to sell cigarettes at
the location of 19146 Freeport Avenue in the city of Elk River.
RECOMMENDATION
Staff recommends that City Council approve a license for Target to sell
cigarettes at 19146 Freeport Avenue.

5.5 Repuest For Temporary 3.2 Beer On-Sale License
• 5.5A Fourth of July Celebration
The City of Elk River has received a request from the Elk River Area
Chamber of Commerce for a temporary one day non-intoxicating malt
liquor on-sale license. This license would allow the sale of 3.2 beer to
be sold on the premises at Lake Orono Park during the Fourth of July
Celebration.
During the past, the Council has waived the $20.00 license fee for this
request.
The Chamber of Commerce has submitted its application and
certificate of insurance.
Staff recommends that the City Council approve a 3.2 temporary on-
sale beer license for the Elk River Area Chamber of Commerce to sell
non-intoxicating Malt Liquor on July 4th at Lake Orono Park and that
the license fee of $20.00 be waived.
• 5.5B Sherburne County Fair
The City has received an application from the Elk River Lions for a
temporary 3.2 beer on-sale license. The license would allow the Lions
to sell 3.2 beer on the premises of the Sherburne County Fairgrounds
during the Sherburne County Fair from July 20 -July 23. The Elk
River Lions have submitted the application, license fee, and liquor
liability insurance.
RECOMMENDATION
City staff recommends that the City Council approve a temporary 3.2
beer on-sale license for the Elk River Lions to sell beer on-sale at the
Sherburne County Fairgrounds during the Sherburne County Fair
from July 20 -July 23.
